4040 An Act relating to license plates; amending 47 O.S.
4141 2011, Section 1135.2, as last amended by Section 1,
4242 Chapter 434, O.S.L. 2019 (47 O.S. Supp. 2020, Section
4343 1135.2), which relates to specialty license plates;
4444 expanding list of family members who may apply for
4545 certain specialty plate; and providing an effective
4646 date.

5252 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5353 SECTION 1. AMENDATORY 47 O.S. 2011, Section 1135.2, as
5454 last amended by Section 1, Chapter 434, O.S.L. 2019 (47 O.S. Supp.
5555 2020, Section 1135.2), is amended to read as follows:
5656 Section 1135.2 A. The Oklahoma Tax Commission is hereby
5757 authorized to design and issue appropriate official special license
5858 plates to persons in recognition of their service or awards as
5959 provided by this section.
6060 Special license plates shall not be transferred to any other
6161 person but shall be removed from the vehicl e upon transfer of
6262 ownership and retained. The special license plate may then be used

9090 registered for the current year.
9191 Special license plates shall be renewed each year by the Tax
9292 Commission or a motor license agent. The Tax Commission shall
9393 annually notify by mail all persons issued special license plates.
9494 The notice shall contain all necessary information and shall contain
9595 instructions for the renewal procedure upon presentation to a motor
9696 license agent or the Tax Commission. The license plates shall be
9797 issued on a staggered system except for legislative plates and
9898 amateur radio operator license plates.
9999 The Tax Commission is hereby directed to develop and implement a
100100 system whereby motor lic ense agents are permitted to accept
101101 applications for special license plates authorized under this
102102 section. The motor license agent shall confirm the applicant 's
103103 eligibility, if applicable, collect and deposit any amount
104104 specifically authorized by law, acc ept and process the necessary
105105 information directly into such system and generate a receipt
106106 accordingly. For performance of these duties, motor license agents
107107 shall retain the fee provided in Section 1141.1 of this title for
108108 registration of a motor vehicle . The motor license agent fees for
109109 acceptance of applications and renewals shall be paid out of the
110110 Oklahoma Tax Commission Reimbursement Fund.
111111 B. The special license plates provided by this section are as

139139 1. Prisoner of War License Plates - such plates shall be
140140 designed for honorably discharged or present members of the United
141141 States Armed Forces and civilians who were former prisoners of war
142142 held by a foreign country and who can provide proper certification
143143 of that status. Such persons may ap ply for a prisoner of war
144144 license plate for no more than two vehicles with each vehicle having
145145 a rated carrying capacity of one (1) ton or less. The surviving
146146 spouse of any deceased former prisoner of war, if the spouse has not
147147 since remarried, or if rema rried, the remarriage is terminated by
148148 death, divorce, or annulment, may apply for a prisoner of war
149149 license plate for one vehicle with a rated carrying capacity of one
150150 (1) ton or less. The fee provided by this section for the special
151151 license plate author ized by this paragraph shall be in addition to
152152 all other registration fees provided by law, except the registration
153153 fees levied by Section 1132 of this title;
154154 2. National Guard License Plates - such plates shall be
155155 designed for active or retired members o f the Oklahoma National
156156 Guard. Retirees who are eligible for such plates shall provide
157157 proof of eligibility upon initial application, but shall not be
158158 required to provide proof of eligibility annually;
159159 3. Air National Guard License Plates - such plates shall be
160160 designed for active or retired members of the Oklahoma Air National
161161 Guard. Retirees who are eligible for such plates shall provide

