48103 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

50104 SECTION 1. NEW LAW A new section of law to be codified
51105 in the Oklahoma Statutes as Section 1 -171.1 of Title 47, unless
52106 there is created a duplication in numbering, reads as follows:
53-
54107 A. A "street-legal utility vehicle" is any motor vehicle
55108 having:
56-
57109 1. A bench seat or side -by-side seat for the use of each rider;
58-
59110 2. Four wheels in contact with the ground, but excluding a
60111 tractor;
61-
62112 3. A combustion engine with a piston or rotor displacement of
63113 four hundred cubic centimeters (400 cc) or greater and capable of
64114 maintaining speeds of forty -five (45) miles per hour or greater;
65-
66115 4. For each occupant, safety belts or safety shoulder harnesses
67116 which shall be of a type and shall be installed pursuant to 49
68117 C.F.R., Section 571.208 et seq.; and
69-
70118 5. All equipment requ ired by the provisions of Sections 12 -201
71119 through 12-232 of Title 47 of the Oklahoma Statutes, with respect to
72120 equipment on vehicles.
73-
74121 B. A street-legal utility vehicle operated on the street s and
75122 highways of this state shall be registered as a motor vehic le.
76-
77123 C. The operator of a street -legal utility vehicle shall not be
78124 required to have an "M" endorsement on the Class D license pursuant
79125 to Section 6-110.1 of Title 47 of the Oklahoma Statutes . The

80153 operator shall be at least sixteen (16) years of age and h old a
81154 valid Oklahoma driver license.

83155 SECTION 2. AMENDATORY 47 O.S. 2011, Section 11 -1116, as
84156 last amended by Section 2, Chapter 315, O.S.L. 2019 (47 O.S. Supp.
85157 2020, Section 11-1116), is amended to read as follows:
86-
87158 Section 11-1116. A. The self-propelled or motor-driven and
88159 operated vehicles described in this section shall be prohibited from
89160 operating or shall be limited in operation on the streets and
90161 highways of this state.

92162 B. Self-propelled or motor-driven cycles, known and co mmonly
93163 referred to as "minibikes" and other similar trade names, shall be
94164 prohibited from operating on the streets and highways of this state,
95165 except:
96-
97166 1. When used in a parade; or
98-
99167 2. When registered, as required by subsection E of Section 1151
100168 of this title, and operated in this state by food vendor services
101169 upon streets having a speed limit of thirty (30) miles per hour or
102170 less.
103-
104171 All minibikes offered for sale in this state shall bear the
105172 following notice to the customer: "This machine is not manufactured
106173 or sold for operation on the public streets or highways. Since it
107174 is not provided with equipment required by law for street or highway
108175 use, all persons are cautioned that any operation of t his vehicle

109203 upon a public street or highway will be in violation of the motor
110204 vehicle laws of this state and will subject the violator to arrest."

112205 C. Golf carts and utility vehicles, as defined by Section 1102
113206 of this title, shall not be operated on the s treets and highways of
114207 this state except:
115-
116208 1. Golf carts or utili ty vehicles owned by the Oklahoma Tourism
117209 and Recreation Department, and operated by employees or agents of
118210 the Department or employees of independent management companies
119211 working on behalf of the Department, may be operated on the streets
120212 and highways of this state during daylight hours or under rules
121213 developed by the Oklahoma Tourism and Recreation Commission, when
122214 the streets and highways are located within the boundaries of a
123215 state park. The Department shall have warning signs placed at the
124216 entrance and other locations at those state parks allowing golf
125217 carts or utility vehicles to be operated on the streets and highways
126218 of this state located within the boundaries of those state parks.
127219 The warning signs shall state that golf carts and utility vehicles
128220 may be operating on streets and highways and that motor vehicle
129221 operators shall take special precautions to be alert for the
130222 presence of golf carts or utility vehicles on the streets and
131223 highways;

133224 2. The municipal governing body has adopted an ordinance
134225 governing the operation of golf carts and/or utility vehicles on

135253 city streets; provided, such ordinances shall include necessary
136-vehicle lighting and safety requirements; ENR. H. B. NO. 2382 Page 4

