26	55		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

28	56		SECTION 1. NEW LAW A new section of law to be codified
29	57		in the Oklahoma Statutes as Section 3250 of Title 12, unless there
30	58		is created a duplication in numbering, reads as fol lows:

32		-	This act shall be known and may be cited as the "Uniform
33		-	Interstate Depositions and Discovery Act ".

35	61		SECTION 2. NEW LAW A new section of law to be codified
36	62		in the Oklahoma Statutes as Section 3 251 of Title 12, unless there
37	63		is created a duplication in numbering, reads as follow s:

	65	+	1. "Foreign jurisdiction" means a state other than this state;

43	93		2. "Foreign subpoena" means a subpoena issued under authority
44	94		of a court of record of a foreign jurisdiction;

46	95		3. "Person" means an individual, corporation, business t rust,
47	96		estate, trust, partnership, limited liability company, association,
48	97		joint venture, public corporation, government, or governmental
49	98		subdivision, agency or instrumentality, or any other legal or
50	99		commercial entity;

52	100		4. "State" means a state of the Unite d States, the District of
53	101		Columbia, Puerto Rico, the United States Virgin Islands, a fe derally
54	102		recognized Indian tribe or any territory or insular possession
55	103		subject to the jurisdiction of the United States; and

57	104		5. "Subpoena" means a document, however den ominated, issued
58	105		under authority of a court of record requiring a person to:
59		-
60	106		a. attend and give testimony at a deposition,
61		-
62	107		b. produce and permit inspection and copying of
63	108		designated books, documents, records, electronically
64	109		stored information or tangible things in the
65	110		possession, custody or control of the person, or
66		-
67	111		c. permit inspection of premises under the control of the
68	112		person.

74	143		A. To request issuance of a subpoena under this section, a
75	144		party must submit a foreign subpoena to a clerk of court in the
76	145		county in which discovery is sought to be conducted in th is state.
77	146		A request for the issuance of a subpoena under this act does not
78	147		constitute an appearance in the courts of this state.

80	148		B. When a party submits a foreign subpoena to a clerk of court
81	149		in this state, the clerk, in accordance with that court 's procedure,
82	150		shall promptly issue a subpoena for service upon the person to which
83	151		the foreign subpoena is directed.

85	152		C. A subpoena under subsection B of this section must:

87	153		1. Incorporate the terms used in the fore ign subpoena; and

89	154		2. Contain or be accompanied by the names, addresses and

94	158		SECTION 4. NEW LAW A new section of law to be codified
95	159		in the Oklahoma Statutes as Section 3253 of Title 12, unless there
96	160		is created a duplication in numbering, reads as follows:

98	161		A subpoena issued by a clerk of court under Section 3 of this
99	162		act must be served in compliance with subsection B of Section 2004.1

115	201		enforce, quash or modify a subpoena issued by a clerk of court under
116	202		Section 3 of this act must comply with the rules or statutes of this
117	203		state and be submitted to the court in the county in which discovery
118	204		is to be conducted.

120	205		SECTION 7. NEW LAW A new section of law to be codified
121	206		in the Oklahoma Statutes as Section 3256 of Title 12, unless there
122	207		is created a duplication in numberi ng, reads as follows:

124	208		In applying and construing this uniform act, consideration must
125	209		be given to the need to promote uniformity of the law with respect
126	210		to its subject matter among states that enact it.

128	211		SECTION 8. NEW LAW A new sect ion of law to be codified
129	212		in the Oklahoma Statutes as Section 3 257 of Title 12, unless there
130	213		is created a duplication in numbering, reads as follows:

132	214		This act applies to requests for discovery in cases pendin g on
133	215		November 1, 2021.
