2655 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

2856 SECTION 1. NEW LAW A new section of law to be codified
2957 in the Oklahoma Statutes as Section 801.8 of Title 17, unless there
3058 is created a duplication in numbering, reads as follows:

3259 A. The Legislature declares that renewable natural gas is a
3360 complement to our state's vast natural gas and rene wable energy
3461 resources that can be carbon neutral or carbon negative.

3662 B. It is further declared the intent of the Legislature to
3763 ensure renewable natural gas is allowable in the portfolio of
3864 natural gas utilities on behalf of Oklahoma energy consumers for
3965 their fueling, heating and power needs, and that natural gas

4093 utilities play a unique and necessary role in procuring,
4194 transporting and delivering gas, including renewable natural gas, to
4295 Oklahoma energy consumers.

4496 C. For purposes of this section:

4697 1. "Biogas" means a mixture of carbon dioxide and hydrocarbons,
4798 primarily methane gas, released from the biological decomposition of
4899 waste, including, but not limited to, animal manure, wastewater,
49100 municipal solid waste, landfilled waste, fats, oils and greases and
50101 food waste; and

52102 2. "Renewable natural gas" means:

54103 a. biogas-derived methane gas that is interchangeable
55104 with geologic natural gas,
56-
57105 b. hydrogen gas or carbon oxides derived from renewable
58106 energy sources, or
59-
60107 c. methane gas derived from any combination o f hydrogen
61108 gas or carbon oxides derived from renewable energy
62109 sources, biogas and waste carbon dioxide.

64110 D. The Oklahoma Corporation Commission shall, no later than
65111 December 1, 2021, issue a report and rec ommendations to the
66112 Legislature regarding the abili ty and appropriateness of natural gas
67113 utilities to procure, transport and deliver renewable natural gas to
68114 customers. The report shall address a recommendation for the
69115 state's renewable fuel standard or goal to more proactively promote
70116 biogas, renewable natural gas and hydrogen as solutions for reducing

71144 methane emissions and other environmental problems. The report
72145 shall also discuss the methods for recovery of associated costs from
73146 ratepayers, such as tr ansport infrastructure and commodity costs.
74147 The report shall also address the production of educational
75148 materials to provide Oklahoma residents with information regarding
76149 renewable natural gas and its positive environmental impacts and
77150 benefits. The report shall also discuss future reporting
78151 requirements for all producers so the Commission can report progress
79152 annually to the Legislature. The report shall be due to the
80153 Legislature no later than December 1, 2021.

82154 SECTION 2. This act shall become effective November 1, 2021.
