2355 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

2556 SECTION 1. AMENDATORY 82 O.S. 2011, Section 569, is
2657 amended to read as follows:

2858 Section 569. A. When it is determined to let the work of a
2959 master conservancy district by contract, contracts in amounts to
3060 exceed Fifty Thousand Dollars ($50,000.00) One Hundred Thousand
3161 Dollars ($100,000.00) shall be advertised after notices calling for
3262 bids have been published once a week, for three (3) consecutive
3363 weeks completed on date of last publication, which shall not be less
3464 than fourteen (14) days from the first publication, in at least o ne
3565 newspaper in each county, where any part of the work under terms of

3693 the contract is to be performed. The board may let the contract to
3794 the lowest and best bidder, who shall give a good and approved bond,
3895 with ample security, equal in amount to the tota l of the bid,
3996 conditioned on the carrying out of the contract to com pletion, and
4097 shall file the bond and contract with the secretary of the district
4198 in amount and conditions as provided by law, conditioned on the
4299 carrying out of the contract. The contract shall be in writing and
43100 shall be approved by the board of directors and signed by the
44101 president of the board and by the contractor. In the case of sudden
45102 emergency when it is necessary in order to protect the district or
46-when the board determines that the contract must be imp lemented by a ENR. H. B. NO. 2049 Page 2
103+when the board determines that th e contract must be implemented by a
47104 sole source or in any situation in which the Public Competitive
48105 Bidding Act of 1974 would allow a state agency to do so, the
49106 advertising of contracts may be waived.

51107 B. The board of directors of any conservancy district may adopt
52108 rules establishing a district competitive bidding process not in
53109 conflict with the provisions of this section.

55110 SECTION 2. This act shall become effective November 1, 2021.
