101101 SECTION 1. AMENDATORY 62 O.S. 2011, Section 3103, as
102102 last amended by Section 1, Chapter 121, O.S.L. 2020 (62 O.S. Supp.
103103 2020, Section 3103), is amended t o read as follows:
104104 Section 3103. As used in the Oklahoma Pension Legislation
105105 Actuarial Analysis Act:
106106 1. "Amendment" means any amendment, including a substitute
107107 bill, made to a retirement bill by any committee of the House or
108108 Senate, any conference commit tee of the House or Senate or by the
109109 House or Senate;
110110 2. "RB number" means that number preceded by the letters "RB"
111111 assigned to a retirement bill by the respective staffs of the
112112 Oklahoma State Senate and the Oklahoma House of Representatives when
113113 the respective staff office prepares a retirement bill for a member
114114 of the Legislature;
115115 3. "Legislative Actuary" means the firm or entity that enters
116116 into a contract with the Legislative Service Bureau pursuant to
117117 Section 452.15 of Title 74 of the Oklahoma Statut es to provide the
118118 actuarial services and other duties provided for in the Oklahoma
119119 Pension Legislation Actuarial Analysis Act;
120120 4. "Nonfiscal amendment" means an amendment to a retirement
121121 bill having a fiscal impact, which amendment does not change any
122122 factor of an actuarial investigation specified in subsection A of
123123 Section 3109 of this title;
124124 5. "Nonfiscal retirement bill " means a retirement bill: RBH No. 6236

151151 a. which does not affect the cost or funding factors of a
152152 retirement system,
153153 b. which affects such factors o nly in a manner which does
154154 not:
155155 (1) grant a benefit increase under the retirement
156156 system affected by the bill,
157157 (2) create an actuarial accrued liability for or
158158 increase the actuarial accrued liability of the
159159 retirement system affected by the bill, or
160160 (3) increase the normal cost of the retirement system
161161 affected by the bill,
162162 c. which authorizes the purchase by an active member of
163163 the retirement system, at the actuarial cost for the
164164 purchase as computed pursuant to the statute in effect
165165 on the effective dat e of the measure allowing such
166166 purchase, of years of service for purposes of reaching
167167 a normal retirement date in the applicable retirement
168168 system, but which cannot be used in order to compute
169169 the number of years of service for purposes of
170170 computing the retirement benefit for the member,
171171 d. which provides for the computation of a service -
172172 connected disability retirement benefit for members of
173173 the Oklahoma Law Enforcement Retirement System

201201 Statutes if the members were unable to complete twenty
202202 (20) years of service as a result of the disability,
203203 e. which requires membership in the defined benefit plan
204204 authorized by Section 901 et seq. of Title 74 of the
205205 Oklahoma Statutes for persons whose first elected or
206206 appointed service occurs on or after November 1, 2018,
207207 if such persons had any prior service in the Oklahoma
208208 Public Employees Retirement System prior to November
209209 1, 2015,
210210 f. which provides for a one -time increase in retirement
211211 benefits if the increase in retirement benefits is not
212212 a permanent increase in the gross annual retirement
213213 benefit payable to a member or beneficiary, occurs
214214 only once pursuant to a single statutory authorization
215215 and does not exceed:
216216 (1) the lesser of two percent (2%) of the gross
217217 annual retirement benefit of the member or One
218218 Thousand Dollars ($1,000.00) and requires that
219219 the benefit may only be provided if the funded
220220 ratio of the affected retirement system would not
221221 be less than sixty percent (60%) but not greater
222222 than eighty percent (80%) after the benefit

252252 Thousand Two Hundred Dollars ($1,200.00) and
253253 requires that the benefit may only be provided if

265265 (4) the greater of two per cent (2%) of the gross
266266 annual retirement benefit of the volunteer
267267 firefighter or One Hundred Dollars ($100.00) for
268268 persons who retired from the Oklahoma
269269 Firefighters Pension and Retirement System as
270270 volunteer firefighters and who did not retire
271271 from the Oklahoma Firefighters Pension and

299299 As used in this subparagraph, "funded ratio" means the
300300 figure derived by dividing the actuarial value of
301301 assets of the applicable retirement system by the
302302 actuarial accrued liability of the applicable
303303 retirement system, or
304304 g. which provides a cost -of-living benefit increase
305305 pursuant to the provisions of Sections 2 through 7 of
306306 this act, or
307307 h. which modifies the postretirement earnings limit
308308 provisions in Section 17 -116.10 of Title 70 o f the
309309 Oklahoma Statutes as provided by Section 2 of this act
310310 and which modifies the postretirement provisions of
311311 the minimum salary schedule as provided by subsection
312312 F of Section 18-114.14 of Title 70 of the Oklahoma
313313 Statutes in the manner prescribed by S ection 4 of this
314314 act.
315315 A nonfiscal retirement bill shall include any retirement bill that
316316 has as its sole purpose the appropriation or distribution or
317317 redistribution of monies in some manner to a retirement system for
318318 purposes of reducing the unfunded liabi lity of such system or the
319319 earmarking of a portion of the revenue from a tax to a retirement
320320 system or increasing the percentage of the revenue earmarked from a
321321 tax to a retirement system; RBH No. 6236