189189 required to provide proof of eligibility annually;
190190 4. United States Armed Forces License Plates - such plates
191191 shall be designed for active, retired, former or reserve members of
192192 the United States Armed Forces, and shall identify which branch of
193193 service, and carry the emblem and name of either the Army, Nav y, Air
194194 Force, Marines or Coast Guard, according to the branch of service to
195195 which the member belongs or did belong. Former members who have
196196 been dishonorably discharged shall not be eligible for such plates.
197197 Persons applying for such license plate must s how proof of present
198198 or past military service by presenting a valid Uniformed Services
199199 Identity Card or the United States Department of Defense Form
200200 (DD)214. Retired or former members who are eligible for such plates
201201 shall provide proof of eligibility upo n initial application, but
202202 shall not be required to provide proof of eligibility annually;
203203 5. Congressional Medal of Honor Recipient License Plates - such
204204 plates shall be designed for any resident of this state who has been
205205 awarded the Congressional Medal of Honor. Such persons may apply
206206 for a Congressional Medal of Honor recipient license plate for each
207207 vehicle with a rated carrying capacity of one (1) ton or less.
208208 There shall be no registration fee for the issuance of this plate;
209209 6. Missing In Action License Plates - such plates shall be
210210 designed to honor members of the United States Armed Forces who are
211211 missing in action. The spouse of such missing person, if the spouse

245245 action license plate for each vehicle with a rated carrying capacity
246246 of one (1) ton or less;
247247 7. Purple Heart Recipient License P lates - such plates shall be
248248 designed for any resident of this state presenting proper
249249 certification from the United States Department of Veterans Affairs
250250 or the Armed Forces of the United States certifying that such
251251 resident has been awarded the Purple He art military decoration.
252252 Such persons may apply for a Purple Heart recipient license plate
253253 for vehicles having a rated carrying capacity of one (1) ton or
254254 less. The surviving spouse of any deceased veteran who has been
255255 awarded the Purple Heart military d ecoration, if such spouse has not
256256 since remarried, or if remarried, the remarriage has been terminated
257257 by death, divorce or annulment, may apply for such plate for one
258258 vehicle with a rated carrying capacity of one (1) ton or less. The
259259 license plate create d by this paragraph shall be exempt from the fee
260260 provided by this section for special license plates;

287287 8. Pearl Harbor Survivor License Plates - such plates shall be
288288 designed for any resident of this state who can be verified by the
289289 United States Departmen t of Veterans Affairs or the Armed Forces of
290290 the United States as being:
291291 a. a member of the United States Armed Forces on December
292292 7, 1941,
293293 b. stationed on December 7, 1941, during the hours of
294294 7:55 a.m. to 9:45 a.m. Hawaii time at Pearl Harbor,
295295 the island of Oahu, or offshore at a distance not to
296296 exceed three (3) miles, and
297297 c. a recipient of an honorable discharge from the United
298298 States Armed Forces.
299299 Such person may apply for a Pearl Harbor Survivor license plate
300300 for each vehicle with a rated carrying capa city of one (1) ton or
301301 less;
302302 9. Iwo Jima License Plates - such plates shall be designed for
303303 any resident of this state who can be verified by the United States
304304 Department of Veterans Affairs or the Armed Forces of the United
305305 States as being:
306306 a. a member of the United States Armed Forces in February
307307 of 1945,
308308 b. stationed in February of 1945 on or in the immediate
309309 vicinity of the island of Iwo Jima, and

338338 Such person may apply for an Iwo Jima license plate for each
339339 vehicle with a rated carrying capacity of one (1) ton or less.
340340 Such license plate shall have the legend "Oklahoma OK" and shall
341341 contain three letters and three numbers. Between the letters and
342342 numbers shall be a logo of th e flag-raising at Iwo Jima. Below the
343343 letters, logo and numbers, the plate shall contain the words "FEB."
344344 at the left, "Iwo Jima" in the center and "1945" at the right. Such
345345 plates shall not be subject to the design requirements of any other
346346 license plates prescribed by law other than the space for the
347347 placement of the yearly decals for each succeeding year of
348348 registration after the initial issue;
349349 10. D-Day Survivor License Plates - such plates shall be
350350 designed for any resident of this state who can be verified by the
351351 United States Department of Veterans Affairs or the Armed Forces of
352352 the United States as being:
353353 a. a member of the United States Armed Forces on June 6,
354354 1944,
355355 b. a participant in the Allied invasion of the coast of
356356 Normandy on June 6, 1944; provided, if such
357357 participation cannot be verified by the United States
358358 Department of Veterans Affairs or the Armed Forces of
359359 the United States, the Tax Commission may, in its

