52	52	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
53	53	SECTION 1. AMENDATORY 51 O.S. 2011, Section 155, as last
54	54	amended by Section 3, Chapter 273, O.S.L. 2016 (51 O.S. Supp. 2020,
55	55	Section 155), is amended to read as follows:
56	56	Section 155. The state or a political subdivision shall not be
57	57	liable if a loss or claim resul ts from:
58	58	1. Legislative functions;
59	59	2. Judicial, quasi-judicial, or prosecutorial functions, other
60	60	than claims for wrongful criminal felony conviction resulting in
61	61	imprisonment provided for in Section 154 of this title;
62	62	3. Execution or enforcement of the lawful orders of any court;

89	89	4. Adoption or enforcement of or failure to adopt or enforce a
90	90	law, whether valid or invalid, including, but not limited to, any
91	91	statute, charter provision, ordinance, resolution, rule, regulation
92	92	or written policy;
93	93	5. Performance of or the failure to exercise or perform any act
94	94	or service which is in the discretion of the state or political
95	95	subdivision or its employees;
96	96	6. Civil disobedience, riot, insurrection or rebellion or the
97	97	failure to provide, or the method of providi ng, police, law
98	98	enforcement or fire protection , unless the loss or claim results
99	99	from instances where the state or political subdivision was aware of
100	100	the dangerous condition and failed to take any reasonable action to
101	101	alleviate or mitigate damage, loss or injury from civil
102	102	disobedience, riot, insurrection or rebellion or makes an
103	103	affirmative decision or establishes a policy to allow civil
104	104	disobedience, riots, insurrection or rebellion ;
105	105	7. Any claim based on the theory of attractive nuisance;
106	106	8. Snow or ice conditions or temporary or natural conditions on
107	107	any public way or other public place due to weather conditions,
108	108	unless the condition is affirmatively caused by the negligent act of
109	109	the state or a political subdivision;
110	110	9 Entry upon any property where t hat entry is expressly or
111	111	implied authorized by law;

139	139	subdivision;
140	140	11. Assessment or collection of taxes or special assessments,
141	141	license or registration fees, or other fees or charges imposed by
142	142	law;
143	143	12. Licensing powers or functions including, but not limited
144	144	to, the issuance, denial, suspension or revocation of or failure or
145	145	refusal to issue, deny, suspend or revoke any permit, license,
146	146	certificate, approval, order or similar authority;
147	147	13. Inspection powers or functions, including failure to make
148	148	an inspection, review or approval, or making an inadequate or
149	149	negligent inspection, review or approval of any property, real or
150	150	personal, to determine whether the property complies with or
151	151	violates any law or contains a hazard to health or safety, or fails
152	152	to conform to a recognized standard;
153	153	14. Any loss to any person covered by any workers ' compensation
154	154	act or any employer's liability act;
155	155	15. Absence, condition, location or malfunction of any tra ffic
156	156	or road sign, signal or warning device unless the absence,
157	157	condition, location or malfunction is not corrected by the state or
158	158	political subdivision responsible within a reasonable time after
159	159	actual or constructive notice or the removal or destruction of such
160	160	signs, signals or warning devices by third parties, action of
161	161	weather elements or as a result of traffic collision except on

188	188	failure of the state or political subdivision to correct the same
189	189	within a reasonable time after actual or constructive no tice.
190	190	Nothing herein shall give rise to liability arising from the failure
191	191	of the state or any political subdivision to initially place any of
192	192	the above signs, signals or warning devices. The signs, signals and
193	193	warning devices referred to herein are thos e used in connection with
194	194	hazards normally connected with the use of roadways or public ways
195	195	and do not apply to the duty to warn of special defects such as
196	196	excavations or roadway obstructions;
197	197	16. Any claim which is limited or barred by any other law;
198	198	17. Misrepresentation, if unintentional;
199	199	18. An act or omission of an independent contractor or
200	200	consultant or his or her employees, agents, subcontractors or
201	201	suppliers or of a person other than an employee of the state or
202	202	political subdivision at the time the act or omission occurred;
203	203	19. Theft by a third person of money in the custody of an
204	204	employee unless the loss was sustained because of the negligence or
205	205	wrongful act or omission of the employee;
206	206	20. Participation in or practice for any interscholastic or
207	207	other athletic contest sponsored or conducted by or on the property
208	208	of the state or a political subdivision;
209	209	21. Participation in any activity approved by a local board of
210	210	education and held within a building or on the grounds of the school

