58 | 58 | | 1. A nonvacated adjudication of guilt; |

95 | 95 | | B. The Department of Public Safety shall disqualify any person |
---|
96 | 96 | | from operating a Class A, B or C commercial motor veh icle for a |
---|
97 | 97 | | period of not less than one (1) year upon receiving a record of |
---|
98 | 98 | | conviction of any of the following disqualifying offenses, when the |
---|
99 | 99 | | conviction has become final: |
---|
100 | 100 | | 1. Driving, operating or being in actual physical control of a |
---|
101 | 101 | | Class A, B or C comm ercial motor vehicle while having a blood or |
---|
102 | 102 | | breath alcohol concentration, as defined in Section 756 of this |
---|
103 | 103 | | title, or as defined by the state in which the arrest occurred, of |
---|
104 | 104 | | four-hundredths (0.04) or more; |
---|
105 | 105 | | 2. Refusing to submit to a test for determinati on of alcohol |
---|
106 | 106 | | concentration, as required by Section 751 of this title, or as |
---|
107 | 107 | | required by the state in which the arrest occurred, while operating |
---|
108 | 108 | | a Class A, B or C commercial motor vehicle, or if the person is the |
---|
109 | 109 | | holder of a commercial driver license, comm itting the offense while |
---|
110 | 110 | | operating any vehicle; |
---|
111 | 111 | | 3. Driving or being in actual physical control of a Class A, B |
---|
112 | 112 | | or C commercial motor vehicle while under the influence of alcohol |
---|
113 | 113 | | or any other intoxicating substance or the combined influence of |

145 | 145 | | because of a test result or test refusal pursuant to paragraph 1 or |
---|
146 | 146 | | 2 of this subsection as a result of the same violation arising from |
---|
147 | 147 | | the same incident; |
---|
148 | 148 | | 4. Knowingly leaving the scene of a collision w hich occurs |
---|
149 | 149 | | while operating a Class A, B or C commercial motor vehicle, or if |
---|
150 | 150 | | the person is the holder of a commercial driver license, committing |
---|
151 | 151 | | the offense while operating any vehicle; |
---|
152 | 152 | | 5. Any felony during the commission of which a Class A, B or C |
---|
153 | 153 | | commercial motor vehicle is used, except a felony involving the |
---|
154 | 154 | | manufacture, distribution or dispensation of a controlled dangerous |
---|
155 | 155 | | substance, or if the person is the holder of a commercial driver |
---|
156 | 156 | | license, committing the offense while operating any vehicle; |
---|
157 | 157 | | 6. Operating a commercial motor vehicle while the commercial |
---|
158 | 158 | | driving privilege is revoked, suspended, canceled, denied, or |
---|
159 | 159 | | disqualified; |
---|
160 | 160 | | 7. Manslaughter homicide, or negligent homicide occurring as a |
---|
161 | 161 | | direct result of negligent operation of a commercial moto r vehicle, |
---|
162 | 162 | | or, if the person is the holder of a commercial driver license, |
---|
163 | 163 | | committing the offense while operating any vehicle; |

196 | 196 | | C. The Department of Public Safety shall disqualify any person |
---|
197 | 197 | | from operating a Class A, B or C commercial motor vehicle for a |
---|
198 | 198 | | period of not less than three (3) years upon receiving a record of |
---|
199 | 199 | | conviction of any of the disqualifying offenses described in |
---|
200 | 200 | | subsection B of this section, committed in connection with the |
---|
201 | 201 | | operation of a motor vehicle which is required to be placarded for |
---|
202 | 202 | | hazardous materials under 49 C.F.R., Part 172, subpart F, when the |
---|
203 | 203 | | conviction has become final. |
---|
204 | 204 | | D. The Department of Public Safety shall disqualify any pe rson |
---|
205 | 205 | | from operating a Class A, B or C commercial motor vehicle for life |
---|
206 | 206 | | upon receiving a record of conviction in any court of any of the |
---|
207 | 207 | | disqualifying offenses described in subsection B of this section |
---|
208 | 208 | | after a former conviction of any of the following disq ualifying |
---|
209 | 209 | | offenses, when the second conviction has become final. |
---|
210 | 210 | | The Department of Public Safety may promulgate rules |
---|
211 | 211 | | establishing conditions under which a disqualification for life |
---|
212 | 212 | | pursuant to the provisions of this subsection may be reduced to a |
---|

