35	100		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

37	101		SECTION 1. NEW LAW A n ew section of law to be codified
38	102		in the Oklahoma Statutes as Section 11 -202.1 of Title 47, unless
39	103		there is created a duplication in numbering, reads as follows:

41	104		A. For the purposes of this section:
42		-
43		-	1. "Bicycle" means a device as defined in subsection A of

44	106		Section 1-104 of Title 47 of the Oklahoma Statutes; and

69	150		C. 1. A person operating a bicycle approaching a steady red
70	151		traffic-control signal shall:

72	152		a. make a complete stop at the steady red traffic -control
73	153		signal before entering the intersection, a nd
74		-
75	154		b. yield the right-of-way to all oncoming traffic that
76	155		constitutes an immediate hazard during the time that
77	156		he or she is moving across or within the intersection.

79	157		2. If a person operating a bicycle determines there is no
80	158		immediate hazard, he or she may proceed through the steady red
81	159		traffic-control signal with caution.

83	160		3. A person operating a bicycle may make a:
84		-
85	161		a. right-hand turn at a steady red traffic -control signal
86	162		without stopping after slowing to a reasonable speed
87	163		and yielding the right -of-way, if required, to
88	164		oncoming traffic that constitutes an immediate hazard,
89	165		or

91	166		b. left-hand turn onto a one -way street at a steady red
92	167		traffic-control signal after stopping and yielding to
93	168		oncoming traffic that constitutes an immediate hazard.

95	169		SECTION 2. NEW LAW A new section of law to be codified

99	198		It shall be unlawful for any person to maliciously throw an
100	199		object at or in the direction of any person riding a bicycle, equine
101		-	or animal-drawn vehicle. Any person convicted of the provisions of

102	201		this section shall be guilty of a misdemeanor punishable by
103	202		imprisonment in the county jail for a term of not more than one (1 )
104	203		year, or by a fine not to exceed Five Hundred Dollars ($500.00), or

107	205		SECTION 3. AMENDATORY 47 O.S. 2011, Section 11 -202, as
108	206		amended by Section 1, Chapter 62, O.S.L. 2019 (47 O.S. Supp. 2020,
109	207		Section 11-202), is amended to read as follows:

111	208		Section 11-202. Whenever traffic is controlled by traffic
112	209		control traffic-control signals exhibiting different colored lights
113	210		or colored lighted arrows successively one at a time, or in
114	211		combination, only the c olors green, red and yellow shall be used,
115	212		except for special pedestrian signals carrying a word legend, and
116	213		the lights shall indicate and apply to drivers of vehicles and
117	214		pedestrians as follows:

119	215		1. Green indication:

121	216		a. vehicular traffic facing a circular green signal,
122	217		except when prohibited under Section 11 -1302 of this
123	218		title, may proceed straight through or turn right or
124	219		left unless a sign at such place prohibits either such

134	254		movement indicated by such arrow, or such other

136	256		the same time. Such vehicular traffic shall yield the
137	257		right-of-way to pedestrians lawfully wit hin an
138	258		adjacent crosswalk and to other traffic lawfully using

141	260		c. unless otherwise directed by a pedestrian -control
142	261		signal, as provided in Section 11 -203 of this title,
143	262		pedestrians facing any green signal, except when the
144	263		sole green signal is a turn arrow, may proceed across
145	264		the roadway within any marked or unmarked crosswalk;

147	265		2. Steady yellow indication:

149	266		a. vehicular traffic facing a steady circular yellow or
150	267		yellow arrow signal is thereby warned that the related
151	268		green movement is bei ng terminated or that a red

160	302		indication is shown, and no pedestrian shall then

163	304		3. Steady red indication:

165	305		a. vehicular traffic facing a steady circular red signal
166	306		alone shall stop at a clearly marked stop line, but if
167	307		none, before entering the crosswalk on the near side
168	308		of the intersection or, if none, then before entering
169	309		the intersection and shall remain standing until an
170	310		indication to proceed is shown except as pro vided in
171	311		subparagraphs b and d of this paragraph,