348348 6. "Reduction-in-cost amendment" means an amendment to a
349349 retirement bill having a fiscal impact which reduces the cost of the
350350 bill as such cost is determined by the actuarial investigation for
351351 the bill prepared pursuant to Section 3109 of this title;
352352 7. "Retirement bill" means any bill or joint resolution
353353 introduced or any bill or joint resolution amended by a member of
354354 the Oklahoma Legislature which creates or amends any law directly
355355 affecting a retirement system. A retirement bill shall not mean a
356356 bill or resolution that impacts the revenue of any state tax in
357357 which a portion of the revenue generated from such tax is earmarked
358358 for the benefit of a retirement system;
359359 8. "Retirement bill having a fiscal impact " means any
360360 retirement bill creating or establishing a retirement system and any
361361 other retirement bill other tha n a nonfiscal retirement bill; and
362362 9. "Retirement system" means the Teachers' Retirement System of
363363 Oklahoma, the Oklahoma Public Employees Retirement System, the
364364 Uniform Retirement System for Justices and Judges, the Oklahoma
365365 Firefighters Pension and Reti rement System, the Oklahoma Police
366366 Pension and Retirement System, the Oklahoma Law Enforcement
367367 Retirement System, or a retirement system established after January
368368 1, 2006.
369369 SECTION 2. AMENDATORY 70 O.S. 2011, Section 17 -116.10,
370370 as last amended by Section 2, Chapter 270, O.S.L. 2017 (70 O.S.

398398 Section 17-116.10 A. Subject to the requirements of Section 6 -
399399 101.2 of this title and any other applicable requirements of law, a
400400 member may enter into postretirement employment with a public school
401401 of Oklahoma and still receive monthly retirement benefits subject to
402402 the following limitations:
403403 1. A retired member is not eligible to be employed by the
404404 public schools of Oklahoma, in a ny capacity, for sixty (60) calendar
405405 days between the retiree's last day of preretirement public
406406 education employment and any postretirement public education
407407 employment. For purposes of this section, the term "last day of
408408 preretirement employment" shall m ean the last day the employee is
409409 required to be physically present on the job to complete the terms
410410 of the employment contract or agreement. An employee on paid leave
411411 is still considered to be employed for purposes of this section.
412412 Employment under any c onditions during this time, volunteer services
413413 for the purpose of obtaining a paid position at a later date, or
414414 payment at a later time for services performed during this time
415415 period shall cause the forfeiture of all retirement benefits
416416 received during the period;
417417 2. Unless otherwise provided in paragraph 3 of this subsection,
418418 earnings from the public schools may not exceed one -half (1/2) of
419419 the member's final average salary used in computing retirement
420420 benefits, or the Earnings Limitation for employees al lowed by the
421421 Social Security Administration, whichever is less. For retired RBH No. 6236

448448 members under the age of sixty -two (62) years, the limit on allowed
449449 earnings from the public schools of Oklahoma for employment for the
450450 performance of duties ordinarily performed by classified or
451451 nonclassified personnel shall be the lesser of Fifteen Thousand
452452 Dollars ($15,000.00) or one -half (1/2) of the member's final average
453453 salary used in computing retirement benefits unless the earnings
454454 limitation allowed by the Social Security Administration would be
455455 greater than Fifteen Thousand Dollars ($15,000.00). For retired
456456 members sixty-two (62) years of age or older the limit on allowed
457457 earnings from the public schools of Oklahoma for the performance of
458458 duties ordinarily performed by c lassified or nonclassified personnel
459459 shall be the lesser of Thirty Thousand Dollars ($30,000.00) or one -
460460 half (1/2) of the member's final average salary used in computing
461461 retirement benefits. For purposes of this paragraph, the following
462462 shall apply:
463463 a. earnings shall mean "regular annual compensation" as
464464 defined in paragraph (25) of Section 17 -101 of this
465465 title, and shall include any payment by a public
466466 school for services rendered by a retired member who
467467 is employed for any purpose whatsoever. Supplement al
468468 retirement payments paid by a former public school
469469 employer pursuant to subsection 9 of Section 17 -105 of
470470 this title or other state law shall not be considered

