2655 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

2856 SECTION 1. NEW LAW A new section of law to be codified
2957 in the Oklahoma Statutes as Section 3250 of Title 12, unless there
3058 is created a duplication in numbering, reads as fol lows:

32-This act shall be known and may be cited as the "Uniform
33-Interstate Depositions and Discovery Act ".

3561 SECTION 2. NEW LAW A new section of law to be codified
3662 in the Oklahoma Statutes as Section 3 251 of Title 12, unless there

4393 2. "Foreign subpoena" means a subpoena issued under authority
4494 of a court of record of a foreign jurisdiction;

4695 3. "Person" means an individual, corporation, business t rust,
4796 estate, trust, partnership, limited liability company, association,
4897 joint venture, public corporation, government, or governmental
4998 subdivision, agency or instrumentality, or any other legal or
5099 commercial entity;

52100 4. "State" means a state of the Unite d States, the District of
53101 Columbia, Puerto Rico, the United States Virgin Islands, a fe derally
54102 recognized Indian tribe or any territory or insular possession
55103 subject to the jurisdiction of the United States; and

57104 5. "Subpoena" means a document, however den ominated, issued
58105 under authority of a court of record requiring a person to:

60106 a. attend and give testimony at a deposition,
61-
62107 b. produce and permit inspection and copying of
63108 designated books, documents, records, electronically
64109 stored information or tangible things in the
65110 possession, custody or control of the person, or
66-
67111 c. permit inspection of premises under the control of the
68112 person.

70113 SECTION 3. NEW LAW A new section of law to be codified

74143 A. To request issuance of a subpoena under this section, a
75144 party must submit a foreign subpoena to a clerk of court in the
76145 county in which discovery is sought to be conducted in th is state.
77146 A request for the issuance of a subpoena under this act does not
78147 constitute an appearance in the courts of this state.

80148 B. When a party submits a foreign subpoena to a clerk of court
81149 in this state, the clerk, in accordance with that court 's procedure,
82150 shall promptly issue a subpoena for service upon the person to which
83151 the foreign subpoena is directed.

85152 C. A subpoena under subsection B of this section must:

87153 1. Incorporate the terms used in the fore ign subpoena; and
88-
89154 2. Contain or be accompanied by the names, addresses and
90-telephone numbers of all counsel of record in the proceeding to ENR. H. B. NO. 2229 Page 3
155+telephone numbers of all counsel of record in the proceeding to
91156 which the subpoena relates and of any party not represented by
92157 counsel.

94158 SECTION 4. NEW LAW A new section of law to be codified
95159 in the Oklahoma Statutes as Section 3253 of Title 12, unless there
96160 is created a duplication in numbering, reads as follows:

98161 A subpoena issued by a clerk of court under Section 3 of this
99162 act must be served in compliance with subsection B of Section 2004.1

115201 enforce, quash or modify a subpoena issued by a clerk of court under
116202 Section 3 of this act must comply with the rules or statutes of this
117203 state and be submitted to the court in the county in which discovery
118204 is to be conducted.

121206 in the Oklahoma Statutes as Section 3256 of Title 12, unless there
122207 is created a duplication in numberi ng, reads as follows:

124208 In applying and construing this uniform act, consideration must
125209 be given to the need to promote uniformity of the law with respect
126210 to its subject matter among states that enact it.