173	312		b. except when a sign is in place prohibiting a turn,
174	313		vehicular traffic facing any steady red signal may
175	314		cautiously enter the intersection to turn right or to
176	315		turn left from a one -way street into a one -way street
177	316		after stopping as required by subparagraph a of this
178	317		paragraph. Such vehicular traffic shall yield the

184	348		prescribed in subparagraph b of this paragraph, on the
185	349		red signal after the required stop, a municipality
186	350		must erect clear, concise signs informing drivers that
187	351		such turns are prohibited. The Highway Department
188	352		shall specify the design of the sign to be used for
189	353		this purpose, and it shall be used uniformly
190	354		throughout the state,
191		-
192	355		d. notwithstanding any other provision of law, the driver
193	356		of a motorcycle or bicycle facing any steady red
194	357		signal may cautiously proceed through the inte rsection
195	358		only if:
196		-
197	359		(1) the motorcycle or bicycle has been brought to a
198	360		complete stop as required by subparagraph a of
199	361		this paragraph,
200		-
201	362		(2) the traffic control traffic-control signal is
202	363		programmed or engineered to change to a green
203	364		signal only after detecting the approach of a
204	365		motor vehicle and has failed to detect the
205	366		arrival of the motorcycle or bicycle because of
206	367		its size or weight, and
207		-
208	368		(3) no motor vehicle or person is approaching on the
209	369		roadway to be crossed or entered, or the motor
210	370		vehicle or person is a t a distance from the

214	399		The driver of any vehicle approaching the
215	400		intersection, which lawfully may enter the
216	401		intersection, shall have the right -of-way over any
217	402		motorcycle or bicycle operator proceeding through a
218	403		red light and, in no event where an accident results
219	404		from the driver of the motorcycle or bicycle
220	405		proceeding into the intersection on a red light, shall
221	406		such driver of the vehicle be charged with any
222	407		violation pursuant to Sections 11 -401 and 11-403 of
223	408		this title relating to failure to yield right -of-way,

231	415		shall not enter the roadway.

233	416		In the event an official traffic -control signal is erected and
234	417		maintained at a place other than an intersection, the provisions of
235	418		this section shall be applicable except as to those provisions which
236	419		by their nature can have no application. Any stop required shall be
237	420		made at a sign or marking on the pavement indicating where the stop

241	449		SECTION 4. AMENDATORY 47 O.S. 2011, Section 11 -606, is
242	450		amended to read as follows:

244	451		Section 11-606. All signals herein required given by hand and
245	452		arm shall be given from the left side of the vehicle in the
246	453		following manner and such signals shall indicate as follows:
247		-
248	454		1. Left turn. Hand and arm extended horizontally .;
249		-
250	455		2. Right turn. Hand and arm extended upward. A person
251	456		operating a bicycle may extend his or her ri ght hand and arm
252	457		horizontally to his or her right; and
253		-
254	458		3. Stop or decrease speed. Hand and arm extended downward. A
255	459		person operating a bicycle may extend his or her right hand and arm
256	460		downward to his or her right side.

258	461		SECTION 5. AMENDATORY 47 O.S. 2011, Section 12 -401, is
259	462		amended to read as follows:

261	463		Section 12-401. A. Every motor vehicle when operated upon a
262	464		highway shall be equipped with a horn in good working order and
263	465		capable of emitting sound audible under normal conditio ns from a
264	466		distance of not less than two hundred (200) feet, but no horn or
265	467		other warning device shall emit an unreasonably loud or harsh sound.
266	468		The driver of a motor vehicle shall, when reasonably necessary to
267	469		insure ensure safe operation, give audible wa rning with a horn but
268	470		shall not otherwise use such horn when upon a highway. No driver of

273	500		B. No vehicle shall be equipped with nor shall any person use
274	501		upon a vehicle any siren, except as otherwise permitted in
275	502		subsection D of this section.

