3565 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3766 SECTION 1. NEW LAW A new section of law to be codified
3867 in the Oklahoma Statut es as Section 51.4 of Title 74, unless there
3968 is created a duplication in numbering, reads as follows:

4169 A. The State of Oklahoma shall establish a program to provide
4270 financial assistance for funeral e xpenses of members of the state

4398 military forces who died in the line of duty while serving on state
4499 active duty orders. For purposes of this section, the terms "state
45100 military forces" and "state active duty" shall have the same
46-definition as provided i n Section 801 of Title 44 of the Oklahoma ENR. H. B. NO. 2374 Page 2
101+definition as provided in S ection 801 of Title 44 of the Oklahoma
47102 Statutes. The program shall provide reimbursement of the funeral
48103 expenses for any eligible member of the state military forces as
49104 determined in accordance with this section by the Director of the
50105 Oklahoma Department of Emergency Management. The reimbursement
51106 shall not exceed Ten Thousand Dollars ($10,000.00).

53107 B. The Director or his or her designee shall determine whether
54108 the deceased member meets eligibility criteria for the program, make
55109 final approval of all reimb ursement applications and disburse funds.
56110 Reimbursement funds shall be paid from the Oklahoma Homeland
57111 Security Revolving Fund. Regulations and application processes for
58112 the implementation of this program shall be promulgated by the
59113 Director.

61114 SECTION 2. AMENDATORY 74 O.S. 2011, Sectio n 51.2, as
62115 amended by Section 701, Chapter 304, O.S.L. 2012 (74 O.S. Supp.
63116 2020, Section 51.2), is amended to read as follows:

65-Section 51.2 A. There is hereby created in the State Treasury

66118 a revolving fund for the Oklahoma Office of Homeland Security to be
67119 designated the "Oklahoma Homeland Security Revolving Fund". The

73151 1. Reimbursements from responsible parties for reasonable
74152 actions taken and costs incurred by a regional team in response to
75153 an incident or event involvin g a dangerous substance;

77154 2. Reimbursements, grants, or ot her monies received from other
78155 state agencies and entities of state government;

80156 3. Reimbursements, grants, or other monies received by the
81157 Oklahoma Office of Homeland Security or the Department of Public
82158 Safety from the United States government or pursuan t to proceedings
83159 in district court to enforce claims initiated pursuant to the
84160 Oklahoma Homeland Security Act or the Oklahoma Emergency Response
85161 Act;

87162 4. Gifts, donations, and bequests;

89163 5. Monies appropriated or apportioned by the state; and

95167 B. All monies accruing to the credit of the Oklahoma Homeland
96168 Security Revolving Fund are hereby appropriated and may be budgeted
97169 and expended by the Oklahoma Office of Homeland Security for:

103199 3. Education and reimbursement for expenses of regional teams,
104200 including maintenance of equipment; and

106201 4. Reimbursement, as provided in S ection 1 of this act, of
107202 funeral expenses for any member of the state military forces who
108203 died in the line of duty while serving on state active duty, as
109204 defined in Section 801 of Title 44 of the Ok lahoma Statutes.

111205 C. Expenditures from the Oklahoma Homela nd Security Revolving
112206 Fund shall be made upon warrants issued by the State Treasurer
113207 against claims filed as prescribed by law with the Director of the
114208 Office of Management and Enterprise Services f or approval and
115209 payment.