498498 b. the Earnings Limitation for employees allowed by the
499499 Social Security Administ ration to workers between the
500500 age of sixty-two (62) years and sixty -five (65) years
501501 shall apply to retired members below the age of sixty -
502502 two (62) years,
503503 c. the limit on allowed earnings from the public schools
504504 shall be automatically adjusted effective the first
505505 day of January of each year to reflect the current
506506 Earnings Limitation for employees as determined from
507507 time to time by the Social Security Administration,
508508 d. the earnings limit for the calendar year in which a
509509 member retires shall be one -twelfth (1/12) of the
510510 annual limit multiplied by the number of months the
511511 member is eligible to work and receive payments from
512512 the public schools of Oklahoma,
513513 e. earnings in excess of the maximum limit on allowed
514514 earnings from public schools of Oklahoma shall result
515515 in a loss of future retirement benefits for the year
516516 the postretirement employment was performed of One
517517 Dollar ($1.00) for each One Dollar ($1.00) earned over
518518 the maximum allowed earnings amount,
519519 f. for those members age seventy (70) years and over, the
520520 earnings in excess of the maximum limit allowed
521521 earnings from public schools of Oklahoma shall be one - RBH No. 6236

548548 half (1/2) the member's final average salary used in
549549 computing retirement benefits. However, any retired
550550 member receiving benefits from the Retirement Sys tem
551551 who reached age seventy (70) years prior to July 1,
552552 1991, shall not be restricted by the earnings limits
553553 pursuant to this subparagraph until January 1, 1994.
554554 To qualify for the provisions of this subparagraph,
555555 the member must be employed less than one -half (1/2)
556556 time compared to other full -time employees in similar
557557 positions;
558558 3. Notwithstanding paragraph 2 of this subsection, a retired
559559 classified or nonclassified member who has been retired for thirty -
560560 six (36) or more months and who is employed by a p ublic school to
561561 perform duties ordinarily performed by classified or nonclassified
562562 personnel shall be able to receive annualized earnings from the
563563 public school with no reduction in retirement benefits regardless of
564564 the amount of annualized earnings. For a period of three (3) years
565565 beginning July 1, 2017, members who have retired as of July 1, 2017,
566566 as active classroom teachers, who have been retired and receiving a
567567 benefit for at least one (1) year, and who have not been employed by
568568 any public school duri ng that one-year period, shall be eligible to
569569 be reemployed as an active classroom teacher in common or career
570570 tech school districts, with no limitations on earnings. The one -
571571 year period starts with the retiree's last day of preretirement RBH No. 6236

598598 public education employment. Members returning under this section
599599 shall not be subject to any earning limitations following the end of
600600 the three-year period described in this paragraph. Members
601601 returning under this section shall only be employed pursuant to a
602602 temporary contract; and
603603 4. A member shall be considered to be employed by a school
604604 district to perform the duties ordinarily performed by classified or
605605 nonclassified personnel if the member is hired by the school
606606 district in the member's individual capacity to perf orm the duties
607607 or if the member performs the duties through employment with a
608608 proprietorship, partnership, corporation, limited liability company
609609 or partnership, or any other business structure that has agreed or
610610 contracted to provide the services to the s chool district;
611611 3. For the first year a retired member is employed full -time by
612612 a public school district, the maximum compensation amount shall be
613613 Thirty-six Thousand Six Hundred One Dollars ($36,601.00). For all
614614 years of service after the first twelve ( 12) months after a member
615615 retires from the System, there shall be no minimum salary
616616 requirement and the provisions of Section 18 -114.14 of this title
617617 shall not be applicable to compensation paid by a public school
618618 district to a retired member of the Syste m for full-time employment;
619619 and
620620 4. For the second and subsequent years that a retired member is

648648 compensation amount shall be Fifty Thousand Dollars ($50,000.00) and
649649 the provisions of Section 18 -114.14 of this title shall not be
650650 applicable to compensation paid by a public school district for
651651 full-time employment to a retired member of the System .
652652 B. A public school district that employs a retired member shall
653653 be required to make contributions to t he System for the retired
654654 member in an amount as required in Section 17 -108.1 and in paragraph
655655 3 of subsection B of Section 17 -116.2 of this title. A retired
656656 member employed pursuant to the provisions of this section shall not
657657 accrue any additional servic e credit in the Teachers ' Retirement
658658 System of Oklahoma resulting from performance of postretirement
659659 employment with a school district. The provisions of this
660660 subsection for payment of employer contribution amounts and the
661661 provisions prohibiting accrual o f additional service credit shall be
662662 applicable regardless of whether the member is receiving his or her
663663 retirement benefit or not and shall not depend upon any election the
664664 member might exercise to suspend or delay receipt of the retirement
665665 benefit amount.
666666 C. For purposes of this section, postretirement employment of
667667 less than one thousand (1,000) hours per year with the Governor, the
668668 State Senate, the House of Representatives or the Legislative
669669 Service Bureau shall not be considered as postretirement emp loyment
670670 with a public school of Oklahoma. RBH No. 6236