388388 c. a recipient of an honorable discharge from the United
389389 States Armed Forces.
390390 Such person may apply for a D -Day Survivor license plate for
391391 each vehicle with a rated carrying capacity of one (1) ton or less;
392392 11. Killed in Action Lice nse Plates - such plates shall be
393393 designed to honor members of the United States Armed Forces who were
394394 killed in action. The spouse of the deceased person, if the spouse
395395 has not remarried, or if remarried, the remarriage is terminated by
396396 death, divorce, or annulment, may apply for a killed in action
397397 license plate upon presenting proper certification that the person
398398 was killed in action and that the person making the application is
399399 the qualifying spouse of the deceased person. The qualifying spouse
400400 may apply for a killed in action license plate for no more than two
401401 vehicles with each vehicle with a rated carrying capacity of one (1)
402402 ton or less. The fee provided by this section for the special
403403 license plate authorized by this paragraph shall be in addition to
404404 all other registration fees provided by law, except the registration
405405 fees levied by Section 1132 of this title;
406406 12. Gold Star Parents Families License Plates - such plates
407407 shall be designed to honor members of the United States Armed Forces
408408 who were killed during a war while on active duty . The parents,
409409 siblings, half-siblings or grandparents of the deceased person may

437437 certification that the person was killed during a war and that the
438438 person making the application is the parent , sibling, half-sibling
439439 or grandparent of the deceased person. The parent family member may
440440 apply for a gold star parent families license plate for no more than
441441 two vehicles with each vehicle having a rated carrying capa city of
442442 one (1) ton or less. The fee provided by this section for the
443443 special license plate authorized by this paragraph shall be in
444444 addition to all other registration fees provided by law, except the
445445 registration fees levied by Section 1132 of this title ;
446446 13. Military Decoration License Plates - such plates shall be
447447 designed for any resident of this state who has been awarded the
448448 Distinguished Service Medal, the Distinguished Service Cross, the
449449 Distinguished Flying Cross, the Bronze Star military decorat ion or
450450 the Silver Star military decoration. Such persons may apply for a
451451 military decoration license plate for each vehicle with a rated
452452 carrying capacity of one (1) ton or less;
453453 14. Vietnam Veteran License Plates - such plates shall be
454454 designed for honorably discharged or present members of the United
455455 States Armed Forces who served in the Vietnam Conflict. Such
456456 persons may apply for a Vietnam veteran license plate for each
457457 vehicle with a rated carrying capacity of one (1) ton or less;
458458 15. Police Officer License Plates - such plates shall be
459459 designed for any currently employed, reserve or retired municipal

487487 officer certified by the Council on Law Enforcement Education and
488488 Training or common education police officer certified by the Council
489489 on Law Enforcement Education and Training. Police officers may
490490 apply for police officer license plates for vehicles with a rated
491491 capacity of one (1) ton or less or for a motorcycle upon proof of
492492 employment by or retirement from a municipal, university or common
493493 education police department by either an identification card or
494494 letter from the chief of the police department or the Oklahoma
495495 Police Pension and Retirement Board. Retirees who are eligible for
496496 such plates shall provide proof of eligibility upon initial
497497 application, but shall not be required to provide proof of
498498 eligibility annually. The license plates shall be designed in
499499 consultation with municipal police departments of this state;
500500 provided, the license plate for motorcycles may be of similar design
501501 to the license plate for motor vehicles or may be a new design in
502502 order to meet space requirements for a motorcycle license plate;
503503 16. World War II Veteran License Plates - such plates shall be
504504 designed to honor honorably discharged former members of the United
505505 States Armed Forces who are residents of this state and who can be
506506 verified by the Oklahoma Military Department, the Department of
507507 Veterans Affairs or the Armed Forces of the United States as hav ing
508508 served on federal active duty anytime during the period from
509509 September 16, 1940, to December 7, 1945. The former members may

