4040 An Act relating to firearms; amending 21 O.S. 2011,

4343 1290.22), which relates to the Oklahoma Self -Defense
4444 Act; prohibiting business entities from establishing
4545 certain policy or rule; and providing an effective

5252 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5353 SECTION 1. AMENDATORY 21 O.S. 2011, Section 1290.22, as
5454 last amended by Section 12, Chapter 1, O.S.L. 2019 (21 O.S. Supp.
5555 2020, Section 1290.22), is amended to read as follows:

5757 BUSINESS OWNER'S RIGHTS
5858 A. Except as provided in subsections B, C and D of this
5959 section, nothing contained in any provision of the Oklahoma Self -
6060 Defense Act shall be construed to limit, restrict or prohibit in any
6161 manner the existing rights of any person, property owner, tenant,
6262 employer, place of wor ship or business entity to control the

8989 possession of weapons on any property owned or controlled by the
9090 person or business entity.
9191 B. 1. No person, property owner, tenant, employer, holder of
9292 an event permit, place of worship or business entity shall be
9393 permitted to establish any policy or rule that has the effect of
9494 prohibiting any person, except a convicted felon, from transporting
9595 and storing firearms in a locked vehicle on any property set aside
9696 for any vehicle.
9797 2. No person or business entity shall establish, maintain or
9898 enforce any policy or rule that has the effect of prohibiting any
9999 person or employee of the business entity, except a convicted felon,
100100 from transporting, carrying or storing firearms or ammunition in a
101101 motor vehicle personally owned, leased or rented by the person or
102102 employee while conducting business for the business entity.
103103 C. A property owner, tenant, employer, place of worship or
104104 business entity may prohibit any person from carrying a concealed or
105105 unconcealed firearm on the prope rty. If the building or property is
106106 open to the public, the property owner, tenant, employer, place of
107107 worship or business entity shall post signs on or about the property
108108 stating such prohibition.
109109 D. No person, property owner, tenant, employer, holder o f an
110110 event permit, place of worship or business entity shall be permitted
111111 to establish any policy or rule that has the effect of prohibiting
112112 any person from carrying a concealed or unconcealed firearm on

139139 property within the specific exclusion provided for in paragraph 4
140140 of subsection B of Section 1277 of this title; provided that
141141 carrying a concealed or unconcealed firearm may be prohibited in the
142142 following places:
143143 1. The portion of a public property structure or building
144144 during an event authorized by the city, town, county, state or
145145 federal governmental authority owning or controlling such building
146146 or structure;
147147 2. Any public property sports field, including any adjacent
148148 seating or adjacent area set aside for viewing a sporting event,
149149 where an elementary or secondary school, collegiate, or professional
150150 sporting event or an International Olympic Committee or organization
151151 or any committee subordinate to the International Olympic Committee
152152 event is being held;
153153 3. The fairgrounds during the Oklahoma State Fai r or the Tulsa
154154 State Fair; and
155155 4. The portion of a public property structure or building that
156156 is leased or under contract to a business or not -for-profit entity
157157 or group for offices.
158158 E. The otherwise lawful carrying of a concealed or unconcealed
159159 firearm by a person on property that has signs prohibiting the
160160 carrying of firearms shall subject the person to being denied
161161 entrance onto the property or removed from the property. If the

189189 1. Has been informed by the property owner, business entity or
190190 manager of the business that the person is in violation of a policy
191191 that prohibits firearms on the property; and
192192 2. Refuses to leave the property and a peace officer is
193193 summoned,
194194 the person may be punished as provided in Section 1276 of this
195195 title.
196196 F. A person, property owner, tenant, employer, holder of an
197197 event permit, place of worship or business entity that does or does
198198 not prohibit any individual, except a convicted felon, from carrying
199199 a loaded or unloaded, concealed or unconcealed weapon on property
200200 that the person, property owner, tenant, employer, holder of an
201201 event permit, place of worship or business entity owns, or has legal
202202 control of, is immune from any liability arising from that decision.
203203 Except for acts of gross negligence or willful or wan ton misconduct,
204204 an employer who does or does not prohibit his or her employees from
205205 carrying a concealed or unconcealed weapon is immune from any
206206 liability arising from that decision. A person, property owner,
207207 tenant, employer, holder of an event permit, place of worship or
208208 business entity that does not prohibit persons from carrying a
209209 concealed or unconcealed weapon pursuant to subsection D of this
210210 section shall be immune from any liability arising from the carrying
211211 of a concealed or unconcealed weapon, w hile in the scope of
212212 employment, on the property or in or about a business entity

239239 vehicle. The provisions of this subsection shall not apply to
240240 claims pursuant to the Administrative Workers ' Compensation Act.
241241 G. It shall not be considered part of an empl oyee's job
242242 description or within the employee 's scope of employment if an
243243 employee is allowed to carry or discharge a weapon pursuant to this
244244 section.
245245 H. Nothing in subsections F and G of this section shall prevent
246246 an employer, employee or person who has suffered loss resulting from
247247 the discharge of a weapon to seek redress or damages of the person
248248 who discharged the weapon or used the weapon outside the provisions
249249 of the Oklahoma Self -Defense Act.
250250 SECTION 2. This act shall become effectiv e November 1, 2021.
