23	55		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

25	56		SECTION 1. AMENDATORY 82 O.S. 2011, Section 569, is
26	57		amended to read as follows:

28	58		Section 569. A. When it is determined to let the work of a
29	59		master conservancy district by contract, contracts in amounts to
30	60		exceed Fifty Thousand Dollars ($50,000.00) One Hundred Thousand
31	61		Dollars ($100,000.00) shall be advertised after notices calling for
32	62		bids have been published once a week, for three (3) consecutive
33	63		weeks completed on date of last publication, which shall not be less
34	64		than fourteen (14) days from the first publication, in at least o ne
35	65		newspaper in each county, where any part of the work under terms of

36	93		the contract is to be performed. The board may let the contract to
37	94		the lowest and best bidder, who shall give a good and approved bond,
38	95		with ample security, equal in amount to the tota l of the bid,
39	96		conditioned on the carrying out of the contract to com pletion, and
40	97		shall file the bond and contract with the secretary of the district
41	98		in amount and conditions as provided by law, conditioned on the
42	99		carrying out of the contract. The contract shall be in writing and
43	100		shall be approved by the board of directors and signed by the
44	101		president of the board and by the contractor. In the case of sudden
45	102		emergency when it is necessary in order to protect the district or

	103	+	when the board determines that th e contract must be implemented by a
47	104		sole source or in any situation in which the Public Competitive
48	105		Bidding Act of 1974 would allow a state agency to do so, the
49	106		advertising of contracts may be waived.

51	107		B. The board of directors of any conservancy district may adopt
52	108		rules establishing a district competitive bidding process not in
53	109		conflict with the provisions of this section.

55	110		SECTION 2. This act shall become effective November 1, 2021.
