35100 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

37101 SECTION 1. NEW LAW A n ew section of law to be codified
38102 in the Oklahoma Statutes as Section 11 -202.1 of Title 47, unless
39103 there is created a duplication in numbering, reads as follows:

41104 A. For the purposes of this section:

43-1. "Bicycle" means a device as defined in subsection A of
105+1. “Bicycle” means a device as defined in subsection A o f
44106 Section 1-104 of Title 47 of the Oklahoma Statutes; and

69150 C. 1. A person operating a bicycle approaching a steady red
70151 traffic-control signal shall:

72152 a. make a complete stop at the steady red traffic -control

75154 b. yield the right-of-way to all oncoming traffic that

99198 It shall be unlawful for any person to maliciously throw an
100199 object at or in the direction of any person riding a bicycle, equine
101-or animal-drawn vehicle. Any person convicted of the provisions of

102201 this section shall be guilty of a misdemeanor punishable by
103202 imprisonment in the county jail for a term of not more than one (1 )
104203 year, or by a fine not to exceed Five Hundred Dollars ($500.00), or

107205 SECTION 3. AMENDATORY 47 O.S. 2011, Section 11 -202, as
108206 amended by Section 1, Chapter 62, O.S.L. 2019 (47 O.S. Supp. 2020,

111208 Section 11-202. Whenever traffic is controlled by traffic
112209 control traffic-control signals exhibiting different colored lights
113210 or colored lighted arrows successively one at a time, or in
114211 combination, only the c olors green, red and yellow shall be used,
115212 except for special pedestrian signals carrying a word legend, and
116213 the lights shall indicate and apply to drivers of vehicles and
117214 pedestrians as follows:

134254 movement indicated by such arrow, or such other

136256 the same time. Such vehicular traffic shall yield the
137257 right-of-way to pedestrians lawfully wit hin an
138258 adjacent crosswalk and to other traffic lawfully using

142261 signal, as provided in Section 11 -203 of this title,

157299 pedestrian-control signal as provided in Section 11 -
158300 203 of this title, are thereby advised that there is
159301 insufficient time to cross the roadway before a red
160302 indication is shown, and no pedestrian shall then
161303 start to cross the roadway; and

163304 3. Steady red indication:
164-
165305 a. vehicular traffic facing a steady circular red signal
166306 alone shall stop at a clearly marked stop line, but if
167307 none, before entering the crosswalk on the near side
168308 of the intersection or, if none, then before entering
169309 the intersection and shall remain standing until an
170310 indication to proceed is shown except as pro vided in
171311 subparagraphs b and d of this paragraph,

173312 b. except when a sign is in place prohibiting a turn,
174313 vehicular traffic facing any steady red signal may
175314 cautiously enter the intersection to turn right or to
176315 turn left from a one -way street into a one -way street
177316 after stopping as required by subparagraph a of this

183347 c. in order to prohibit r ight turns or left turns as
184348 prescribed in subparagraph b of this paragraph, on the
185349 red signal after the required stop, a municipality
186350 must erect clear, concise signs informing drivers that
187351 such turns are prohibited. The Highway Department
188352 shall specify the design of the sign to be used for
189353 this purpose, and it shall be used uniformly
190354 throughout the state,
191-
192355 d. notwithstanding any other provision of law, the driver
193356 of a motorcycle or bicycle facing any steady red
194357 signal may cautiously proceed through the inte rsection
195358 only if:
196-
197359 (1) the motorcycle or bicycle has been brought to a
198360 complete stop as required by subparagraph a of
199361 this paragraph,
200-
201362 (2) the traffic control traffic-control signal is
202363 programmed or engineered to change to a green
203364 signal only after detecting the approach of a
204365 motor vehicle and has failed to detect the
205366 arrival of the motorcycle or bicycle because of
206367 its size or weight, and

208368 (3) no motor vehicle or person is approaching on the
209369 roadway to be crossed or entered, or the motor
210370 vehicle or person is a t a distance from the

214399 The driver of any vehicle approaching the
215400 intersection, which lawfully may enter the
216401 intersection, shall have the right -of-way over any
217402 motorcycle or bicycle operator proceeding through a
218403 red light and, in no event where an accident results
219404 from the driver of the motorcycle or bicycle
220405 proceeding into the intersection on a red light, shall
221406 such driver of the vehicle be charged with any
222407 violation pursuant to Sections 11 -401 and 11-403 of
223408 this title relating to failure to yield right -of-way,

233416 In the event an official traffic -control signal is erected and
234417 maintained at a place other than an intersection, the provisions of
235418 this section shall be applicable except as to those provisions which
236419 by their nature can have no application. Any stop required shall be
237420 made at a sign or marking on the pavement indicating where the stop

241449 SECTION 4. AMENDATORY 47 O.S. 2011, Section 11 -606, is
242450 amended to read as follows:

244451 Section 11-606. All signals herein required given by hand and
245452 arm shall be given from the left side of the vehicle in the
246453 following manner and such signals shall indicate as follows:

248454 1. Left turn. Hand and arm extended horizontally .;
249-
250455 2. Right turn. Hand and arm extended upward. A person
251456 operating a bicycle may extend his or her ri ght hand and arm
252457 horizontally to his or her right; and
253-
254458 3. Stop or decrease speed. Hand and arm extended downward. A
255459 person operating a bicycle may extend his or her right hand and arm
256460 downward to his or her right side.

