5750 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5851 SECTION 1. AMENDATORY 63 O.S. 2011, Section 6403, i s
5952 amended to read as follows:
6053 Section 6403. A. The declaration of a state of catastrophic
6154 health emergency shall activate the disaster response and recovery
6255 aspects of the state, local, and inter -jurisdictional disaster
6356 emergency plans in the affected po litical subdivisions or geographic
6457 areas. Such declaration authorizes the deployment and use of any
6558 forces to which the plans apply and the use or distribution of any
59+supplies, equipment, and materials and facilities assembled,
60+stockpiled, or available pu rsuant to this act.
61+B. During a state of catastrophic health emergency, the
62+Governor may:

93-supplies, equipment, and materials and facilities assembled,
94-stockpiled, or available pursuant to this act.
95-B. During a state of catastrophic health emergency, the
96-Governor may:
9789 1. Suspend the provisions of any regulatory statute prescribing
9890 procedures for conducting state business, or the orders and rules of
9991 any state agency, to the extent that strict compliance with the same
10092 would prevent, hinder, or delay necessary action (including
10193 emergency purchases) by the public health authority to respond to
10294 the catastrophic health emergency, or increase the health threat to
10395 the population;
10496 2. Utilize all available resources of the state government and
10597 its political subdivisions, as reasonably necessary to respond to
10698 the catastrophic health emergency;
10799 3. Transfer the direction, personnel, or functions of state
108100 departments and agencies in order to p erform or facilitate response
109101 and recovery programs regarding the catastrophic health emergency;
110102 4. Mobilize all or any part of the National Guard into service
111103 of the state. An order directing the National Guard to report for
112104 active duty shall state the purpose for which it is mobilized and
113105 the objectives to be accomplished;
114106 5. Provide aid to and seek aid from other states during the
115107 catastrophic health emergency in accordance with any interstate
116108 emergency compact made with this state; and
109+6. Seek aid from the federal government for the catastrophic
110+health emergency in accordance with federal programs or
111+requirements.

144-6. Seek aid from the federal government for the catastrophic
145-health emergency in accordance with federal programs or
146-requirements.
147138 C. The public health authority shall coordinate all matters
148139 pertaining to the catastrophic health emergency response of the
149140 state. The public health authority shall have primary jurisdiction,
150141 responsibility, and authority for:
151142 1. Planning and executing catastrophic health emergency
152143 assessment, mitigation, preparedness response, and recovery for the
153144 state;
154145 2. Coordinating catastrophic hea lth emergency response between
155146 state and local authorities during a catastrophic health emergency;
156147 3. Collaborating with relevant federal government authorities,
157148 elected officials of other states, private organizations or
158149 companies during a catastrophic h ealth emergency;
159150 4. Coordinating recovery operations and mitigation initiatives
160151 subsequent to catastrophic health emergencies; and
161152 5. Organizing public information activities regarding
162153 catastrophic health emergency response operations.
163154 D. After the declaration of a state of catastrophic health
164155 emergency, special identification for all public health personnel
165156 working during the catastrophic health emergency shall be issued as
166157 soon as possible. The identification shall indicate the authority
167158 of the bearer to exercise public health functions and emergency
159+powers during the state of catastrophic health emergency. Public
160+health personnel shall wear the identification in plain view.

197187 E. Nothing in the Catastrophic Health Emergency Powers Act
198188 shall allow the Governor or any other governmental entity to :
199189 1. Force a business to close;
200190 2. Limit or in any way restrict the hours of operation of a
201191 business; or
202192 3. Limit or restrict the number of occupants or patrons allowed
203193 in a business.
204194 SECTION 2. This act shall become effective November 1, 2021.
