48 | 101 | | economy. Provided, howev er, the local bidder or contractor must |

49 | 102 | | agree to perform the contract for the same price and terms as the |

50 | 103 | | bid proposed by the nonlocal bidder or contractor. Any bid |
---|
51 | 104 | | preference granted hereunder must be in accordance with an |
---|
52 | 105 | | established policy adopted by t he governing body of the awarding |
---|
53 | 106 | | public agency to cle arly demonstrate the economic benefit to the |
---|
54 | 107 | | local area or economy. Provided, further, no local bid preference |
---|
55 | 108 | | shall be granted unless the local bidding entity is the second |
---|
56 | 109 | | lowest qualified bid on the contract. The bid specifications shall |
---|
57 | 110 | | clearly state that the bid is subject to a local bidder preference |
---|
58 | 111 | | law. For purposes of this section, "local bid" means the bidding |
---|
59 | 112 | | person is authorized to transact business in this state and |
---|
60 | 113 | | maintains a bona fide establishment for transacting such business |
---|
61 | 114 | | within this state. This provision does not apply to any |
---|
62 | 115 | | construction contract for which federal funds are available for |
---|
66 | 145 | | C. Except as provided in subsection E of this section, other |
---|
67 | 146 | | construction contracts for the purpose of making any public |
---|
68 | 147 | | improvements or constructing any public building or making repairs |
---|
69 | 148 | | to the same for Fifty Thousand Dollars ($50,000.00) or less shall be |
---|
70 | 149 | | let and awarded to the lowest responsible bidder by receipt of |
---|
71 | 150 | | written bids or awarded on the basis of competitive quotes to the |

72 | 151 | | lowest responsible qualified contractor. Work may be commenced in |
---|
73 | 152 | | accordance with the purchasing policies of the public agency. |
---|

100 | 203 | | Procedures Act, shall promulgate rules necessary to implement the |

103 | 205 | | G. 1. A public agency shall not let or award a public |
---|
104 | 206 | | construction contract exceeding Fifty Thousand Dollars ($50,000.00) |
---|
105 | 207 | | to any contractor affiliated with a purchasing cooperative unless |
---|
106 | 208 | | the purchasing cooperative and the contractor have complied with all |
---|
107 | 209 | | of the provisions of the Public Competitive Bidding Act of 1974, |
---|
108 | 210 | | including but not limited to open competitive bidding after |
---|
109 | 211 | | solicitation for sealed bids. A public agency shall not let or |
---|
110 | 212 | | award a public construction contract exceeding Five Thousand Dollars |
---|
111 | 213 | | ($5,000.00) up to Fifty Thousand Dollars ($50,000.00) to any |
---|
112 | 214 | | contractor affiliated with a purchasing cooperative unless the |

113 | 215 | | purchasing cooperative and the contractor have complied with all of |
