56	56	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
57	57	SECTION 1. AMENDATORY 70 O.S. 2011, Section 5 -135.4, as
58	58	last amended by Section 1, Chapter 282, O.S.L. 2018 (70 O.S. Supp.
59	59	2020, Section 5-135.4), is amended to read as follows:
60	60	Section 5-135.4 A. This section shall be known and may be
61	61	cited as the "School District Transpar ency Act".
62	62	B. The State Department of Education shall make school district
63	63	revenue sources and school district and school site expenditure data
64	64	available on its website. Data shall be made available in an open -
65	65	structured data format that may be downloade d by the public and that

92	92	allows the user to systematically sort, search, and access all data
93	93	without any fee or charge for access. Prior to the beginning of the
94	94	2019-2020 school year, if a school district has a website, the
95	95	district shall provide a link o n its home page to the State
96	96	Department of Education 's Oklahoma Cost Accounting System and School
97	97	District Financial Information website, or the district shall
98	98	provide the information required by subsection C of this section
99	99	within one click of the home pa ge of the school district 's website.
100	100	C. The website shall provide information on school district
101	101	revenue sources and school district and school site expenditures of
102	102	state, federal, and local funds, whether appropriated or
103	103	nonappropriated, excluding paymen ts of voluntary payroll deductions
104	104	for employees to receiving parties. The website shall further
105	105	provide information, including, but not limited to, the following:
106	106	1. Identification of the school district;
107	107	2. The Oklahoma Cost Accounting System (OCAS) c ode designation
108	108	for each expenditure;
109	109	3. The name and principal location of the entity or recipient
110	110	of the funds, excluding release of information relating to an
111	111	individual's place of residence and release of information
112	112	prohibited by subsection D of Sect ion 24A.7 of Title 51 of the
113	113	Oklahoma Statutes or by federal law relating to privacy rights;
114	114	4. The amount of funds expended;
115	115	5. The type of transaction;

142	142	6. A descriptive purpose of the funding action or expenditure;
143	143	7. The budgeted and audited actual expenditure figures for each
144	144	fiscal year, ensuring each set of figures can be identified as
145	145	budgeted or audited figures;
146	146	8. The per-pupil expenditure as defined in Section 1 -124 of
147	147	this title; and
148	148	9. The total compensation package of the superintendent a s
149	149	defined by the requirements of the OCAS including a listing of the
150	150	base salary, insurance, retirement and other fringe benefits
151	151	including exempted nonadministrative services such as teaching in
152	152	the classroom or serving as a principal, counselor or librar y media
153	153	specialist pursuant to subsection E of Section 18 -124 of this title;
154	154	and
155	155	10. A list of all revenue sources of the school district ,
156	156	organized by category including, but not limited to, the categories
157	157	of local funds, county funds, state funds, feder al funds and other
158	158	revenue sources. The list shall include percentage s for each
159	159	category to show the total revenue of the school district .
160	160	D. The Department shall make the data available on its website
161	161	within one hundred twenty (120) days of transmission of the
162	162	expenditures to the Department by the school district.
163	163	E. School districts shall provide information requested by the
164	164	Department to accomplish the purposes of this section.

191	191	F. If a school district maintains a website, the district shall
192	192	provide the information required in subsection C of this section in
193	193	the manner prescribed in subsection B of this section on the
194	194	district website.
195	195	G. Nothing in this section shall require the disclosure of
196	196	information which is required to be kept confidential by s tate or
197	197	federal law.
198	198	H. The disclosure of information required by this section shall
199	199	create no liability whatsoever, civil or criminal, to the State of
200	200	Oklahoma, the State Department of Education, school districts, or
201	201	any employee thereof for disclosure o f required information or for
202	202	any error or omission in the disclosure.
203	203	I. The Department shall undertake activities annually to inform
204	204	parents, schools and other stakeholders about the availability of
205	205	school district revenue sources and school district and school site
206	206	expenditure data on its website and how to use the website.
207	207	SECTION 2. This act shall become effective November 1, 2021.
