40	40	An Act relating to agriculture; amending 2 O.S. 2011,
41	41	Section 10-9.8a, which relates to the Oklahoma
42	42	Registered Poultry Feeding Operati ons Act; modifying
43	43	current setback requirements; providing setback

50	50	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
51	51	SECTION 1. AMENDATORY 2 O.S. 2011, Section 10 -9.8a, is
52	52	amended to read as follows:
53	53	Section 10-9.8a A. On and after the effective date of this
54	54	act:
55	55	1. No new or expanding poultry feeding operations , operated by
56	56	entities prohibited in Section 951 of Title 18 of the Oklahoma
57	57	Statutes including but not limited to entities operating as
58	58	prescribed by Section 954 of Title 18 of the Oklahoma Statutes,
59	59	shall be constructed within a one -hundred-year flood plain; and
60	60	2. No new or expanding poultry feeding operations, operate d by
61	61	entities prohibited in Section 951 of Title 18 of the Oklahoma
62	62	Statutes including but not limited to entities operating as

89	89	prescribed by Section 954 of Title 18 of the Oklahoma Statutes,
90	90	shall be constructed within the following minimum buffer areas:
91	91	a. one and one-half (1 1/2) miles of the high water mark
92	92	of a surface public water supply if the poultry
93	93	feeding operation is located within the watershed for
94	94	the public water supply,
95	95	b. one (1) mile of any designated scenic river area as
96	96	specified by the Scenic Rivers Act,
97	97	c. one (1) mile of a public drinking water well, and
98	98	d. one (1) mile of a water body specified as Outstanding
99	99	Resource Waters that has recreational or ecological
100	100	significance as outlined by the most current Water
101	101	Quality Standards promul gated by the Oklahoma Water
102	102	Resources Board
103	103	New or expanding poultry feeding operations with more than
104	104	thirty thousand (30,000) birds, including , but not limited to,
105	105	poultry barns, composters and other carcass disposal areas, litter
106	106	sheds and other buildin gs associated with the operation, shall not
107	107	be constructed within one -half (1/2) mile of occupied residences.
108	108	All distances between occupied residences and poultry feeding
109	109	operations shall be measured from the closest corner of the walls of
110	110	the occupied residence to the closest point of the registered
111	111	poultry feeding operation, excluding land application sites ; and

138	138	3. New or expanding poultry feeding operations, including , but
139	139	not limited to, poultry barns, composters and other carcass disposal
140	140	areas, litter sheds and other buildings associated with the
141	141	operation, shall not be constructed within:
142	142	a. one-half (1/2) mile of public schools, a cemetery, a
143	143	church, a public park or incorporated city limits,
144	144	b. one-tenth (1/10) mile of a public highway or propert y
145	145	line. For the purposes of this subparagraph,
146	146	"property line" means the division line between two
147	147	units of land,
148	148	c. one-quarter (1/4) mile of streams identified on a
149	149	current USGS 7.5 minute topographic map, and
150	150	d. one-fifth (1/5) mile of private wells not owned or
151	151	used for the poultry feeding operation .
152	152	B. Prior to approval of any application for a new or expanding
153	153	poultry feeding operation, the Oklahoma Department of Agriculture,
154	154	Food, and Forestry shall con duct a pre-site inspection of the
155	155	proposed facility and review and confirm compliance with all setback
156	156	requirements contained in this section .
157	157	SECTION 2. This act shall become effective November 1, 20 21.
