3361 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3562 SECTION 1. NEW LAW A new section of law to be codified
3663 in the Oklahoma Statutes as Section 3 -322a of Title 43A, unless
3764 there is created a duplication in numbering, reads as follows:

3965 A. The Board of Mental Health and Substance Abuse Services
4066 shall promulgate rule s and standards for certification of Problem
4167 Gambling Treatment Counselors who are:

46-the state to provide behavioral health services; ENR. H. B. NO. 2006 Page 2

4898 3. Employed by a tribe or tribal facility that provides

51100 4. Employed by an Oklahoma Department of Veterans Affairs or a
52101 United States Department of Veterans Affairs facility.

54102 B. Such rules and standards sh all address criteria for
55103 certification and renewal, including minimum education requirements,
56104 examination and supervision requirements, continuing education
57105 requirements, and rules of professional conduct.

59106 C. Application for certification as a Problem Gam bling
60107 Treatment Counselor shall be made to the Depa rtment of Mental Health
61108 and Substance Abuse Services on prescribed forms authorized by the
62109 Department. The Board, or the Commissioner of Mental Health and
63110 Substance Abuse Services upon delegation by the B oard, may certify
64111 the Problem Gambling Treatment Co unselor for a period of two (2)
65112 years subject to renewal as provided in the rules promulgated by the
66113 Board.

68114 D. The Board is authorized to establish an application and
69115 renewal fee of no more than One Hundr ed Dollars ($100.00) to defray
70116 the costs incurred i n the certification process.

72117 E. Problem Gambling Treatment Counselors certified by the Board
73118 or the Commissioner shall only use the title "Problem Gambling
74119 Treatment Counselor" if employed by the state, e mployed by

75147 behavioral services providers contractin g with the state to provide
76148 behavioral health services, employed by a tribe or tribal facility
77149 that provides behavioral health services or employed by an Oklahoma
78150 Department of Veterans Affairs or a United States Department of
79151 Veterans Affairs facility.

81152 F. This section shall not be construed to permit the certified
82153 Problem Gambling Treatment Counselor to practice any of the
83154 following professions or use the following titles unless also
84155 licensed or accredite d by the appropriate authority:

86156 1. Physician;

88157 2. Psychologist;

90158 3. Clinical social worker;

92159 4. Professional counselor;

94160 5. Marital and family therapist;

96161 6. Behavioral practitioner; or

98162 7. Alcohol and drug counselor.

100163 G. Failure to comply with the rules and standards promulgated
101164 by the Board shall be gro unds for revocation, suspension or
102165 nonrenewal of certification.

104166 H. No Problem Gambling Treatment Counselor shall operate or
105167 continue to operate as a Problem Gambling Treatment Counselor unless
106168 the Problem Gambling Treatment Counselor complies with the rul es
107169 promulgated by the Board and is certified as required by this
108170 section.