254+vehicle lighting and safety requirements;
138255 3. Golf carts or uti lity vehicles may operate on state highways
139256 only if making a perp endicular crossing of a state highway located
140257 within the boundaries of a municipality which has adopted an
141258 ordinance governing the operation of golf carts and/or utility
142259 vehicles; or
143-
144260 4. The board of county commissioners of a county has approved
145261 the operation of golf cart and/or utility vehicle traffic on
146262 roadways within the county, and:
147-
148263 a. the roadway has a posted speed limit of twenty -five
149264 (25) miles per hour or less,
150-
151265 b. the roadway is locat ed in an unincorporated area, and
152-
153266 c. appropriate signage, caution ing motorists of the
154267 possibility of golf cart or utility vehicle traffic,
155268 is erected by the board of county commissioners ; or
156-
157269 5. Street-legal utility vehicles that are registered as a motor
158270 vehicle pursuant to subsection B of Section 1 of this act may be
159271 operated on the streets and highways of this state. Provided,
160272 however, street-legal utility vehicles shall not be operated on the
161273 National System of Interstate and Defense Highways or U.S. h ighways.
162-
163274 D. All-terrain vehicles shall not be operated on the st reets
164275 and highways of this state, except:

166303 1. On unpaved roads which are located within the boundaries of
167304 any property of the Forest Service of the United States Department
168305 of Agriculture;

170306 2. On highways if:

172307 a. the vehicle needs to make a direct crossing of the
173308 highway while the vehicle is traveling upon a
174309 regularly traveled trail and needs to continue travel
175310 from one area of the trail to another and, if the
176311 vehicle comes to a complete stop, yields the right-of-
177312 way to all oncoming traffic that constitutes an
178313 immediate hazard, and crosses the highway at an angle
179314 of approximately ninety (90) degrees to the direction
180315 of the street or highway. This exception shall not
181-apply to divided highways or highways with a posted ENR. H. B. NO. 2382 Page 5
316+apply to divided highways or highways with a posted
182317 speed limit of more than thirty -five (35) miles per
183318 hour in the area of the crossing,
184-
185319 b. the vehicle needs to travel on a highway in order to
186320 cross a railroad track. In that event, the all -
187321 terrain vehicle may travel for not more th an three
188322 hundred (300) feet on a highway to cross a railroad
189323 track,

191324 c. the operator of the all -terrain vehicle making the
192325 crossing at a highway has a valid driver license, and

194353 d. the operator of the vehicle makes a crossing on a
195354 highway during daylight hou rs only;
196-
197355 3. On streets and highways within a municipality if the
198356 municipal governing body has adopted an ordinance governing the
199357 operation of golf carts, utility vehicles or all -terrain vehicles on
200358 streets and highways within the municipality; or
201-
202359 4. On roadways within unincorporated areas of a county if those
203360 roadways are not part of the state highway system or the National
204361 System of Interstate and Defense Highways; provided, however, that
205362 the driver is a licensed driver.
206-
207363 E. Mopeds, as defined by Section 1-133.2 of this title, may be
208364 operated on the streets and highwa ys of this state if:
209-
210365 1. The municipal governing body has adopted an ordinance
211366 governing the operation of mopeds on city streets; provided, such
212367 ordinances shall include necessary vehicle lig hting and safety
213368 requirements; or
214-
215369 2. The board of county commiss ioners of a county has approved
216370 the operation of mopeds on roadways within the county, not including
217371 roadways within a municipality.

219372 SECTION 3. AMENDATORY 47 O.S. 20 11, Section 1102, as
220373 last amended by Section 1, Chapter 57, O.S.L . 2016 (47 O.S. Supp.
221374 2020, Section 1102), is amended to read as follows:

223375 Section 1102. As used in the Oklahoma Vehicle License and
224376 Registration Act:

226404 1. "All-terrain vehicle" means a vehicl e manufactured and used
227405 exclusively for off-highway use traveling on four or more non-
228406 highway tires, and being fifty (50) inches or less in width;
229-
230407 2. "Carrying capacity" means the carrying capacity of a vehicle
231408 as determined or declared in tons of cargo o r payload by the owner;
232409 provided, that such declared capacity sha ll not be less than the
233410 minimum tonnage capacity fixed, listed or advertised by the
234411 manufacturer of any vehicle;
235-
236412 3. "Certificate of title" means a document which is proof of
237413 legal ownership of a motor vehicle as described and provided for in
238414 Section 1105 of this title;
239-
240415 4. "Chips and oil" or the term "road oil and crushed rock"
241416 means, with respect to materials authorized for use in the surfacing
242417 of roads or highways in this title or in any eq uivalent statute
243418 pertaining to road or highway surfacing in the S tate of Oklahoma,
244419 any asphaltic materials. Wherever chips and oil or road oil and
245420 crushed rock are authorized for use in the surfacing of roads or
246421 highways in this state, whether by the Depa rtment of Transportation,
247422 or by the county commissioners, or othe r road building authority
248423 subject to the Oklahoma Vehicle License and Registration Act,
249424 asphaltic materials are also authorized for use in such surfacing
250425 and construction;

