5057 BE IT ENACTED BY THE PEOPLE OF TH E STATE OF OKLAHOMA:
5158 SECTION 1. AMENDATORY 43A O.S. 2011, Section 1 -103, as
5259 last amended by Section 29, Chapter 475, O.S.L. 2019 (43A O.S. Supp.
5360 2020, Section 1-103), is amended to read as follows:
5461 Section 1-103. When used in this title, unless otherwise
5562 expressly stated, or unless the context or subject matter otherwise
5663 requires:
5764 1. "Department" means the Department of Mental Health and
5865 Substance Abuse Services;
59-2. "Chair" means the chair of the Board of Mental Health and
60-Substance Abuse Services;
61-3. "Mental illness" means a substantial disorder of thought,
62-mood, perception, psychological orienta tion or memory that

93+2. "Chair" means the chair of the Board of Mental Health and
94+Substance Abuse Services;
95+3. "Mental illness" means a substantial disorder of thought,
96+mood, perception, psychological orientation or memory that
8997 significantly impairs judgment, behavior, capacity to recognize
9098 reality or ability to meet the ordinary demands of life;
9199 4. "Board" means the Board of Mental Health and Substance Abuse
92100 Services as established by the Mental Health Law;
93101 5. "Commissioner" means the individual selected and appointed
94102 by the Board to serve as Commissioner of Mental Health and Substance
95103 Abuse Services;
96104 6. "Indigent person" means a person who has not sufficient
97105 assets or resources to support the person and to support members of
98106 the family of the person lawfully dependent on the person for
99107 support;
100108 7. "Facility" means any hospital, school, building, house or
101109 retreat, authorized by law to have the care, treatment or custody of
102110 an individual with mental illness, or drug or alcohol dependency,
103111 gambling addiction, eating disorders, an opioid substitution
104112 treatment program, including, but not lim ited to, public or private
105113 hospitals, community mental health centers, clinics, satellites or
106114 facilities; provided, that facility shall not mean a child guidance
107115 center operated by the State Department of Health;
108-8. "Consumer" means a person under care or treatment in a
109-facility pursuant to the Mental Health Law, or in an outpatient

143+8. "Consumer" means a person under care or treatment in a
144+facility pursuant to the Mental Health Law, or in an outpatient
145+status;
137146 9. "Care and treatment" means medical care and behavioral
138147 health services, as well as food, clothing and maintenance,
139148 furnished to a person;
140149 10. Whenever in this law or in any other law, or in any rule or
141150 order made or promulgated pursuant to this law or to any other law,
142151 or in the printed forms prepared for the admission of consumers or
143152 for statistical reports, the words "insane", "insanity", "lunacy",
144153 "mentally sick", "mental disease" or "mental disorder" are used,
145154 such terms shall have equal significance to the words "mental
146155 illness";
147156 11. "Licensed mental health professional " means:
148157 a. a psychiatrist who is a diplomate of the American
149158 Board of Psychiatry and Neurolo gy,
150159 b. a psychiatrist who is a diplomate of the American
151160 Osteopathic Board of Neurology and Psychiatry,
152161 c. a physician licensed pursuant to the Oklahoma
153162 Allopathic Medical and Surgical Licensure and
154163 Supervision Act or the Oklahoma Osteopathic Medicine
155164 Act,
156-d. a clinical psychologist who is duly licensed to
157-practice by the State Board of Examiners of
158-Psychologists,
159-e. a professional counselor licensed pursuant to the
160-Licensed Professional Counselors Act,

192+d. a clinical psychologist who is duly licensed to
193+practice by the State Board of Examiners of
194+Psychologists,
195+e. a professional counselor licensed pursuant to the
196+Licensed Professional Counselors Act,
187197 f. a person licensed as a clinical social worker pursu ant
188198 to the provisions of the Social Worker 's Licensing
189199 Act,
190200 g. a licensed marital and family therapist as defined in
191201 the Marital and Family Therapist Licensure Act,
192202 h. a licensed behavioral practitioner as defined in the
193203 Licensed Behavioral Practitioner Ac t,
194204 i. an advanced practice nurse as defined in the Oklahoma
195205 Nursing Practice Act,
196206 j. a physician's assistant who is licensed in good
197207 standing in this state, or
198208 k. a licensed drug and alcohol counselor/mental health
199209 (LADC/MH) as defined in the Licensed Alco hol and Drug
200210 Counselors Act;
201211 12. "Mentally incompetent person " means any person who has been
202212 adjudicated mentally or legally incompetent by an appropriate
203213 district court;
204-13. a. "Person requiring treatment " means a person who
205-because of his or her mental illness or drug or
206-alcohol dependency:
207-(1) poses a substantial risk of immediate physical
208-harm to self as manifested by ev idence or serious
209-threats of or attempts at suicide or other
210-significant self-inflicted bodily harm,

