44	44	Act; prohibiting business entities from establishing

52	52	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
53	53	SECTION 1. AMENDATORY 21 O.S. 2011, Section 1290.22, as
54	54	last amended by Section 12, Chapter 1, O.S.L. 2019 (21 O.S. Supp.
55	55	2020, Section 1290.22), is amended to read as follows:
56	56	Section 1290.22
57	57	BUSINESS OWNER'S RIGHTS
58	58	A. Except as provided in subsections B, C and D of this
59	59	section, nothing contained in any provision of the Oklahoma Self -
60	60	Defense Act shall be construed to limit, restrict or prohibit in any
61	61	manner the existing rights of any person, property owner, tenant,
62	62	employer, place of wor ship or business entity to control the

89	89	possession of weapons on any property owned or controlled by the
90	90	person or business entity.
91	91	B. 1. No person, property owner, tenant, employer, holder of
92	92	an event permit, place of worship or business entity shall be
93	93	permitted to establish any policy or rule that has the effect of
94	94	prohibiting any person, except a convicted felon, from transporting
95	95	and storing firearms in a locked vehicle on any property set aside
96	96	for any vehicle.
97	97	2. No person or business entity shall establish, maintain or
98	98	enforce any policy or rule that has the effect of prohibiting any
99	99	person or employee of the business entity, except a convicted felon,
100	100	from transporting, carrying or storing firearms or ammunition in a
101	101	motor vehicle personally owned, leased or rented by the person or
102	102	employee while conducting business for the business entity.
103	103	C. A property owner, tenant, employer, place of worship or
104	104	business entity may prohibit any person from carrying a concealed or
105	105	unconcealed firearm on the prope rty. If the building or property is
106	106	open to the public, the property owner, tenant, employer, place of
107	107	worship or business entity shall post signs on or about the property
108	108	stating such prohibition.
109	109	D. No person, property owner, tenant, employer, holder o f an
110	110	event permit, place of worship or business entity shall be permitted
111	111	to establish any policy or rule that has the effect of prohibiting
112	112	any person from carrying a concealed or unconcealed firearm on

139	139	property within the specific exclusion provided for in paragraph 4
140	140	of subsection B of Section 1277 of this title; provided that
141	141	carrying a concealed or unconcealed firearm may be prohibited in the
142	142	following places:
143	143	1. The portion of a public property structure or building
144	144	during an event authorized by the city, town, county, state or
145	145	federal governmental authority owning or controlling such building
146	146	or structure;
147	147	2. Any public property sports field, including any adjacent
148	148	seating or adjacent area set aside for viewing a sporting event,
149	149	where an elementary or secondary school, collegiate, or professional
150	150	sporting event or an International Olympic Committee or organization
151	151	or any committee subordinate to the International Olympic Committee
152	152	event is being held;
153	153	3. The fairgrounds during the Oklahoma State Fai r or the Tulsa
154	154	State Fair; and
155	155	4. The portion of a public property structure or building that
156	156	is leased or under contract to a business or not -for-profit entity
157	157	or group for offices.
158	158	E. The otherwise lawful carrying of a concealed or unconcealed
159	159	firearm by a person on property that has signs prohibiting the
160	160	carrying of firearms shall subject the person to being denied
161	161	entrance onto the property or removed from the property. If the
162	162	person:

189	189	1. Has been informed by the property owner, business entity or
190	190	manager of the business that the person is in violation of a policy
191	191	that prohibits firearms on the property; and
192	192	2. Refuses to leave the property and a peace officer is
193	193	summoned,
194	194	the person may be punished as provided in Section 1276 of this
195	195	title.
196	196	F. A person, property owner, tenant, employer, holder of an
197	197	event permit, place of worship or business entity that does or does
198	198	not prohibit any individual, except a convicted felon, from carrying
199	199	a loaded or unloaded, concealed or unconcealed weapon on property
200	200	that the person, property owner, tenant, employer, holder of an
201	201	event permit, place of worship or business entity owns, or has legal
202	202	control of, is immune from any liability arising from that decision.
203	203	Except for acts of gross negligence or willful or wan ton misconduct,
204	204	an employer who does or does not prohibit his or her employees from
205	205	carrying a concealed or unconcealed weapon is immune from any
206	206	liability arising from that decision. A person, property owner,
207	207	tenant, employer, holder of an event permit, place of worship or
208	208	business entity that does not prohibit persons from carrying a
209	209	concealed or unconcealed weapon pursuant to subsection D of this
210	210	section shall be immune from any liability arising from the carrying
211	211	of a concealed or unconcealed weapon, w hile in the scope of
212	212	employment, on the property or in or about a business entity

239	239	vehicle. The provisions of this subsection shall not apply to
240	240	claims pursuant to the Administrative Workers ' Compensation Act.
241	241	G. It shall not be considered part of an empl oyee's job
242	242	description or within the employee 's scope of employment if an
243	243	employee is allowed to carry or discharge a weapon pursuant to this
244	244	section.
245	245	H. Nothing in subsections F and G of this section shall prevent
246	246	an employer, employee or person who has suffered loss resulting from
247	247	the discharge of a weapon to seek redress or damages of the person
248	248	who discharged the weapon or used the weapon outside the provisions
249	249	of the Oklahoma Self -Defense Act.
250	250	SECTION 2. This act shall become effectiv e November 1, 2021.