697697 D. The Board of Trustees of the Teachers' Retirement System of
698698 Oklahoma shall promulgate such rules as are necessary to implement
699699 the provisions of this section.
700700 E. A member who has entered into postretirement em ployment with
701701 a participating employer of the Teachers' Retirement System of
702702 Oklahoma must fully comply with all the provisions of the rules
703703 promulgated by the Board of Trustees pursuant to this section in
704704 order to continue receiving his or her monthly ret irement benefit.
705705 SECTION 3. NEW LAW A new section of law to be codified in the
706706 Oklahoma Statutes as Section 6 -101.6c of Title 70, unless there is
707707 created a duplication in numbering, reads as follows:
708708 A school district that employs a ret ired member of the Teachers '
709709 Retirement System of Oklahoma shall not be subject to any provisions
710710 of law related to pretermination procedures and the school district
711711 shall not have any legal obligation to enter into a postretirement
712712 employment contract. A ll such postretirement employment contracts
713713 shall be for a period of no longer than twelve (12) months as agreed
714714 to by the school district and the retired member. No school
715715 district shall be obligated to rehire a retired member with whom the
716716 district has previously entered into a postretirement employment
717717 contract.

898898 2. If a school district intends to provide retirement benefits
899899 to a teacher such that the teacher's salary would be less than the
900900 amounts set forth in the minimum salary schedule specified in
901901 subsection A of this section, the district shall be required to
902902 provide written notification to the teacher prior to his or her
903903 employment or, if already employed by the district, no later than
904904 thirty (30) days prior to the date the district elects to provide
905905 retirement benefits such that the teacher's salary would be less
906906 than the minimum salary schedule.
907907 C. Any of the degrees referred to in this section shall be from
908908 a college recognized by the State Board of E ducation. The Board
909909 shall accept teaching experience from out -of-state school districts
910910 that are accredited by the state board of education or appropriate
911911 state accrediting agency for the districts. The Board shall accept
912912 teaching experience from out -of-country schools that are accredited
913913 or otherwise endorsed by the appropriate national or regional
914914 accrediting or endorsement authority. Out -of-country certification
915915 documentation in a language other than English shall be analyzed by
916916 an educational credent ial evaluation service in accordance with
917917 industry standards and guidelines and approved by the State
918918 Department of Education. The person seeking to have credit granted
919919 for out-of-country teaching experience shall be responsible for all RBH No. 6236

947947 shall accept teaching experience from primary and secondary schools
948948 that are operated by the United States Department of Defense or are
949949 affiliated with the United States Department of State.
950950 D. For the purpose of state salary increments and retirement,
951951 no teacher shall be granted credit for more than five (5) years of
952952 active duty in the military service or out -of-state or out-of-
953953 country teaching experience as a certified teacher or its
954954 equivalent. Nothing in this section shall prohibit boards of
955955 education from crediting more years of experience on district salary
956956 schedules than those allowed for state purposes.
957957 E. The State Board of Education shall recognize, for purposes
958958 of certification and salary incre ments, all the years of experience
959959 of a:
960960 1. Certified teacher who teaches in the educational program of
961961 the Department of Corrections, beginning with fiscal year 1981;
962962 2. Vocational rehabilitation counselor under the Department of
963963 Human Services if the c ounselor was employed as a certified teacher
964964 by the State Department of Education when the Division of Vocational
965965 Rehabilitation was transferred from the State Board of Career and
966966 Technology Education or the State Board of Education to the Oklahoma
967967 Public Welfare Commission on July 1, 1968;
968968 3. Vocational rehabilitation counselor which were completed

998998 4. Certified teacher which were completed while employed by the
999999 Department of Human Services Child Study Center at University
10001000 Hospital, if the teacher was certified as a teacher in Oklahoma; and
10011001 5. Certified school psychologist or psychometrist which were
10021002 completed while employed as a doctoral intern, psychological
10031003 assistant, or psychologist with any agency of the State of Oklahoma
10041004 if the experience primarily involved work with persons of school - or
10051005 preschool-age and if the person was, at the time the experi ence was
10061006 acquired, certified as, or eligible for certification as, a school
10071007 psychologist or psychometrist.
10081008 F. The provisions of this section shall not apply to teachers
10091009 who have retired from the Teachers ' Retirement System of Oklahoma
10101010 and who have entered into postretirement employment with a public
10111011 school in Oklahoma and are still receiving a monthly retirement
10121012 benefit.
10131013 G. If a person employed as certified personnel, as defined in
10141014 Section 26-103 of this title, by a school district during the 2017 -
10151015 2018 school year was receiving a salary above the step level
10161016 indicated by the State Minimum Salary Schedule for the 2017 -2018
10171017 school year, the person shall receive a salary increase amount equal
10181018 to the amount indicated in subsection A of this section for the step
10191019 level indicated for the person, provided they remain employed by the RBH No. 6236
