56	56	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
57	57	SECTION 1. AMENDATORY Section 21, Chapter 366, O.S.L.
58	58	2016, as amended by Section 1, Chapter 81, O.S.L. 2020 (37A O.S.
59	59	Supp. 2020, Section 2-109), is amended to read as follows:
60	60	Section 2-109. A. A retail spirits license shall authorize the
61	61	holder thereof:
62	62	1. To purchase wine or spirits from a wine and spirits
63	63	wholesaler;
64	64	2. To purchase beer from a beer distributor or from the holder
65	65	of a small brewer self -distribution license; and

92	92	3. To sell same on the licensed premises in such containers to
93	93	consumers for off-premises consumption only and not for resale;
94	94	provided, spirits, wine and beer may be sold to charitable
95	95	organizations that are holders of charitable alcoholic beverage
96	96	auction or charitable alcoholic beverage event licenses.
97	97	B. A retail wine license shall authorize the holder thereof:
98	98	1. To purchase wine from a wine and spirits wholesaler;
99	99	2. To purchase wine from a s mall farm winemaker who is
100	100	permitted and has elected to self -distribute as provided in Article
101	101	XXVIII-A of the Oklahoma Constitution; and
102	102	3. To sell same on the licensed premises in such containers to
103	103	consumers for off-premises consumption only and not fo r resale;
104	104	provided, wine may be sold to charitable organizations that are
105	105	holders of charitable alcoholic beverage auction or charitable
106	106	alcoholic beverage event licenses ; and
107	107	4. To allow tasting parties within the licensed premises:
108	108	a. during normal business hours,
109	109	b. in a separate room or an area of the premises that has
110	110	been sectioned off,
111	111	c. if no person under twenty -one (21) years of age is
112	112	allowed in the room or area in which the tasting party
113	113	is held,
114	114	d. if the samples served at the tasting party ar e
115	115	provided to patrons at no cost to the patrons,

142	142	e. if any alcoholic beverages sold are sold in their
143	143	original sealed packages, and
144	144	f. if the licensee does not receive any gift or thing of
145	145	value in violation of Section 3 -119 of this title.
146	146	As used in this paragraph, "tasting parties" means events for
147	147	sampling a selection of spirits, wine or beer to compare qualities.
148	148	Samples served pursuant to this paragraph shall not be considered a
149	149	sale within the meaning of Article XXVIII -A of the Oklahoma
150	150	Constitution.
151	151	Provided, no holder of a retail wine license may sell wine with
152	152	alcohol beverage volume in excess of fifteen percent (15%).
153	153	C. A retail beer license shall authorize the holder thereof:
154	154	1. To purchase beer from a beer distributor;
155	155	2. To purchase beer fr om the holder of a small brewer self -
156	156	distribution license; and
157	157	3. To sell same on the licensed premises in such containers to
158	158	consumers for off-premises consumption only and not for resale;
159	159	provided, beer may be sold to charitable organizations that are
160	160	holders of charitable alcoholic beverage auction or charitable
161	161	alcoholic beverage event licenses.
162	162	Provided, no holder of a retail beer license may sell a malt
163	163	beverage with alcohol beverage volume in excess of fifteen percent
164	164	(15%).
