3361 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3562 SECTION 1. NEW LAW A new section of law to be codified
3663 in the Oklahoma Statutes as Section 2 -3-105 of Title 10A, unless
3764 there is created a duplication in numbering, reads as follows:

3965 A. The Oklahoma Commission on Children and Youth sh all
4066 administer a grievance process to be utilized by children detained
4167 in an adult jail, adult lockup, adult detention or other adult
4268 facility. The grievance process shall be available to a child at

4396 any time prior to or after adjudication or conviction or during his
4497 or her incarceration. Grievances may be filed ei ther by the child

4699 defined by Section 2 -1-103 of Title 10A of the Oklahoma Statutes
47100 acting on the child's behalf.

49101 B. Grievances shall be directed to the Commission's Office of
50102 Juvenile System Oversight for investigation, resolution and referral
51103 to the appropriate agency if deemed necessary, including, but not
52104 limited to, the State Department of Health.

54105 1. The Office of Juvenile Sy stem Oversight shall have the
55106 authority to investigate compla ints, including, but not limited to,
56107 the following:

58108 a. placement,

60109 b. treatment,

62110 c. psychological services,

64111 d. social services,

66112 e. educational services,

68113 f. recreation,

70114 g. abuse, neglect or miscond uct,

72115 h. cleanliness and hygiene, and

74116 i. routine problems with employees, contractors or other
75117 incarcerated persons within the facility.

77118 2. The Office of Juvenile System Oversight shall notify the
78119 Office of Juvenile Affairs compliance monitor or designee w hen a

79147 grievance is received. The Office of Juvenile System O versight
80148 shall notify the Department of Human Services when a grievance is
81149 received regarding a child in the custody of the Department of Human
82150 Services.

84151 C. Each facility in which children are being held shall:

86152 1. Make all grievance policies and procedu res available upon
87153 request to any member of the public;

89154 2. Make grievance policies and procedures readily accessible to

155+any children in the facility; and
92156 3. Explain all grievance policies and p rocedures to every child
93157 during his or her intake at the faci lity.

95158 D. The Oklahoma Commission on Children and Youth shall
96159 promulgate rules for the purposes of administering this section that
97160 are consistent with grievance procedures available to children
98161 detained in juvenile detention facilities as promulgated by th e
99162 Office of Juvenile Affairs.

101163 E. The provisions of this section shall not apply to any child
102164 housed in a Department of Corrections facility or housed under a
103165 contract with the Department of Corr ections.