258461 SECTION 5. AMENDATORY 47 O.S. 2011, Section 12 -401, is
259462 amended to read as follows:

261463 Section 12-401. A. Every motor vehicle when operated upon a
262464 highway shall be equipped with a horn in good working order and
263465 capable of emitting sound audible under normal conditio ns from a
264466 distance of not less than two hundred (200) feet, but no horn or
265467 other warning device shall emit an unreasonably loud or harsh sound.
266468 The driver of a motor vehicle shall, when reasonably necessary to
267469 insure ensure safe operation, give audible wa rning with a horn but
268470 shall not otherwise use such horn when upon a highway. No driver of

497+any vehicle shall use a horn when passing a person riding a bicycle,
270498 equine or animal-drawn vehicle under normal conditions if no
271499 imminent danger of a collision exis ts.

273500 B. No vehicle shall be equipped with nor shall any person use
274501 upon a vehicle any siren, except as otherwise permitted in
275502 subsection D of this section.
276-
277503 C. Any vehicle may be equipped with a theft alarm signal device
278504 which is so arranged that it cannot be used by the driver as an
279505 ordinary warning signal. A theft alarm signal device shall not use
280506 a siren, as described in subsection D of this section.
281-
282507 D. Every authorized emergency vehicle shall, in addition to any
283508 other equipment and distinctive marking s required by this title, be
284509 equipped with a siren, or similar device, capable of emitting sound
285510 audible under normal conditions from a distance of not less than
286511 five hundred (500) feet and of a type approved by the Department of
287512 Public Safety, but such si ren shall not be used except when such
288513 vehicle is operated in response to an emergency call or in the
289514 immediate pursuit of an actual or suspected violator of the law, in
290515 which said latter events the driver of such vehicle shall sound said
291516 siren when reasonably necessary to warn pedestrians and other
292517 drivers of the approach thereof.

294518 E. It shall be unlawful for any person to use a device capable
295519 of producing auditory warning signals similar to that on an
296520 authorized emergency vehicle or to use audible signal equipment from

806+insufficient time to cross the roadway before a red
807+indication is shown, and no pedestrian shall then
808+start to cross the roadway; and
809+3. Steady red indication:
810+a. vehicular traffic facing a steady circular red signal
811+alone shall stop at a clearly marked stop line, but if
812+none, before entering the crosswalk on the near side
813+of the intersection or, if none, then before entering
814+the intersection and shall remain standing until an
815+indication to proceed is shown except as provided in
816+subparagraphs b and d of this paragraph,
817+b. except when a sign is in place prohibiting a turn,
818+vehicular traffic facing any steady red signal may
819+cautiously enter the intersection to turn right or to
820+turn left from a one -way street into a one -way street
821+after stopping as required by subparagraph a of this
822+paragraph. Such vehicular traffic shall yield the
823+right-of-way to pedestrians lawfully within an
824+adjacent crosswalk and to other traffic lawfully using
825+the intersection,

852+c. in order to prohibit right turns or left turns as
853+prescribed in subparagraph b of this paragraph, on the
854+red signal after the required stop, a municipality
855+must erect clear, concise signs informi ng drivers that
856+such turns are prohibited. The Highway Department
857+shall specify the design of the sign to be used for
858+this purpose, and it shall be used uniformly
859+throughout the state,
860+d. notwithstanding any other provision of law, the driver
861+of a motorcycle or bicycle facing any steady red
862+signal may cautiously proceed through the intersection
863+only if:
864+(1) the motorcycle or bicycle has been brought to a
865+complete stop as required by subparagraph a of
866+this paragraph,
867+(2) the traffic-control signal is progra mmed or
868+engineered to change to a green signal only after
869+detecting the approach of a motor vehicle and has
870+failed to detect the arrival of the motorcycle or
871+bicycle because of its size or weight, and
872+(3) no motor vehicle or person is approaching on the
873+roadway to be crossed or entered, or the motor
874+vehicle or person is at a distance from the

