51 | 48 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |

52 | 49 | | SECTION 1. NEW LAW A new section of law to be codified |
---|
53 | 50 | | in the Oklahoma Statutes as Section 1176 of Title 21, unless there |
---|
54 | 51 | | is created a duplication in numbering, reads as follows: |

55 | 52 | | A. It shall be unlawful for a person, who by telecommunication |
---|
56 | 53 | | or electronic communication, as defined in Section 1172 of Title 21 |
---|
57 | 54 | | of the Oklahoma Statutes, to willfully publish on a public online |
---|
58 | 55 | | site or forum, attempt to publish or conspire to publish on a public |
---|
59 | 56 | | online site or forum personally identifiable information of a law |
---|
60 | 57 | | enforcement officer with the intent to threaten, intimidate, harass |
---|
61 | 58 | | or stalk, and, as a result, causes, attempts to cause or would be |
---|
62 | 59 | | reasonably expected to cause substantial emotional distress or |
---|
92 | 88 | | B. Except as provided in subsection C of this sec tion, any |
---|
93 | 89 | | person convicted of violating the provisions of subsection A of this |
---|
94 | 90 | | section shall be guilty of a misdemeanor. |
---|
95 | 91 | | C. Any person who is convicted of a second or subsequent |
---|
96 | 92 | | violation of subsection A of this section shall be guilty of a |
---|
97 | 93 | | felony. |
---|
98 | 94 | | D. As used in subsection A of this section: |
---|
99 | 95 | | 1. "Family or household member " means: |
---|
100 | 96 | | a. parents, including grandparents, stepparents, adoptive |
---|
101 | 97 | | parents and foster parents , |
---|
102 | 98 | | b. children, including grandchildren, stepchildren, |
---|
103 | 99 | | adopted children and foster children, and |
---|
104 | 100 | | c. persons otherwise related by blood or marriage living |
---|
105 | 101 | | in the same household; |
---|
106 | 102 | | 2. "Law enforcement officer " means any officer, agent or |
---|
107 | 103 | | employee of the state, a unit of local government , or federally |
---|
108 | 104 | | recognized American Indian tribe, authorized by law or by a |
---|
109 | 105 | | government agency to engage in or supervise the prevention , |
---|
110 | 106 | | detection or investigation of any violation of criminal law ; and |
---|
111 | 107 | | 3. "Personally identifiable information " includes, but is not |
---|
112 | 108 | | limited to: |

113 | 109 | | a. name, |
