4040 An Act relating to public health; creating the COVID-
4141 19 Save Lives Response Act; providing for effective

4646 certain entities to compel compliance or r emoval;
4747 prohibiting certain non essential gatherings;
4848 requiring compliance with certain guidelines;
4949 requiring the reduction of in -person workforce of

6060 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6161 SECTION 1. NEW LAW A new section of law to be codified
6262 in the Oklahoma Statutes as Section 7320 of Title 63, unless there
6363 is created a duplication in numbering, reads as follows:
6464 This act shall be known and may be cited as the "COVID-19 Save
6565 Lives Response Act". It shall remain in force and effect until the
6666 State Department of Health confirms that no mo re than three hundred
6767 (300) persons have been hospitalized statewide for COVID-19 on any

9696 SECTION 2. NEW LAW A new section of law to be codified
9797 in the Oklahoma Statutes as Section 7321 of Title 63, unless there

9999 For purposes of this a ct:
100100 A. "Essential businesses " shall include, but not be limited to ,
101101 the following:
102102 1. Health care operations, including research or laboratory
103103 services;
104104 2. Infrastructure entities, including utilities,
105105 telecommunications, airports and transportation;
106106 3. Hotels and places of accommodation;
107107 4. Manufacturing, including food processing and
108108 pharmaceuticals;
109109 5. Grocery stores and pharmacies;
110110 6. Services, including trash coll ection, mail and shipping;
111111 7. News media;
112112 8. Banks and financial institutions;
113113 9. Providers of basic necessities to economi cally disadvantaged
114114 populations;

142142 11. Vendors of essential services necessary to maintain the
143143 safety, sanitation and essential operations of residences or other
144144 essential businesses;
145145 12. Vendors that provide essential services or products,
146146 including logistics and technology support;
147147 13. Child care providers;
148148 14. Support services needed to ensure the continuing o peration
149149 of government agencies and to provide for the health, sa fety and
150150 welfare of the public; and
151151 15. Places of worship that are eligible for the religious
152152 exemption found in Section 501(c)(3) of Title 26 of the United
153153 States Code.
154154 B. "Face-coverings" shall include, but not be limited to, clot h
155155 masks, whether homemade, sewn or quick-cut, bandanas, surgi cal masks
156156 and N95 respirators.
157157 C. "Social distance" shall mean a distance of at least six (6)
158158 feet between any persons not of the same household.
159159 SECTION 3. NEW LAW A new section of law to be codified
160160 in the Oklahoma Statutes as Section 7322 of Title 63, unless there
161161 is created a duplication in numbering, reads as follows:
162162 A. Any person who is five (5) years of age or older and w ho is
163163 medically able to tolerate a face covering shall be required to
164164 cover his or her nos e and mouth with a mask or face covering when in

191191 a public place and unable to maintain, or when not maintain ing,
192192 social distance.
193193 B. Any passenger of a public or pri vate transportation ca rrier
194194 or other for-hire vehicle who is five (5) years of age or older and
195195 who is medically able to tolerate a face -covering shall wear a mask
196196 or face-covering over the nose and mouth during any such trip. A ny
197197 employee of such public or private transportation carrier who is
198198 operating such public or private transport shall likewise wear a
199199 mask or face-covering which covers the nose and mouth while there
200200 are any passengers in the vehicle.
201201 C. Any employee who is present in the workplace shall be
202202 provided and shall wear a mask or face -covering when in direct
203203 contact with customers or members of the public or when unable to
204204 maintain social distance. Employees of food service establishments
205205 must wear a mask or face -covering at all times whi le at their places
206206 of work. Businesses must provide, at their expense, such face
207207 coverings for their employees.
208208 D. Business operators, building owners, and those authorized on
209209 their behalf or otherwise authorized to use the building shall deny
210210 admittance to any person who fails to c omply with this section and
211211 shall require or compel such persons ' removal. Provided, however,
212212 this subsection shall be applied in a manner consistent the
213213 Americans with Disabilities Act.

240240 SECTION 4. NEW LAW A new section of law to be codified
241241 in the Oklahoma Statutes as Section 7323 of Title 63, unless there
242242 is created a duplication in numbering, reads as follows:
243243 A. There shall be no non essential gatherings of greater than
244244 ten individuals for any reason at any location in the state,
245245 including, but not limited to, parties, celebrations or other social
246246 events.
247247 B. No person, business or other entity shall encourage or
248248 promote any nonessential gathering, including those on public
249249 property such as streets, s idewalks, parking lots, par ks or
250250 playgrounds, that would violate subsection A of this section.
251251 C. There shall be no non essential gatherings on sidewalks,
252252 streets or other public property within one hundred (100) feet of
253253 any food service establishment or a ny business holding a liquor
254254 license from the Alcoholic Beverage Laws Enforcement (ABLE)
255255 Commission.
256256 D. All nonessential gatherings that are permitted pursuant to
257257 this section shall comply with social distancing, cleaning and
258258 safety guidelines issued by the State Department of Health.
259259 SECTION 5. NEW LAW A new section of law to be codified
260260 in the Oklahoma Statutes as Section 7324 of Title 63, unless there
261261 is created a duplication in numbering, reads as follows:
262262 All business and not -for-profit entities in the state shall
263263 utilize, to the maximum extent safely possible, any telecommuting or

290290 work-from-home procedures. Each employer shall attempt to reduce
291291 the in-person workforce at any work location by one hundred percent
292292 (100%), provided that essential businesses shall not be subject to
293293 such in-person restrictions. An entity providing essential services
294294 or functions to an essential business or nonessential business shall
295295 not be subject to the in -person work restriction but may operate a t
296296 the level necessary to provide such service s or functions.
297297 SECTION 6. NEW LAW A new section of law to be codified
298298 in the Oklahoma Statutes as Section 7325 of Title 63, unless there
299299 is created a duplication in numbering, reads as f ollows:
300300 Individuals or entities that violate this a ct shall be subject
301301 to a fine not to exceed One Thousand Dollars ($1,000.00) for each
302302 violation; provided that individuals or entities who violate
303303 subsection A or B of Section 4 of this a ct shall be subject to a
304304 maximum fine of Fifteen T housand Dollars ($15,000.00) for each
305305 violation. Each day that there is a nonessential gathering or that
306306 an entity operates in a manner inconsistent with this a ct shall
307307 constitute a separate violation.
308308 SECTION 7. It being immediately necessary for the preservation
309309 of the public peace, health or safety, an emergency is hereby
310310 declared to exist, by reason whereof this act shall take effect and
311311 be in full force from and after its passage and approval.
