40	40	An Act relating to state government; prohibiting
41	41	state governmental entities organized within the
42	42	executive branch of state government from requiring
43	43	certain evidence related to surgical procedures;
44	44	providing for codification; providing an effective
45	45	date; and declaring an emergency .

52	52	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
53	53	SECTION 1. NEW LAW A new section of law to be codified
54	54	in the Oklahoma Statutes as Section 9501 of Title 74, unless there
55	55	is created a duplication in numbering, reads as follows:
56	56	No agency, board, commission, department, instrumentality o r
57	57	other entity organized within the executive branch of state
58	58	government shall require, if applicable, on any form or other
59	59	document used by the state governmental entity as part of a process
60	60	for changing gender identification on a driver licen se or any permit
61	61	or other form of identification used by such entity an affidavit,
62	62	attesting to the applicant’s gender identity. The applicant’s
63	63	affidavit shall be accepted as conclusive proof of gender change if

90	90	it contains substantially the following language: "I, [name of
91	91	applicant], hereby attest under penalty of perjury that the request
92	92	for a change in gender to (female, male or nonbinary) is to conform
93	93	my legal gender to my gender identity and is not for any fraudulent
94	94	purpose."
95	95	SECTION 2. This act shall become effective July 1, 2021.
96	96	SECTION 3. It being immediately necessary for the preservation
97	97	of the public peace, health or safety, an emergency is hereby
98	98	declared to exist, by reason whereof this act shall take effect and
99	99	be in full force from and after its pass age and approval.