277	503		C. Any vehicle may be equipped with a theft alarm signal device
278	504		which is so arranged that it cannot be used by the driver as an
279	505		ordinary warning signal. A theft alarm signal device shall not use
280	506		a siren, as described in subsection D of this section.
281		-
282	507		D. Every authorized emergency vehicle shall, in addition to any
283	508		other equipment and distinctive marking s required by this title, be
284	509		equipped with a siren, or similar device, capable of emitting sound
285	510		audible under normal conditions from a distance of not less than
286	511		five hundred (500) feet and of a type approved by the Department of
287	512		Public Safety, but such si ren shall not be used except when such
288	513		vehicle is operated in response to an emergency call or in the
289	514		immediate pursuit of an actual or suspected violator of the law, in
290	515		which said latter events the driver of such vehicle shall sound said
291	516		siren when reasonably necessary to warn pedestrians and other
292	517		drivers of the approach thereof.

294	518		E. It shall be unlawful for any person to use a device capable
295	519		of producing auditory warning signals similar to that on an
296	520		authorized emergency vehicle or to use audible signal equipment from

	665	+	C. 1. A person operating a bicycle approaching a steady red
	666	+	traffic-control signal shall:
	667	+	a. make a complete stop at the steady red traffic -control
	668	+	signal before entering the intersection, and
	669	+	b. yield the right-of-way to all oncoming traffic that
	670	+	constitutes an immediate hazard during the time that
	671	+	he or she is moving across or within the intersection.
	672	+	2. If a person operating a bicycle determines there is no
	673	+	immediate hazard, he or she may proceed through the steady red
	674	+	traffic-control signal with caution.
	675	+	3. A person operating a bicycle may make a:

	703	+	without stopping after slowing to a reasonable speed
	704	+	and yielding the right -of-way, if required, to
	705	+	oncoming traffic that constitutes an immediate hazard,

	707	+	b. left-hand turn onto a one -way street at a steady red
	708	+	traffic-control signal after stopping and yielding to
	709	+	oncoming traffic that constitutes an immediate hazard.
	710	+	SECTION 8. AMENDATORY 47 O.S. 2011, Section 11 -202, as
	711	+	amended by Section 1, Chapter 62, O.S.L. 2019 (47 O.S. Supp. 2020,
	712	+	Section 11-202), is amended to read as follows:
	713	+	Section 11-202. Whenever traffic is controlled by traffic -
	714	+	control signals exhibiting different colored lights or colored
	715	+	lighted arrows successively one at a time, or in combination, only
	716	+	the colors green, red and yellow shall be used, except for special
	717	+	pedestrian signals carrying a word legend, and the lights shall
	718	+	indicate and apply to drivers of vehicles and p edestrians as
	719	+	follows:
	720	+	1. Green indication:
	721	+	a. vehicular traffic facing a circular green signal,
	722	+	except when prohibited under Section 11 -1302 of this
	723	+	title, may proceed straight through or turn right or
	724	+	left unless a sign at such place prohibits either su ch

	754	+	intersection or an adjacent crosswalk at the time such
	755	+	signal is exhibited,
	756	+	b. vehicular traffic facing a green arrow signal, shown
	757	+	alone or in combination with another indication, may
	758	+	cautiously enter the intersection only to make the
	759	+	movement indicated by such arrow, or such other
	760	+	movement as is permitted by other indications shown at
	761	+	the same time. Such vehicular traffic shall yield the
	762	+	right-of-way to pedestrians lawfully within an
	763	+	adjacent crosswalk and to other traffic lawfully using
	764	+	the intersection, and
	765	+	c. unless otherwise directed by a pedestrian -control
	766	+	signal, as provided in Section 11 -203 of this title,
	767	+	pedestrians facing any green signal, except when the
	768	+	sole green signal is a turn arrow, may proceed across
	769	+	the roadway within any marked or unmarked crosswalk;
	770	+	2. Steady yellow indication:
	771	+	a. vehicular traffic facing a steady circular yel low or
	772	+	yellow arrow signal is thereby warned that the related
	773	+	green movement is being terminated or that a red
	774	+	indication will be exhibited immediately thereafter,