538538 The license plate shall have the legend "Oklahoma" and shall
539539 contain, in the center of the plate, either the Thunderbird Insignia
540540 of the 45th Infantry Division in the prescribed red and gold
541541 coloring or the emblem of the Army, Navy, U.S. Army Air Corps,
542542 Marines or Coast Guard according to the branch of service to which
543543 the member belonged. For the purpose of license plate
544544 identification, the plate shall contain four digits, two digits at
545545 the left and two digits at the right of the insignia or emblem.
546546 Centered on the bottom of the license plate shall be the words
547547 "WORLD WAR II";
548548 17. Korean War Veteran License Plates - such plates shall be
549549 designed to honor honorably discharged former members of the United
550550 States Armed Forces who are residents of this state and who ca n be
551551 verified by the Oklahoma Military Department, the Department of
552552 Veterans Affairs or the Armed Forces of the United States as having
553553 served on federal active duty anytime during the period from June
554554 27, 1950, to January 31, 1955, both dates inclusive. The former
555555 members may apply for a Korean War Veteran license plate for
556556 vehicles with a rated carrying capacity of one (1) ton or less.
557557 The license plate shall have the legend "OKLAHOMA" and shall
558558 contain, in the center of the plate, either the Thunderbir d Insignia

592592 18. Municipal Official License Plates - such plates shall be
593593 designed for persons elected to a municipal office in this state and
594594 shall designate the name of the municipality and the district or
595595 ward in which the municipal official serves. The plates shall only
596596 be produced upon application;
597597 19. Red Cross Volunteer License Plates - such plates shall be
598598 designed to honor American Red Cross volunteers and staff who are
599599 residents of this state. Such persons must present an
600600 identification card issued by the American Red Cross and bearing a
601601 photograph of the person. Th e license plate shall be designed with
602602 the assistance of the American Red Cross and shall have the legend
603603 "Oklahoma OK!" in the color Pantone 186C Red. Below the legend the
604604 symbol of the American Red Cross and no more than three letters and
605605 three numbers shall be in the color Pantone 186C Red. Below the
606606 symbol and letters and numbers shall be the words "American Red
607607 Cross" in black. The plates shall not be subject to the design
608608 requirements of any other license plates prescribed by law other

637637 20. Desert Storm License Plates - such plates shall be designed
638638 and issued to any honorably discharged or present member of the
639639 United States Armed Forces who served in the Persian Gulf Crisis and
640640 the Desert Storm operation. Such persons may apply for a Desert
641641 Storm license plate for each vehicle with a rated carrying capacity
642642 of one (1) ton or less;
643643 21. Military Reserve Unit License Plates - such plates shall be
644644 designed and issued to any honorably discharged or present member of
645645 a reserve unit of the United States Armed Forces. Such persons may
646646 apply for a Military Reserve Unit license plate for each vehicle
647647 with a rated carrying capacity of one (1) ton or less;
648648 22. Oklahoma City Bombing Victims and Survivors License Plates
649649 - such plates shall be designed and issued to any victim or survivor
650650 of the bombing attack on the Alfred P. Murrah Federal Building in
651651 downtown Oklahoma City on April 19, 1995 ;
652652 23. Civil Air Patrol License Plates - such plates shall be
653653 designed and issued to any person who is a member of the Civil Air
654654 Patrol. Such persons may apply for a Civil Air Patrol license plate
655655 for each vehicle with a rated carrying capacity of one (1) ton or
656656 less upon proof of membership in the Civil Air Patrol. The license
657657 plate shall be designed in consultation with the Civil Air Patrol;