241+13. a. "Person requiring treatment " means a person who
242+because of his or her mental illness or drug or
243+alcohol dependency:
244+(1) poses a substantial risk of immediate physical
245+harm to self as manifested by evidence or serious
246+threats of or attempts at suicide or other
247+significant self-inflicted bodily harm,
237248 (2) poses a substantial risk of i mmediate physical
238249 harm to another person or persons as manifested
239250 by evidence of violent behavior directed toward
240251 another person or persons,
241252 (3) has placed another person or persons in a
242253 reasonable fear of violent behavior directed
243254 towards such person or p ersons or serious
244255 physical harm to them as manifested by serious
245256 and immediate threats,
246257 (4) is in a condition of severe deterioration such
247258 that, without immediate intervention, there
248259 exists a substantial risk that severe impairment
249260 or injury will result to the person, or
250261 (5) poses a substantial risk of immediate serious
251262 physical injury to self or death as manifested by
252263 evidence that the person is unable to provide for
253-and is not providing for his or her basic
254-physical needs.
255-b. The mental health or substance abuse history of the
256-person may be used as part of the evidence to
257-determine whether the person is a person requiring
258-treatment or an assisted outpatient. The mental
259-health or substance abuse history of the person shall
260-not be the sole basis for this determination.

292+physical needs.
293+b. The mental health or substanc e abuse history of the
294+person may be used as part of the evidence to
295+determine whether the person is a person requiring
296+treatment or an assisted outpatient. The mental
297+health or substance abuse history of the person shall
298+not be the sole basis for this de termination.
287299 c. Unless a person also meets the criteria established in
288300 subparagraph a or b of this paragraph, "person
289301 requiring treatment" or an "assisted outpatient" shall
290302 not mean:
291303 (1) a person whose mental processes have been
292304 weakened or impaired by rea son of advanced years,
293305 dementia, or Alzheimer 's disease,
294306 (2) a person with intellectual or developmental
295307 disability as defined in Title 10 of the Oklahoma
296308 Statutes,
297309 (3) a person with seizure disorder,
298310 (4) a person with a traumatic brain injury, or
299311 (5) a person who is homeless.
300312 d. A person who meets the criteria established in this
301313 section but who is medically unstable, or the facility
302314 holding the person is unable to treat the additional
303-medical conditions of that person, should be
304-discharged and transported in accordance with Section
305-1-110 of this title;
306-14. "Petitioner" means a person who files a petition alleging
307-that an individual is a person requiring treatment or an assisted
308-outpatient;
309-15. "Executive director" means the person in charge of a
310-facility as defined in this section;

342+medical conditions of that person, should be
343+discharged and transported in accordance with Section
344+1-110 of this title;
345+14. "Petitioner" means a person who files a petition alleging
346+that an individual is a person requiring treatment or an assisted
347+outpatient;
348+15. "Executive director" means the person in charge of a
349+facility as defined in this section;
337350 16. "Private hospital or facility " means any general hospital
338351 maintaining a neuro-psychiatric unit or ward, or any private
339352 hospital or facility for care and treatment of a person having a
340353 mental illness, which is not supported by the state or federal
341354 government. The term "private hospital" or "facility" shall not
342355 include nursing homes or other facilities maintained primarily for
343356 the care of elderly and disabled persons;
344357 17. "Individualized treatment plan " means a proposal dev eloped
345358 during the stay of an individual in a facility, under the provisions
346359 of this title, which is specifically tailored to the treatment needs
347360 of the individual. Each plan shall clearly include the following:
348361 a. a statement of treatment goals or objecti ves, based
349362 upon and related to a clinical evaluation, which can
350363 be reasonably achieved within a designated time
351364 interval,
352-b. treatment methods and procedures to be used to obtain
353-these goals, which methods and procedures are related
354-to each of these goals and which include specific
355-prognosis for achieving each of these goals,
356-c. identification of the types of professional per sonnel
357-who will carry out the treatment procedures, including
358-appropriate medical or other professional involvement
359-by a physician or other health professional properly