244 | 244 | | 1. Any felony related to the manufacture, distribution or |
---|
245 | 245 | | dispensation of a controlled dangerous substance in the commission |
---|
246 | 246 | | of which a Class A, B or C commercial motor vehicle is used, or if |
---|
247 | 247 | | the person is the holder of a commercial d river license, committing |
---|
248 | 248 | | the offense while operating any vehicle, when the conviction has |
---|
249 | 249 | | become final; or |
---|
250 | 250 | | 2. Any felony for the offense of human trafficking for labor or |
---|
251 | 251 | | human trafficking for commercial sex pursuant to the provisions of |
---|
252 | 252 | | Section 748 of Title 21 of the Oklahoma Statutes . |
---|
253 | 253 | | F. The Department of Public Safety shall disqualify any person |
---|
254 | 254 | | from operating a Class A, B or C commercial motor vehicle for sixty |
---|
255 | 255 | | (60) days upon receiving a record of a second conviction of the |
---|
256 | 256 | | person for a serious traff ic offense arising out of separate |
---|
257 | 257 | | transactions or occurrences within a three -year period, when the |
---|
258 | 258 | | convictions have become final. The Department of Public Safety |
---|
259 | 259 | | shall disqualify any person from operating a Class A, B or C |
---|
260 | 260 | | commercial motor vehicle for on e hundred twenty (120) days upon |
---|
261 | 261 | | receiving a record of a third conviction of a person for a serious |
---|
262 | 262 | | traffic offense arising out of separate transactions or occurrences |
---|

296 | 296 | | 1. Speeding fifteen (15) miles per hour or more over the limit; |
---|
297 | 297 | | 2. Reckless driving; |
---|
298 | 298 | | 3. Any traffic offense committed that results in or in |
---|
299 | 299 | | conjunction with a motor vehicle collision resulting in a fatal ity; |
---|
300 | 300 | | 4. Erratic or unsafe lane changes; |
---|
301 | 301 | | 5. Following too closely; |
---|
302 | 302 | | 6. Failure to obtain a commercial driver license; |
---|
303 | 303 | | 7. Failure to have in possession of the person a commercial |
---|
304 | 304 | | driver license; |
---|
305 | 305 | | 8. Failure to have: |
---|
306 | 306 | | a. the proper class of commercial drive r license for the |
---|
307 | 307 | | class of vehicle being operated, |
---|
308 | 308 | | b. the proper endorsement or endorsements for the type of |
---|
309 | 309 | | vehicle being operated, including but not limited to, |
---|
310 | 310 | | passengers or type of cargo being transported, or |
---|
311 | 311 | | c. both proper class and proper endorsement , as provided |
---|

---|
344 | 344 | | For the purposes of paragraphs 9 and 10 of this subsection, |
---|
345 | 345 | | operating a commercial motor vehicle and using an electronic |
---|
346 | 346 | | communication device or a hand -held mobile telephone is permissible |
---|
347 | 347 | | by the operator when necessary to communicate with law enforcement |
---|
348 | 348 | | officials or other emergency services. Further, for the purposes of |
---|
349 | 349 | | paragraphs 9 and 10 of this subsection, "operate" means operating on |
---|
350 | 350 | | a street or highway, including while temporarily stationary because |
---|
351 | 351 | | of traffic, a traffic control device or other momentary delays. |
---|
352 | 352 | | Operating does not include when the driver of a commercial motor |
---|
353 | 353 | | vehicle has moved the vehicle to the side of or off a street or |
---|
354 | 354 | | highway and has halted in a location where the vehicle can safe ly |
---|
355 | 355 | | remain stationary. |
---|
356 | 356 | | G. Upon the receipt of a person 's record of conviction of |
---|
357 | 357 | | violating a lawful out -of-service order, when the conviction becomes |
---|
358 | 358 | | final the Department shall disqualify the driving privilege of the |
---|
359 | 359 | | person as follows: |

360 | 360 | | 1. For a first conv iction for violating an out -of-service |

400 | 400 | | paragraph, the period of disqualification shall be for |
---|
401 | 401 | | two (2) years, or |
---|
402 | 402 | | b. while transporting hazardous materials required to be |
---|
403 | 403 | | placarded under the Hazardous Materials Transportation |
---|
404 | 404 | | Act, 49 P. app. 180-1813, or while operating a motor |
---|
405 | 405 | | vehicle designed for transport of sixteen (16) or more |
---|

437 | 437 | | H. Upon determination by the Department that fraudulent |
---|
438 | 438 | | information was used to apply for or obtain a Class A, B or C driver |
---|
439 | 439 | | license, the Department shall disqualify the driving privilege of |
---|
440 | 440 | | the applicant or licensee for a period of sixty (60) days. |
---|
441 | 441 | | I. Any person who drives a Class A, B or C commercial motor |
---|
442 | 442 | | vehicle on any public roads, streets, highways, turnpikes or any |
---|
443 | 443 | | other public place of this state at a time when the person has been |
---|
444 | 444 | | disqualified or when the privilege to do so is canceled, denied, |
---|
445 | 445 | | suspended or revoked shall be guilty of a misdemeanor and upon |
---|
446 | 446 | | conviction shall be punished by a fine of not less than One Hundred |
---|
447 | 447 | | Dollars ($100.00) and not more than Five Hundred Dollars ($500.00), |
---|
448 | 448 | | or by imprisonment for not more than one (1) year, or by both such |
---|
449 | 449 | | fine and imprisonment. Each act of driving as prohibited shall |
---|
450 | 450 | | constitute a separate offense. |
---|

501 | 501 | | of a Class A, B or C commercial motor vehicle, or if the nonresident |