	802	+	b. pedestrians facing a steady circular yellow or yellow
	803	+	arrow signal, unless otherwise directed by a
	804	+	pedestrian-control signal as provided in Section 11 -
	805	+	203 of this title, are thereby advised that there is
	806	+	insufficient time to cross the roadway before a red
	807	+	indication is shown, and no pedestrian shall then
	808	+	start to cross the roadway; and
	809	+	3. Steady red indication:
	810	+	a. vehicular traffic facing a steady circular red signal
	811	+	alone shall stop at a clearly marked stop line, but if
	812	+	none, before entering the crosswalk on the near side
	813	+	of the intersection or, if none, then before entering
	814	+	the intersection and shall remain standing until an
	815	+	indication to proceed is shown except as provided in
	816	+	subparagraphs b and d of this paragraph,
	817	+	b. except when a sign is in place prohibiting a turn,
	818	+	vehicular traffic facing any steady red signal may
	819	+	cautiously enter the intersection to turn right or to
	820	+	turn left from a one -way street into a one -way street
	821	+	after stopping as required by subparagraph a of this
	822	+	paragraph. Such vehicular traffic shall yield the
	823	+	right-of-way to pedestrians lawfully within an
	824	+	adjacent crosswalk and to other traffic lawfully using
	825	+	the intersection,

	853	+	prescribed in subparagraph b of this paragraph, on the
	854	+	red signal after the required stop, a municipality
	855	+	must erect clear, concise signs informi ng drivers that
	856	+	such turns are prohibited. The Highway Department
	857	+	shall specify the design of the sign to be used for
	858	+	this purpose, and it shall be used uniformly
	859	+	throughout the state,
	860	+	d. notwithstanding any other provision of law, the driver
	861	+	of a motorcycle or bicycle facing any steady red
	862	+	signal may cautiously proceed through the intersection
	863	+	only if:
	864	+	(1) the motorcycle or bicycle has been brought to a
	865	+	complete stop as required by subparagraph a of
	866	+	this paragraph,
	867	+	(2) the traffic-control signal is progra mmed or
	868	+	engineered to change to a green signal only after
	869	+	detecting the approach of a motor vehicle and has
	870	+	failed to detect the arrival of the motorcycle or
	871	+	bicycle because of its size or weight, and
	872	+	(3) no motor vehicle or person is approaching on the
	873	+	roadway to be crossed or entered, or the motor
	874	+	vehicle or person is at a distance from the
	875	+

	902	+	immediate hazard.
	903	+	The driver of any vehicle approaching the
	904	+	intersection, which lawfully may enter the
	905	+	intersection, shall hav e the right-of-way over any
	906	+	motorcycle or bicycle operator proceeding through a
	907	+	red light and, in no event where an accident results
	908	+	from the driver of the motorcycle or bicycle
	909	+	proceeding into the intersection on a red light, shall
	910	+	such driver of the vehi cle be charged with any
	911	+	violation pursuant to Sections 11 -401 and 11-403 of
	912	+	this title relating to failure to yield right -of-way,
	913	+	Section 11-310 of this title relating to following too
	914	+	closely, or Section 11 -801 of this title relating to
	915	+	driving too fast for conditions, and
	916	+	e. unless otherwise directed by a pedestrian -control
	917	+	signal as provided in Section 11 -203 of this title,
	918	+	pedestrians facing a steady circular red signal alone
	919	+	shall not enter the roadway.
	920	+	In the event an official traffic -control signal is erected and
	921	+	maintained at a place other than an intersection, the provisions of
	922	+	this section shall be applicable except as to those provisions which
	923	+	by their nature can have no application. Any stop required shall be
	924	+	made at a sign or marking on the pav ement indicating where the stop
	925	+

