30 | 58 | SECTION 1. NEW LAW A new section of law to be codified | |
31 | 59 | in the Oklahoma Statutes as Section 3 -601 of Title 2, unless there | |
32 | 60 | is created a duplication in numbering, reads as follows: | |

34 | 61 | A. This act shall be known and may be cited as the "Oklahoma | |
35 | 62 | Industrial Hemp Remediation Program". | |

37 | 63 | B. As used in the Oklahoma Industrial Hemp Remediation Program, | |
38 | 64 | the following words and terms, and any derivative of such words or | |
39 | 65 | terms, shall have the following meanings, unl ess the context clearly | |

56 | 105 | 4. "CSA" means the federal Controlled Substances Act ; | |

58 | 106 | 5. "DEA" means the United States Drug Enforcement | |

61 | 108 | 6. "Department" means the Oklahoma Department of Agriculture, | |
62 | 109 | Food, and Forestry; | |

64 | 110 | 7. "Hemp" means the plant Cannabis sativa L. and any part of | |
65 | 111 | such plant including, but not limited to, the seeds and all | |
66 | 112 | derivatives, extracts, cannabinoids, isomers, acids, salts and salts | |
67 | 113 | of isomers, whether growing or not, and grown from a certified seed | |
68 | 114 | with a delta-9 tetrahydrocannabinol concentration of not more than | |
69 | 115 | three-tenths of one percent (0.3%) on a dry -weight basis. Hemp and | |

84 | 153 | 11. "Person" means any natural person or any corporation, | |
85 | 154 | general partnership, limited partnership, limited liability | |
86 | 155 | partnership, limited liability company, trust, estate, charitab le | |
87 | 156 | organization, joint stock company, joint venture, associ ation or any | |
88 | 157 | other business or similar organization recognized by the state ; | |

90 | 158 | 12. "Processor" means any person who is licensed by the | |
91 | 159 | Department to process hemp in this state ; | |

95 | 161 | 14. "THC" means delta -9 tetrahydrocannabinol, which is a | |
96 | 162 | psychoactive component in cannabis plants ; | |

98 | 163 | 15. "Tracking software" means software that is approved by the | |
99 | 164 | Department and is capable of transparently tracking hemp in any | |
100 | 165 | state or form whatsoever including, but not limited to, a certifi ed | |
101 | 166 | seed, any stage of growth, processing or handling, and any hemp | |

112 | 201 | D. If the Department approves the rem ediation of the | |
113 | 202 | noncompliant hemp, the person holding the l icense shall promptly | |
114 | 203 | have the noncompliant hemp extracted by a licensed processor into | |
115 | 204 | concentrated form and the hemp concentrate shall be sampled by a | |
116 | 205 | certified laboratory for compliance with USD A levels for THC in | |
117 | 206 | concentrated form. | |

119 | 207 | E. If the samples o f the hemp concentrate are below USDA levels | |
120 | 208 | for THC, the hemp concentrate shall be co mpliant as a hemp product | |
121 | 209 | with the Hemp Program and may be used in commercial sales. | |

123 | 210 | F. If the samples of the hemp concentrate are above the USDA | |
124 | 211 | levels for THC, the hem p concentrate shall be noncompliant with the | |
125 | 212 | Hemp Program and shall be destroyed in accordance with the CSA and | |
126 | 213 | DEA regulations found at 21 C .F.R., Section 1317.15, as enforced by | |
127 | 214 | federal, state and local law enforcement. The person holding the | |
128 | 215 | license for the noncompliant hemp concentrate shall promptly notify | |
129 | 216 | the Department and USDA of its intent to destroy the noncompliant | |
130 | 217 | hemp concentrate and verify destruction by submitting required | |
131 | 218 | documentation using the tracking software. | |