684684 24. Ninety-Nines License Plates - such plates shall be designed
685685 and issued to members of the Ninety -Nines. Persons applying for
686686 such license plate must show proof of membership in the Ninety -
687687 Nines. The license plates shall be designed in consultation with
688688 the Ninety-Nines;
689689 25. Combat Infantryman Badge License Plates – such plates shall
690690 be designed to honor recipi ents of the Combat Infantryman Badge.
691691 The plate shall have the legend "Oklahoma OK". Below the legend
692692 shall be the Combat Infantryman Badge and three numbers. Below the
693693 badge and the numbers shall be the words "Combat Infantryman Badge ".
694694 Such persons may apply for a Combat Infantryman Badge license plate
695695 for each vehicle with a rated carrying capacity of one (1) ton or
696696 less;
697697 26. Somalia Combat Veterans License Plates – such plates shall
698698 be designed and issued to any honorably discharged or present memb er
699699 of the United States Armed Forces who saw combat in the United
700700 Nations relief effort. Such persons may apply for a Somalia Combat
701701 Veteran license plate for each vehicle with a rated carrying
702702 capacity of one (1) ton or less;
703703 27. Police Chaplain License Plates – such plates shall be
704704 designed and issued to members of the International Conference of
705705 Police Chaplains (ICPC) who have completed the ICPC requirements for
706706 basic certification as a police chaplain. The license plates shall
707707 be designed in consult ation with the ICPC;

734734 28. Joint Service Commendation Medal License Plates – such
735735 plates shall be designed and issued to any resident of this state
736736 who has been awarded the Joint Service Commendation Medal by the
737737 United States Secretary of Defense;
738738 29. Merchant Marine License Plates - such plates shall be
739739 designed, subject to criteria to be presented to the Tax Commission
740740 by the Oklahoma Department of Veterans Affairs, and issued to any
741741 person who during combat was a member of the Merchant Marines as
742742 certified by the Oklahoma Department of Veterans Affairs. Such
743743 license plate may be issued for each vehicle with a rated carrying
744744 capacity of one (1) ton or less;
745745 30. Legislative License Plates - such plates shall be designed
746746 for persons elected to the Oklahom a Legislature and shall designate
747747 the house of the Legislature in which the legislator serves and the
748748 district number;
749749 31. Disabled Veterans License Plates - such plates shall be
750750 designed for persons presenting proper certification from the United
751751 States Department of Veterans Affairs or the Armed Forces of the
752752 United States certifying such veteran has a service -connected
753753 disability rating of fifty percent (50%) or more, regardless which
754754 agency pays the disability benefits, or that such veteran has been
755755 awarded a vehicle by the United States government or receives a
756756 grant from the United States Department of Veterans Affairs for the
757757 purchase of an automobile due to a service -connected disability

795795 fee provided by this section for the special license plate
796796 authorized by this paragraph shall be in addi tion to all other
797797 registration fees provided by law, except the registration fees
798798 levied by Section 1132 of this title. The total expense of this
799799 license plate shall not exceed Five Dollars ($5.00).
800800 If the person qualifies for a disabled veterans license plate
801801 and is also eligible for a physically disabled placard under the
802802 provisions of Section 15 -112 of this title, the person shall be
803803 eligible to receive a disabled veterans license plate that also
804804 displays the international accessibility symbol, which is a stylized

836836 plates shall be designed for members of the United States Air Force

840840 33. Oklahoma Military Academy Alumni License Plates - such
841841 plates shall be designed and issued to any resident of this state
842842 who is an alumnus of the Oklahoma Military Academy. Such persons
843843 may apply for an Oklahoma Military Academy Alumn us license plate for
844844 each vehicle with a rated carrying capacity of one (1) ton or less.
845845 The license plates shall be designed in consultation with the
846846 Oklahoma Military Academy and shall contain the shield of the
847847 Academy;
848848 34. Amateur Radio Operator Licen se Plates – such plates shall
849849 be designed and issued to any person, holding a valid operator 's
850850 license, technician class or better, issued by the Federal
851851 Communications Commission, and who is also the owner of a motor
852852 vehicle currently registered in Oklaho ma, in which has been
853853 installed amateur mobile transmitting and receiving equipment.
854854 Eligible persons shall be entitled to two special vehicle
855855 identification plates as herein provided. Application for such
856856 identification plates shall be on a form prescri bed by the Tax