	953	+	SECTION 9. AMENDATORY 47 O.S. 2011, Section 11 -606, is
	954	+	amended to read as follows:
	955	+	Section 11-606. All signals herein required given by hand and
	956	+	arm shall be given from the left side of the vehicle in the
	957	+	following manner and such signals shall indicate as follows:
	958	+	1. Left turn. Hand and arm extended horizontally .;
	959	+	2. Right turn. Hand and arm exte nded upward. A person
	960	+	operating a bicycle may extend his or her right hand and arm
	961	+	horizontally to his or her right ; and
	962	+	3. Stop or decrease speed. Hand and arm extended downward. A
	963	+	person operating a bicycle may extend his or her right hand and arm
	964	+	downward to his or her right side.
	965	+	SECTION 10. AMENDATORY 47 O.S. 2011, Section 11 -901, is
	966	+	amended to read as follows:
	967	+	Section 11-901. A. It shall be deemed reckless driving for any
	968	+	person to drive a motor vehicle in a careless or wanton manner
	969	+	without regard for the safety of persons or property or in violation
	970	+	of the conditions outlined in Section 11 -801 of this title.
	971	+	B. It shall be deemed reckless driving for any person driving a
	972	+	motor vehicle to harass, taunt or maliciously th row an object at or
	973	+	in the direction of any person riding a bicycle , equine or animal-
	974	+	drawn vehicle.

	1001	+	C. Every person convicted of reckless driving shall be punished
	1002	+	upon a first conviction by imprisonment for a period of not less
	1003	+	than five (5) days nor mo re than ninety (90) days, or by a fine of
	1004	+	not less than One Hundred Dollars ($100.00) nor more than Five
	1005	+	Hundred Dollars ($500.00), or by both such fine and imprisonment; on
	1006	+	a second or subsequent conviction, punishment shall be imprisonment
	1007	+	for not less than ten (10) days nor more than six (6) months, or by
	1008	+	a fine of not less than One Hundred Fifty Dollars ($150.00) nor more
	1009	+	than One Thousand Dollars ($1,000.00), or by both such fine and

	1011	+	SECTION 11. AMENDATORY 47 O.S. 2011, Section 12-401, is
	1012	+	amended to read as follows:
	1013	+	Section 12-401. A. Every motor vehicle when operated upon a
	1014	+	highway shall be equipped with a horn in good working order and
	1015	+	capable of emitting sound audible under normal conditions from a
	1016	+	distance of not less than two hundred (200) feet, but no horn or
	1017	+	other warning device shall emit an unreasonably loud or harsh sound.
	1018	+	The driver of a motor vehicle shall, when reasonably necessary to
	1019	+	insure ensure safe operation, give audible warning with a horn but
	1020	+	shall not otherwise use such horn when upon a highway. No driver of
	1021	+	any vehicle shall use a horn when passing a person riding a bicycle,
	1022	+	equine or animal-drawn vehicle under normal conditions if no
	1023	+	imminent danger of a collision exists.

	1050	+	B. No vehicle shall be equipped with nor shall any person use
	1051	+	upon a vehicle any siren, except as otherwise permitted in
	1052	+	subsection D of this section.
	1053	+	C. Any vehicle may be equipped with a theft alarm signal device
	1054	+	which is so arranged that it cannot be used by the drive r as an
	1055	+	ordinary warning signal. A theft alarm signal device shall not use
	1056	+	a siren, as described in subsection D of this section.
	1057	+	D. Every authorized emergency vehicle shall, in addition to any
	1058	+	other equipment and distinctive markings required by this ti tle, be
	1059	+	equipped with a siren, or similar device, capable of emitting sound
	1060	+	audible under normal conditions from a distance of not less than
	1061	+	five hundred (500) feet and of a type approved by the Department of
	1062	+	Public Safety, but such siren shall not be used except when such
	1063	+	vehicle is operated in response to an emergency call or in the
	1064	+	immediate pursuit of an actual or suspected violator of the law, in
	1065	+	which said latter events the driver of such vehicle shall sound said
	1066	+	siren when reasonably necessary to war n pedestrians and other
	1067	+	drivers of the approach thereof.
	1068	+	E. It shall be unlawful for any person to use a device capable
	1069	+	of producing auditory warning signals similar to that on an
	1070	+	authorized emergency vehicle or to use audible signal equipment from
	1071	+	a motor vehicle for the purpose of causing any other motor vehicle
	1072	+	operator to yield right -of-way and stop, or which actually causes
	1073	+	any other motor vehicle operator to yield the right -of-way and stop,
