33	61		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

35	62		SECTION 1. NEW LAW A new section of law to be codified
36	63		in the Oklahoma Statutes as Section 3 -322a of Title 43A, unless
37	64		there is created a duplication in numbering, reads as follows:

39	65		A. The Board of Mental Health and Substance Abuse Services
40	66		shall promulgate rule s and standards for certification of Problem
41	67		Gambling Treatment Counselors who are:

43	68		1. Employed by the state;

46		-	the state to provide behavioral health services; ENR. H. B. NO. 2006 Page 2

48	98		3. Employed by a tribe or tribal facility that provides
49	99		behavioral health services; or

51	100		4. Employed by an Oklahoma Department of Veterans Affairs or a
52	101		United States Department of Veterans Affairs facility.

54	102		B. Such rules and standards sh all address criteria for
55	103		certification and renewal, including minimum education requirements,
56	104		examination and supervision requirements, continuing education
57	105		requirements, and rules of professional conduct.

59	106		C. Application for certification as a Problem Gam bling
60	107		Treatment Counselor shall be made to the Depa rtment of Mental Health
61	108		and Substance Abuse Services on prescribed forms authorized by the
62	109		Department. The Board, or the Commissioner of Mental Health and
63	110		Substance Abuse Services upon delegation by the B oard, may certify
64	111		the Problem Gambling Treatment Co unselor for a period of two (2)
65	112		years subject to renewal as provided in the rules promulgated by the
66	113		Board.

68	114		D. The Board is authorized to establish an application and
69	115		renewal fee of no more than One Hundr ed Dollars ($100.00) to defray
70	116		the costs incurred i n the certification process.

72	117		E. Problem Gambling Treatment Counselors certified by the Board
73	118		or the Commissioner shall only use the title "Problem Gambling
74	119		Treatment Counselor" if employed by the state, e mployed by

75	147		behavioral services providers contractin g with the state to provide
76	148		behavioral health services, employed by a tribe or tribal facility
77	149		that provides behavioral health services or employed by an Oklahoma
78	150		Department of Veterans Affairs or a United States Department of
79	151		Veterans Affairs facility.

81	152		F. This section shall not be construed to permit the certified
82	153		Problem Gambling Treatment Counselor to practice any of the
83	154		following professions or use the following titles unless also
84	155		licensed or accredite d by the appropriate authority:

86	156		1. Physician;

88	157		2. Psychologist;

90	158		3. Clinical social worker;

92	159		4. Professional counselor;

94	160		5. Marital and family therapist;

96	161		6. Behavioral practitioner; or

98	162		7. Alcohol and drug counselor.

100	163		G. Failure to comply with the rules and standards promulgated
101	164		by the Board shall be gro unds for revocation, suspension or
102	165		nonrenewal of certification.

104	166		H. No Problem Gambling Treatment Counselor shall operate or
105	167		continue to operate as a Problem Gambling Treatment Counselor unless
106	168		the Problem Gambling Treatment Counselor complies with the rul es
107	169		promulgated by the Board and is certified as required by this
108	170		section.