393+these goals, which methods and procedures are related
394+to each of these goals and which include specific
395+prognosis for achieving each of these goals,
396+c. identification of the types of professional personnel
397+who will carry out the treatment procedures, including
398+appropriate medical or other professional involvement
399+by a physician or other health professional properly
386400 qualified to fulfill legal requirements mandated under
387401 state and federal law,
388402 d. documentation of involvement by the individual
389403 receiving treatment and, if applicable, the accordance
390404 of the individual with the treatment p lan, and
391405 e. a statement attesting that the executive director of
392406 the facility or clinical director has made a
393407 reasonable effort to meet the plan 's individualized
394408 treatment goals in the least restrictive environment
395409 possible closest to the home community of the
396410 individual;
397411 18. "Substance abuse records " referenced in this title shall
398412 mean medical records governed by 42 U.S.C. , Section 290dd-2 and not
399413 any other records;
400414 19. "Telemedicine" means the practice of health care delivery,
401415 diagnosis, consultation, e valuation, treatment, transfer of medical
402-data, or exchange of medical education information by means of
403-audio, video, or data communications. Telemedicine uses audio and
404-video multimedia telecommunication equipment which permits two -way
405-real-time communication between a health care practitioner and a
406-patient who are not in the same physical location. Telemedicine
407-shall not include consultation provided by telephone or facsimile
408-machine;

445+video multimedia telecommunication equipment which permits two -way
446+real-time communication between a health care practitioner and a
447+patient who are not in the same physical location. Telemedicine
448+shall not include consultation provided by telephone or facsimile
449+machine;
435450 19. 20. "Recovery and recovery support " means nonclinical
436451 services that assist individuals and families to recover from
437452 alcohol or drug problems. They include social support, linkage to
438453 and coordination among allied service providers, including but not
439454 limited to transportation to and from treatment or employment,
440455 employment services and job training, case management and individual
441456 services coordination, life skills education, relapse prevention,
442457 housing assistance, child care, and substance abuse education;
443458 20. 21. "Assisted outpatient" means a person who:
444459 a. is either currently under the care of a facility
445460 certified by the Department of Mental Health and
446461 Substance Abuse Services as a Community Mental Health
447462 Center, or is being discharged from the custody of the
448463 Oklahoma Department of Corrections, or is being
449464 discharged from a residential placement by the Office
450465 of Juvenile Affairs,
451466 b. is suffering from a mental illness,
452-c. is unlikely to survive safely in the community without
453-supervision, based on a clinical determination,
454-d. has a history of lack of compliance with treatment for
455-mental illness that has:
456-(1) prior to the filing of a petition, at least twice
457-within the last thirty -six (36) months been a
458-significant factor in necessitating

495+supervision, based on a clinical determination,
496+d. has a history of lack of compliance with tre atment for
497+mental illness that has:
498+(1) prior to the filing of a petition, at least twice
499+within the last thirty -six (36) months been a
500+significant factor in necessitating
485501 hospitalization or treatment in a hospital or
486502 residential facility, including admiss ion to a
487503 community-based structured crisis center as
488504 certified by the Oklahoma Department of Mental
489505 Health and Substance Abuse Services, or receipt
490506 of services in a forensic or other mental health
491507 unit of a correctional facility, or a specialized
492508 treatment plan for treatment of mental illness in
493509 a secure juvenile facility or placement in a
494510 specialized residential program for juveniles, or
495511 (2) prior to the filing of the petition, resulted in
496512 one or more acts of serious violent behavior
497513 toward self or others or threats of, or attempts
498514 at, serious physical harm to self or others
499515 within the last twenty -four (24) months,
500516 e. is, as a result of his or her mental illness, unlikely
501517 to voluntarily participate in outpatient treatment
502-that would enable him or her to live safely in the
503-community,
504-f. in view of his or her treatment history and current
505-behavior, is in need of assisted outpati ent treatment
506-in order to prevent a relapse or deterioration which
507-would be likely to result in serious harm to the
508-person or persons as defined in this section, and

546+community,
547+f. in view of his or her treatment history and current
548+behavior, is in need of assisted outpatient treatment
549+in order to prevent a relapse or deterioration which
550+would be likely to result in serious harm to the
551+person or persons as defined in this section, and
535552 g. is likely to benefit from assisted outpatient
536553 treatment; and
537554 21. 22. "Assisted outpatient treatment " means outpatient
538555 services which have been ordered by the court pursuant to a
539556 treatment plan approved by the court to tr eat an assisted
540557 outpatient's mental illness and to assist the person in living and
541558 functioning in the community, or to attempt to prevent a relapse or
542559 deterioration that may reasonably be predicted to result in suicide
543560 or the need for hospitalization.
544561 SECTION 2. This act shall become effective November 1, 2021 .