902+immediate hazard.
903+The driver of any vehicle approaching the
904+intersection, which lawfully may enter the
905+intersection, shall hav e the right-of-way over any
906+motorcycle or bicycle operator proceeding through a
907+red light and, in no event where an accident results
908+from the driver of the motorcycle or bicycle
909+proceeding into the intersection on a red light, shall
910+such driver of the vehi cle be charged with any
911+violation pursuant to Sections 11 -401 and 11-403 of
912+this title relating to failure to yield right -of-way,
913+Section 11-310 of this title relating to following too
914+closely, or Section 11 -801 of this title relating to
915+driving too fast for conditions, and
916+e. unless otherwise directed by a pedestrian -control
917+signal as provided in Section 11 -203 of this title,
918+pedestrians facing a steady circular red signal alone
919+shall not enter the roadway.
920+In the event an official traffic -control signal is erected and
921+maintained at a place other than an intersection, the provisions of
922+this section shall be applicable except as to those provisions which
923+by their nature can have no application. Any stop required shall be
924+made at a sign or marking on the pav ement indicating where the stop

952+stop shall be made at the signal.
953+SECTION 9. AMENDATORY 47 O.S. 2011, Section 11 -606, is
954+amended to read as follows:
955+Section 11-606. All signals herein required given by hand and
956+arm shall be given from the left side of the vehicle in the
957+following manner and such signals shall indicate as follows:
958+1. Left turn. Hand and arm extended horizontally .;
959+2. Right turn. Hand and arm exte nded upward. A person
960+operating a bicycle may extend his or her right hand and arm
961+horizontally to his or her right ; and
962+3. Stop or decrease speed. Hand and arm extended downward. A
963+person operating a bicycle may extend his or her right hand and arm
964+downward to his or her right side.
965+SECTION 10. AMENDATORY 47 O.S. 2011, Section 11 -901, is
966+amended to read as follows:
967+Section 11-901. A. It shall be deemed reckless driving for any
968+person to drive a motor vehicle in a careless or wanton manner
969+without regard for the safety of persons or property or in violation
970+of the conditions outlined in Section 11 -801 of this title.
971+B. It shall be deemed reckless driving for any person driving a
972+motor vehicle to harass, taunt or maliciously th row an object at or
973+in the direction of any person riding a bicycle , equine or animal-
974+drawn vehicle.

1001+C. Every person convicted of reckless driving shall be punished
1002+upon a first conviction by imprisonment for a period of not less
1003+than five (5) days nor mo re than ninety (90) days, or by a fine of
1004+not less than One Hundred Dollars ($100.00) nor more than Five
1005+Hundred Dollars ($500.00), or by both such fine and imprisonment; on
1006+a second or subsequent conviction, punishment shall be imprisonment
1007+for not less than ten (10) days nor more than six (6) months, or by
1008+a fine of not less than One Hundred Fifty Dollars ($150.00) nor more
1009+than One Thousand Dollars ($1,000.00), or by both such fine and
1010+imprisonment.
1011+SECTION 11. AMENDATORY 47 O.S. 2011, Section 12-401, is
1012+amended to read as follows:
1013+Section 12-401. A. Every motor vehicle when operated upon a
1014+highway shall be equipped with a horn in good working order and
1015+capable of emitting sound audible under normal conditions from a
1016+distance of not less than two hundred (200) feet, but no horn or
1017+other warning device shall emit an unreasonably loud or harsh sound.
1018+The driver of a motor vehicle shall, when reasonably necessary to
1019+insure ensure safe operation, give audible warning with a horn but
1020+shall not otherwise use such horn when upon a highway. No driver of
1021+any vehicle shall use a horn when passing a person riding a bicycle,
1022+equine or animal-drawn vehicle under normal conditions if no
1023+imminent danger of a collision exists.

1050+B. No vehicle shall be equipped with nor shall any person use
1051+upon a vehicle any siren, except as otherwise permitted in
1052+subsection D of this section.
1053+C. Any vehicle may be equipped with a theft alarm signal device
1054+which is so arranged that it cannot be used by the drive r as an
1055+ordinary warning signal. A theft alarm signal device shall not use
1056+a siren, as described in subsection D of this section.
1057+D. Every authorized emergency vehicle shall, in addition to any
1058+other equipment and distinctive markings required by this ti tle, be
1059+equipped with a siren, or similar device, capable of emitting sound
1060+audible under normal conditions from a distance of not less than
1061+five hundred (500) feet and of a type approved by the Department of
1062+Public Safety, but such siren shall not be used except when such
1063+vehicle is operated in response to an emergency call or in the
1064+immediate pursuit of an actual or suspected violator of the law, in
1065+which said latter events the driver of such vehicle shall sound said
1066+siren when reasonably necessary to war n pedestrians and other
1067+drivers of the approach thereof.
1068+E. It shall be unlawful for any person to use a device capable
1069+of producing auditory warning signals similar to that on an
1070+authorized emergency vehicle or to use audible signal equipment from
1071+a motor vehicle for the purpose of causing any other motor vehicle
1072+operator to yield right -of-way and stop, or which actually causes
1073+any other motor vehicle operator to yield the right -of-way and stop,
