40	40	An Act relating to public buildings and public works;
41	41	amending 61 O.S. 2011, Sections 104, as last amended
42	42	by Section 1, Chapter 40, O.S .L. 2017 and 110, as
43	43	amended by Section 1, Chapter 219, O.S.L. 2018 (61
44	44	O.S. Supp. 2020, Sections 104 and 110), which relate
45	45	to the Public Competitive Bidding Act of 1974;
46	46	modifying bid notices and opening of bids; and

52	52	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
53	53	SECTION 1. AMENDATORY 61 O.S. 2011, Section 104, as last
54	54	amended by Section 1, Chapter 40, O.S.L. 2017 (61 O.S. Supp. 2020,
55	55	Section 104), is amended to read as follows:
56	56	Section 104. All proposals to award public construction
57	57	contracts shall be made equally and uniformly known by the awarding
58	58	public agency to all prospective bidders and the public in the
59	59	following manner:
60	60	1. Notice Public notice thereof shall be given by publication
61	61	in a newspaper of general circulation and published in the county
62	62	where the work, or the major part of it, is to be done , such written
63	63	or electronic means. Such notice by publication to be published in

91	91	publication thereof to be shall be accessible to the public at least
92	92	twenty-one (21) ten (10) days prior to the date set for opening
93	93	bids; and
94	94	2. Notice thereof shall be sent to one in -state trade or
95	95	construction publication for their u se and information whenever the
96	96	estimated cost of the contract exceeds Fifty Thousand Dollars
97	97	($50,000.00); provided, however, this section shall not be construed
98	98	to require the publication of the notice in such trade or
99	99	construction publication or the req uirement to provide the notice to
100	100	more than one in-state trade or construction publication or to any
101	101	out-of-state trade or construction publications.
102	102	SECTION 2. AMENDATORY 61 O.S. 2011, Section 110, as
103	103	amended by Section 1, Chapte r 219, O.S.L. 2018 (61 O.S. Supp. 2020,
104	104	Section 110), is amended to read as follows:
105	105	Section 110. A. Except as provided by subsection B of this
106	106	section, all All bids shall be sealed and opened only at the time
107	107	and place mentioned in the bidding documents , and read aloud in the
108	108	presence of an administrative officer of the awarding public agency.
109	109	Such bid opening shall be open to the public and to all bidders .
110	110	B. The Oklahoma Department of Transportation and the Oklahoma
111	111	Turnpike Authority shall be exempt from the requirements provided in
