40	40	An Act relating to agriculture; amending 2 O.S. 2011,
41	41	Section 7-414, which relates to the Oklahoma Milk and
42	42	Milk Products Act; allowing for certain incidental
43	43	sales of raw milk by delivery; requiring certain
44	44	label; and providing an effective date.

50	50	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
51	51	SECTION 1. AMENDATORY 2 O.S. 2011, Section 7 -414, is
52	52	amended to read as follows:
53	53	Section 7-414. A. The provisions of the Oklahoma Milk and Milk
54	54	Products Act shall not be construed to:
55	55	1. Include incidental sales of raw milk directly to consumers
56	56	at the farm where the milk is produced;
57	57	2. Include incidental sales of raw milk delivered by the farm
58	58	producer directly to the final consumer' s residence from the farm
59	59	where the milk is produced; provided any raw milk shall be clearly
60	60	labeled by the producer as "unpasteurized raw milk" ;
61	61	3. Preclude the advertisin g of the incidental sale of goat
62	62	milk; and

89	89	3. 4. Prohibit any farmer or producer from making cheese using
90	90	milk or cream produced on the farm of such farmer or producer.
91	91	B. For purposes of this section, incidental sales of goat milk
92	92	are those sales where the average monthly number of gallons sold
93	93	does not exceed one hundred (100).
94	94	SECTION 2. This act shall become effective November 1, 2021 .