238	238	normal school hours or on weekends;
239	239	22. Use of indoor or outdoor school property and facilities
240	240	made available for public recreation before or after normal school
241	241	hours or on weekends or school vacati ons, except those claims
242	242	resulting from willful and wanton acts of negligence. For purposes
243	243	of this paragraph:
244	244	a. "public" includes, but is not limited to, students
245	245	during nonschool hours and school staff when not
246	246	working as employees of the school, and
247	247	b. "recreation" means any indoor or outdoor physical
248	248	activity, either organized or unorganized, undertaken
249	249	for exercise, relaxation, diversion, sport or
250	250	pleasure, and that is not otherwise covered by
251	251	paragraph 20 or 21 of this section;
252	252	23. Any court-ordered, Department of Corrections or county
253	253	approved work release program; provided, however, this provision
254	254	shall not apply to claims from individuals not in the custody of the
255	255	Department of Corrections based on accidents involving motor
256	256	vehicles owned or oper ated by the Department of Corrections;
257	257	24. The activities of the National Guard, the militia or other
258	258	military organization administered by the Military Department of the
259	259	state when on duty pursuant to the lawful orders of competent
260	260	authority:

288	288	b. in response to a natural disaster or military attack,

290	290	c. if participating in a military mentor program ordered
291	291	by the court;
292	292	25. Provision, equipping, operation or maintenance of any
293	293	prison, jail or correctional facility, or in juries resulting from
294	294	the parole or escape of a prisoner or injuries by a prisoner to any
295	295	other prisoner; provided, however, this provision shall not apply to
296	296	claims from individuals not in the custody of the Department of
297	297	Corrections based on accidents in volving motor vehicles owned or
298	298	operated by the Department of Corrections;
299	299	26. Provision, equipping, operation or maintenance of any
300	300	juvenile detention facility, or injuries resulting from the escape
301	301	of a juvenile detainee, or injuries by a juvenile detai nee to any
302	302	other juvenile detainee;
303	303	27. Any claim or action based on the theory of manufacturer 's
304	304	products liability or breach of warranty, either expressed or
305	305	implied;
306	306	28. Any claim or action based on the theory of indemnification
307	307	or subrogation;
308	308	29. Any claim based upon an act or omission of an employee in
309	309	the placement of children;

337	337	recognized standards;
338	338	31. Maintenance of the state highway system or any portion
339	339	thereof unless the claimant p resents evidence which establishes
340	340	either that the state failed to warn of the unsafe condition or that
341	341	the loss would not have occurred but for a negligent affirmative act
342	342	of the state;
343	343	32. Any confirmation of the existence or nonexistence of any
344	344	effective financing statement on file in the office of the Secretary
345	345	of State made in good faith by an employee of the office of the
346	346	Secretary of State as required by the provisions of Section 1 -9-
347	347	320.6 of Title 12A of the Oklahoma Statutes;
348	348	33. Any court-ordered community sentence;
349	349	34. Remedial action and any subsequent related maintenance of
350	350	property pursuant to and in compliance with an authorized
351	351	environmental remediation program, order, or requirement of a
352	352	federal or state environmental agency;
353	353	35. The use of necessary and reasonable force by a school
354	354	district employee to control and discipline a student during the
355	355	time the student is in attendance or in transit to and from the
356	356	school, or any other function authorized by the school district;
357	357	36. Actions taken in good faith by a school district employee
358	358	for the out-of-school suspension of a student pursuant to applicable
359	359	Oklahoma Statutes; or
