40	40	An Act relating to roads, bridges and ferries;
41	41	amending 69 O.S. 2011, Section 3001, which relates to
42	42	authorization to construct toll expres sways by means
43	43	of public trusts; allowing for the planning,
44	44	financing, constructing, maintaining and operating of
45	45	toll bridges by certain entities; making certain
46	46	exceptions for toll bridges; and providing an
47	47	effective date.

54	54	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
55	55	SECTION 1. AMENDATORY 69 O.S. 2011, Section 3001, is
56	56	amended to read as follows:
57	57	Section 3001. A. Any county or combination of cities, counties
58	58	or towns, by resolution of their governing board s, may jointly
59	59	create a public trust for the purpose of planning, financing,
60	60	constructing, maintaining and operating a toll expressway or a toll
61	61	bridge upon the locations now or hereafter authorized by Section
62	62	1705 of Title 69, Oklahoma Statutes, and the s tate, or any county,
63	63	municipality, political or governmental subdivision or governmental
64	64	agency of the state or any combination thereof may be the

91	91	beneficiary of such trust; provided that no funds of said
92	92	beneficiary derived from sources other than the tru st property, or
93	93	the operation thereof, shall be charged with or expended for the
94	94	execution of said trust, except by express action of the legislative
95	95	authority of the beneficiary first had. The officers or any other
96	96	governmental agencies or authorities ha ving the custody, management
97	97	or control of any property, real or personal or both, of the
98	98	beneficiary of such trust, or of such a proposed trust, which
99	99	property shall be needful for the execution of the trust purposes,
100	100	hereby are authorized and empowered t o lease such property for said
101	101	purposes, after the acceptance of the beneficial interest therein by
102	102	the beneficiary as hereafter provided, or conditioned upon such
103	103	acceptance.
104	104	B. Toll bridges and their approaches that are not part of toll
105	105	expressways shall not be subject to the consent requirement se t
106	106	forth in Section 3006 of this title, and shall not be considered a
107	107	"toll expressway" as that term is used in S ection 3016 of this
108	108	title.
109	109	SECTION 2. This act shall become effective November 1, 2021.
