49	46		amended by Section 3, Chapter 67, O.S.L. 2020 (70

51	48		Physician Manpower Training Commission; including a
52	49		nurse practitioner in membership; and providing an

59	56		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
60	57		SECTION 1. AMENDATORY 63 O.S. 2011, Section 1 -2721, as
61	58		last amended by Section 1, Chapter 286, O.S.L. 2018 (63 O.S. Supp.
62	59		2020, Section 1-2721), is amended to read as follows:
63	60		Section 1-2721. A. 1. The Physician Manpower Training
64	61		Commission shall administer the Oklahoma Medical Loan Repayment
65	62		Program.
66	63		2. For the purposes of this section, "primary care physicians "
67	64		shall mean physicians practicing in family medicine, geriatrics,

95	91		general internal medicine, general pediatrics,
96		-	obstetrics/gynecology, or emergency medicine or general surgery.

97	93		3. For the purposes of this section, "health center" shall mean
98	94		a federally qualified health center as defined by 42 U.S.C., Section
99	95		1905(1)(2)(B).
100	96		4. For the purposes of this section, "teaching health center"
101	97		shall mean a health center that supports the residencies of primary
102	98		care physicians within the operations of the health center.
103	99		5. The Program, depending upon and limited to available
104	100		funding, shall provide educational loan repayment assistance to
105	101		Oklahoma licensed primary care physicians and physician assistan ts
106	102		who agree to establish a practice in a community located in Oklahoma
107	103		approved by the Commission.
108	104		6. Each award shall be for a contracted period and shall be
109	105		distributed to the participant by drafts made payable to the
110	106		participant at the end of each con tract year with disbursements not
111	107		to exceed an amount to be established annually by the Commission.
112	108		Prior to any disbursement, the Commission shall certify and properly
113	109		review reports submitted by the participating physician or physician
114	110		assistant detailing performance of activities in accordance with the
115	111		Program.
116	112		7. The Commission shall review the performance in the Program
117	113		of the participating physician or physician assistant and determine

145	140		whether an award may be granted for additional years pursuant to
146	141		rules promulgated by the Commission.
147	142		B. The physicians and physician assistants entering the Program
148	143		each year shall agree to provide medical care and services in areas
149	144		designated by the Commission to provide medical care and services to
150	145		Medicaid recipients as authorized by the Oklahoma Health Care
151	146		Authority.
152	147		C. A physician or physician assistant shall be eligible to
153	148		participate in the loan repayment program Oklahoma Medical Loan
154	149		Repayment Program if the individual:
155	150		1. Is a physician that holds a curren t Oklahoma medical
156	151		license;
157	152		2. Is a new primary care graduate physician or physician
158	153		assistant. Preference will be given to graduates of the primary
159	154		care residency programs affiliated with the Oklahoma State
160	155		University College of Osteopathic Medicine, th e University of
161	156		Oklahoma College of Medicine and the teaching hospitals affiliated
162	157		with both schools of medicine and teaching health centers located in
163	158		this state; or
164	159		3. Is a current practicing physician or physician assistant and
165	160		has met criteria establi shed by the Commission.
166	161		D. The Commission may accept donations of public or private
167	162		funds to assist in funding the Oklahoma Medical Loan Repayment
168	163		Program. The Commission may, at its discretion, contract with other

196	190		public entities and non-profit nonprofit corporations for the
197	191		endowment, management and administration of such funds.
198	192		E. The Commission shall present a report on the operation of
199	193		the Program to the Governor, the Speaker of the House of
200	194		Representatives, and the President Pro Tempore of the Sena te within
201	195		one (1) month of the beginning of each regular session of the
202	196		Legislature, including but not limited to the progress made in
203	197		accomplishing the goal of the Program.
204	198		SECTION 2. AMENDATORY 70 O.S. 2011, Section 697.3, as
205	199		amended by Section 3, Chapter 67, O.S.L. 2020 (70 O.S. Supp. 2020,
206	200		Section 697.3), is amended to read as follows:
207		-	Section 697.3. The Physician Manpower Training Commission shall

208	202		be composed of seven (7) members appointed by the Governor with the
209	203		advice and consent of the Senate. Upon the expiration of the term
210	204		of one of the nonphysician members, three members shall be
211	205		practicing allopathic physicians, three shall be practicing
212	206		osteopathic physicians and one shall not be a physician nurse
213	207		practitioner. The membership shall be appointed from diverse
214	208		geographic areas of the state. No board member serving on November
215	209		1, 2001, shall be removed from the board to satisfy the requirements
216	210		of this section, but appointments to fill vacancies subsequent to
217	211		November 1, 2001, shall be subject to the requirements of this
218	212		section. Three members of the Commission shall be appointed for
219	213		one-year terms, two members shall be appointed for three -year terms

248	241		expiration of the initial terms, succeeding terms of office shall be
249	242		five (5) years in duration. There shall be also twelve additional
250	243		nonvoting ex officio members of the Commission who shall serve in an
251	244		advisory capacity only and include the Dean of the Univ ersity of
252	245		Oklahoma College of Medicine or designee, the Dean of the University
253	246		of Oklahoma College of Medicine - Tulsa or designee, the Chair of
254	247		the Department of Family Medicine of the University of Oklahoma
255	248		Health Sciences Center or designee, the Chair o f the Department of
256	249		Family Practice of the University of Oklahoma College of Medicine -
257	250		Tulsa or designee, the Chair of the Department of General Practice
258	251		of the Oklahoma College of Osteopathic Medicine and Surgery or
259	252		designee, the President of the Oklahom a Academy of Family Physicians
260	253		or designee, the President of the Oklahoma State Medical Association
261	254		or designee, the President of the Oklahoma State Osteopathic
262	255		Association or designee, the President of the Oklahoma Hospital
263	256		Association or designee, the St ate Commissioner of Health or
264	257		designee, the Provost of the University of Oklahoma Health Sciences
265	258		Center or designee, and the Dean of the Oklahoma College of
266	259		Osteopathic Medicine and Surgery or designee. Members of the
267	260		Commission shall serve without salar y, but may be reimbursed for
268	261		travel expenses in attending meetings and performing their duties
269	262		pursuant to the State Travel Reimbursement Act, Section 500.1 et
270	263		seq. of Title 74 of the Oklahoma Statutes.