884884 stamped thereon the word "Oklahoma" and bear the official call
885885 letters of the radio station assigned by the Federal Communications
886886 Commission to the individual amateur operator th ereof. All
887887 applications for such plates must be made to the Tax Commission on
888888 or before the first day of October of any year for such plates for
889889 the following calendar year and must be accompanied by the fee
890890 required in this section together with a certif icate, or such other
891891 evidence as the Tax Commission may require, of proof that applicant
892892 has a valid technician class or better amateur operator 's license
893893 and proof of applicant 's ownership of a vehicle in which radio
894894 receiving and transmitting equipment i s installed. Applicants shall
895895 only be entitled to one set of special identification plates in any
896896 one (1) year, and such calendar year shall be stamped thereon. The
897897 right to such special identification plates herein provided for
898898 shall continue until the amateur radio operator 's license of the
899899 person to whom such plates are issued expires or is revoked;
900900 35. American Legion License Plates - such plates shall be
901901 designed for members of the American Legion. Persons applying for
902902 such license plate must show proof of membership. The license
903903 plates shall be designed in consultation with the American Legion of
904904 Oklahoma;
905905 36. Deputy Sheriff License Plates - such plates shall be
906906 designed for any currently employed or retired county sheriff or

934934 such plates for vehicles with a rated capacity of one (1) ton or
935935 less upon proof of employment by or retirement from a county
936936 sheriff's office by either an identification card or letter from the
937937 county sheriff or a government-sponsored retirement board from which
938938 the county sheriff or deputy sheriff may be receiving a pension.
939939 Retirees who are eligible for such plates shall provide proof of
940940 eligibility upon initial application, but shall not be required to
941941 provide proof of eligibility annually. The license plates shall be
942942 designed in consultation with the county sheriff offices of this
943943 state;
944944 37. Gold Star Surviving Spouse License Plates – such plates
945945 shall be designed to honor the surviving spouses and childr en of
946946 qualified veterans. As used in this paragraph, "qualified veteran"
947947 shall mean:
948948 a. any person honorably discharged from any branch of the
949949 United States Armed Forces or as a member of the
950950 Oklahoma National Guard, who died as a direct result
951951 of the performance of duties for any branch of the
952952 United States Armed Forces or Oklahoma National Guard
953953 while on active military duty, or
954954 b. any person honorably discharged from any branch of the
955955 United States Armed Forces or as a member of the
956956 Oklahoma National Gu ard, who died as a result of

995995 Service Medal license plate for each vehicle with a rated carry ing
996996 capacity of one (1) ton or less;
997997 39. 180th Infantry License Plates – such plates shall be
998998 designed for members and prior members of the 180th Infantry.
999999 Persons applying for such license plate must obtain and provide
10001000 proof of their membership from the 180th Infantry Association. The
10011001 license plates shall be designed in consultation with the 180th
10021002 Infantry;
10031003 40. Operation Iraqi Freedom Veteran License Plates – such
10041004 plates shall be designed and issued to any honorably discharged or
10051005 present member of the United States Armed Forces who served in

10951095 shall be designed in consultation with the United States Institute
10961096 of Heraldry and the Military Department of the State of Oklahoma.
10971097 Such person may apply for a Global War on Terror Expeditionary
10981098 license plate for each vehicle with a rated carrying capacity of one
10991099 (1) ton or less;
11001100 45. Legion of Merit Medal Recipient License Plates - such
11011101 plates shall be designed for any resident of this state presenting

12881288 qualified person in any combination of numbers and letters from one
12891289 to a maximum of seven, as for personalized license plates.
12901290 C. Unless otherwise provided by this section, the f ee for such
12911291 plates shall be Eight Dollars ($8.00) and shall be in addition to
12921292 all other registration fees provided by the Oklahoma Vehicle License
12931293 and Registration Act. Such fees shall be deposited in the Oklahoma
12941294 Tax Commission Reimbursement Fund to be u sed for the administration
12951295 of the Oklahoma Vehicle License and Registration Act.
