4040 An Act relating to the Council on Law Enforcement

5252 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5353 SECTION 1. AMENDATORY 70 O.S. 2011, Section 3311.5, as
5454 last amended by Section 66, Chapter 161, O.S.L. 2020 (70 O.S. Supp.
5555 2020, Section 3311.5), is amended to read as follows:
5656 Section 3311.5. A. On and after November 1, 2007, the Council
5757 on Law Enforcement Education and Training (CLEET), pursuant to its
5858 authority granted by Section 3311 of this title, shall include in
5959 its required basic training courses for law enforcement
6060 certification a minimu m of four (4) hours of education and training
6161 relating to recognizing and managing a person appearing to require
6262 mental health treatment or services. The Council shall further
6363 offer a minimum of four (4) hours of education and training on

9090 specific mental health issues pursuant to Section 3311.4 of this
9191 title to meet the annual requirement for continuing education in the
9292 areas of mental health issues.
9393 B. By January 1, 2008, CLEET, pursuant to its authority granted
9494 by Sections 3311 and 3311.4 of this title, shall include in its
9595 required courses of study for law enforcement certification a
9696 minimum of six (6) hours of evidence -based sexual assault and sexual
9797 violence training. A portion of the sexual assault and sexual
9898 violence training shall include instruct ion presented by a certified
9999 sexual assault service provider.
100100 C. By January 1, 2012, every active full -time peace officer,
101101 previously certified by CLEET pursuant to Section 3311 of this
102102 title, shall be required to attend and complete the evidence -based
103103 sexual assault and sexual violence training provided in subsection B
104104 of this section.
105105 D. CLEET shall promulgate rules to enforce the provisions of
106106 subsections B and C of this section and shall, with the assistance
107107 of certified sexual assault service provide rs, establish a
108108 comprehensive integrated curriculum for the teaching of evidence -
109109 based sexual assault and sexual violence issues.
110110 E. The Council is required to update that block of training or
111111 course materials relating to legal issues, concepts, and state laws
112112 annually, but not later than ninety (90) days following the
113113 adjournment of any legislative session.

140140 F. By January 1, 2009, CLEET, pursuant to its authority granted
141141 by Sections 3311 and 3311.4 of this title, shall include in its
142142 required courses of s tudy for law enforcement certification oil
143143 field equipment theft training.
144144 G. By January 1, 2012, CLEET, pursuant to its authority granted
145145 by Sections 3311 and 3311.4 of this title, shall establish and
146146 include in its required courses of study for law enfo rcement
147147 certification a minimum of eight (8) hours of evidence -based
148148 domestic violence and stalking investigation training. The training
149149 should include, at a minimum, the importance of reporting domestic
150150 violence incidents, determining the predominant agg ressor, evidence-
151151 based investigation of domestic violence and stalking, lethality
152152 assessment, and personal safety planning necessary at the pretrial
153153 stages of a potential criminal case. A portion of the training
154154 shall include instruction presented by an e xpert victim advocate
155155 selected from recommendations provided by the Office of the Attorney
156156 General or the Domestic Violence Fatality Review Board. The
157157 training shall be developed in collaboration with the Domestic
158158 Violence Fatality Review Board, and where applicable, shall replace
159159 existing domestic violence and stalking courses currently required.
160160 H. By January 1, 2012, the evidence -based domestic violence and
161161 stalking investigation curriculum developed in collaboration with
162162 the Domestic Violence Fatality Review Board shall be submitted to
163163 the Council for approval.

190190 I. CLEET shall establish the training provided in subsection G
191191 of this section as a part of CLEET 's peace officer continuing
192192 education program and develop a plan to train full -time peace
193193 officers previously certified by CLEET pursuant to Section 3311 of
194194 this title where applicable. The Office of the Attorney General
195195 shall provide a list of expert victim advocates that are available
196196 to assist in the training.
197197 J. The Council is authorized to pay for and send training staff
198198 and employees to one or more training and education courses in
199199 jurisdictions outside this state for the purpose of expanding
200200 curriculum, training skill development, and general knowledge within
201201 the field of law enforcement educ ation and training.
202202 K. On and after November 1, 2013, CLEET, pursuant to its
203203 authority granted by Section 3311 of this title, shall include in
204204 its required basic training courses for law enforcement
205205 certification a minimum of two (2) hours of education an d training
206206 relating to recognizing and managing a person experiencing dementia
207207 or Alzheimer's disease.
208208 L. By November 1, 2019, CLEET shall establish appropriate
209209 training resources focused on protocol for handling and processing
210210 sexual assault calls. The training shall include, but not be
211211 limited to:
212212 1. How to handle the sexual assault call upon first contact;
213213 2. Determining when the assault occurred;

240240 3. Where to take the victim;
241241 4. Questioning witnesses and collecting evidence; and
242242 5. Informing and assisting the victim in accessing resources,
243243 help and information.
244244 M. The Council shall promulgate rules to evaluate and approve
245245 municipalities and counties that are deemed capable of conducting
246246 separate basic law enforcement training academies in their
247247 jurisdiction and to certify officers successfully completing such
248248 academy training courses. Upon application to the Council, any
249249 municipality with a population of sixty -five thousand (65,000) or
250250 more or any county with a population of five hundred thousand
251251 (500,000) or more shall be authorized to operate a basic law
252252 enforcement academy. In addition, upon application and approval
253253 from the Council, a municipality with a population under sixty -five
254254 thousand (65,000) or a county with a population under five hun dred
255255 thousand (500,000) may be authorized to operate a basic law
256256 enforcement academy; provided, however, the Council may approve no
257257 more than two such applications per year. The Council shall approve
258258 an application when the municipality or county making t he
259259 application meets the criteria for a separate training academy and
260260 demonstrates to the satisfaction of the Council that the academy has
261261 sufficient resources to conduct the training, the instructional
262262 staff is appropriately trained and qualified to teach the course
263263 materials, the curriculum is composed of comparable or higher

290290 quality course segments to the CLEET academy curriculum, and the
291291 facilities where the academy will be conducted are safe and
292292 sufficient for law enforcement training purposes. Any mu nicipality
293293 or county authorized to operate a basic law enforcement academy
294294 after November 1, 2007, shall not be eligible to receive funds
295295 pursuant to subsection E of Section 1313.2 of Title 20 of the
296296 Oklahoma Statutes. The Council shall not provide any fu nding for
297297 the operation of any separate training academy authorized by this
298298 subsection.
299299 N. Any municipality or county that, prior to November 1, 2007,
300300 was authorized to conduct a basic law enforcement academy shall
301301 continue to receive funding pursuant to subsection E of Section
302302 1313.2 of Title 20 of the Oklahoma Statutes.
303303 O. The Council on Law Enforcement Education and Training may
304304 establish appropriate training resources focused on the
305305 investigations of unidentified and missing person s and may require
306306 all CLEET-certified law enforcement officers to complete such
307307 training on a regular basis as determined by the Council.
308308 SECTION 2. This act shall become effective November 1, 2021.
