4040 An Act relating to agriculture; amending 2 O.S. 2011,

5050 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5151 SECTION 1. AMENDATORY 2 O.S. 2011, Section 10 -9.8a, is
5252 amended to read as follows:
5353 Section 10-9.8a A. On and after the effective date of this
5454 act:
5555 1. No new or expanding poultry feeding operations , operated by
5656 entities prohibited in Section 951 of Title 18 of the Oklahoma
5757 Statutes including but not limited to entities operating as
5858 prescribed by Section 954 of Title 18 of the Oklahoma Statutes,
5959 shall be constructed within a one -hundred-year flood plain; and
6060 2. No new or expanding poultry feeding operations, operate d by
6161 entities prohibited in Section 951 of Title 18 of the Oklahoma
6262 Statutes including but not limited to entities operating as

8989 prescribed by Section 954 of Title 18 of the Oklahoma Statutes,
9090 shall be constructed within the following minimum buffer areas:
9191 a. one and one-half (1 1/2) miles of the high water mark
9292 of a surface public water supply if the poultry
9393 feeding operation is located within the watershed for
9494 the public water supply,
9595 b. one (1) mile of any designated scenic river area as
9696 specified by the Scenic Rivers Act,
9797 c. one (1) mile of a public drinking water well, and
9898 d. one (1) mile of a water body specified as Outstanding
9999 Resource Waters that has recreational or ecological
100100 significance as outlined by the most current Water
101101 Quality Standards promul gated by the Oklahoma Water
102102 Resources Board
103103 New or expanding poultry feeding operations with more than
104104 thirty thousand (30,000) birds, including , but not limited to,
105105 poultry barns, composters and other carcass disposal areas, litter
106106 sheds and other buildin gs associated with the operation, shall not
107107 be constructed within one -half (1/2) mile of occupied residences.
108108 All distances between occupied residences and poultry feeding
109109 operations shall be measured from the closest corner of the walls of
110110 the occupied residence to the closest point of the registered
111111 poultry feeding operation, excluding land application sites ; and

138138 3. New or expanding poultry feeding operations, including , but
139139 not limited to, poultry barns, composters and other carcass disposal
140140 areas, litter sheds and other buildings associated with the
141141 operation, shall not be constructed within:
142142 a. one-half (1/2) mile of public schools, a cemetery, a
143143 church, a public park or incorporated city limits,
144144 b. one-tenth (1/10) mile of a public highway or propert y
145145 line. For the purposes of this subparagraph,
146146 "property line" means the division line between two
147147 units of land,
148148 c. one-quarter (1/4) mile of streams identified on a
149149 current USGS 7.5 minute topographic map, and
150150 d. one-fifth (1/5) mile of private wells not owned or
151151 used for the poultry feeding operation .
152152 B. Prior to approval of any application for a new or expanding
153153 poultry feeding operation, the Oklahoma Department of Agriculture,
154154 Food, and Forestry shall con duct a pre-site inspection of the
155155 proposed facility and review and confirm compliance with all setback
156156 requirements contained in this section .
157157 SECTION 2. This act shall become effective November 1, 20 21.