252426 5. "Combined laden weight" means the weight of a truck or
253427 station wagon and its car go or payload transported thereon, or the

254455 weight of a truck or truck -tractor plus the weight of any trailers
255456 or semitrailers together with the cargo or payload transported
256457 thereon;

258458 6. "Commercial trailer" means any trailer, as defined in
259459 Section 1-180 of this title, or semitrailer, as defined in Section
260460 1-162 of this title, when such trailer or semitrailer is used
261461 primarily for business or commercial purposes;
262-
263462 7. "Commercial trailer dealer" means any person, firm or
264463 corporation engaged in the business of selling any new and unused,
265464 or used, or both new and used commercial trailers;
266-
267465 8. "Commercial vehicle" means any vehicle over eight thousand
268466 (8,000) pounds combined laden weight used primari ly for business or
269467 commercial purposes. Each motor vehicle being registered pursuant
270-to the provisions of this section shall have the name of the ENR. H. B. NO. 2382 Page 7
468+to the provisions of this section shall have the name of the
271469 commercial establishment or the words "Commercial Vehicle"
272470 permanently and prominently displayed upon the out side of the
273471 vehicle in letters not less than two (2) inches high. Such letters
274472 shall be in sharp contrast to the background and shall be of
275473 sufficient shape and color as to be readily legible during daylight
276474 hours, from a distance of fifty (50) feet while the vehicle is not
277475 in motion;

279476 9. "Commission" or "Tax Commissio n" means the Oklahoma Tax

282505 10. "Construction machinery" means machines or devices drawn as
283506 trailers which are designed and used for construction, tree trimming
284507 and waste maintenance projects, which derive no revenue from the
285508 transportation of persons or property, whose use of the highway is
286509 only incidental and which are not mounted or affixed to another
287510 vehicle; provided, construction machinery shall not include
288511 implements of husbandry as defined in Section 1-125 of this title;
289-
290512 11. "Dealer" means any person, firm, association, corporation
291513 or trust who sells, solicits or advertises the sale of new and
292514 unused motor vehicles and holds a bona fide contract or franchise in
293515 effect with a manufacturer or distributor of a particular make of
294516 new or unused motor vehicle or vehicles for the sale of same;
295-
296517 12. "Mini-truck" means a foreign -manufactured import or
297518 domestic-manufactured vehicle powered by an internal combustion
298519 engine with a piston or rotor displacement of one thousand cubic
299520 centimeters (1,000 cu cm) (1,000 cc) or less, which is sixty -seven
300521 (67) inches or less in width, with an unladen dry weight of three
301522 thousand four hundred (3,400) pounds or less, traveling on four or
302523 more tires, having a top speed of approximately fifty -five (55)
303524 miles per hour, equipped with a bed or compartment for hauling, and
304525 having an enclosed passenger cab;
305-
306526 13. "Interstate commerce" means any commerce moving between any
307527 place in a state and any place in an other state or between places in
308528 the same state through another s tate;

310556 14. "Laden weight" means the combined weight of a vehicle when
311557 fully equipped for use and the cargo or payload transported thereon;
312558 provided, that in no event shall the laden weight be less than the
313559 unladen weight of the vehicle fully equipped for u se, plus the
314560 manufacturer's rated carrying capacity;

316561 15. "Local authorities" means every county, municipality or
317562 local board or body having authority to adopt police regulations
318563 under the Constitution and laws of this state;

320564 16. "Low-speed electrical veh icle" means any four -wheeled
321565 electrical vehicle that is powered by an electric motor that draws
322566 current from rechargeable storage batteries or other sources of
323567 electrical current and whose to p speed is greater than twenty (20)
324568 miles per hour but not greate r than twenty-five (25) miles per hour
325569 and is manufactured in compliance with the National Highway Traffic
326570 Safety Administration standards for low -speed vehicles in 49 C.F.R.
327571 571.500;

329572 17. "Manufactured home" means a residential dwelling built in
330573 accordance with the National Manufactured Housing Construction and
331574 Safety Standards Act of 1974, 42 U.S.C., Section 5401 et seq., and
332575 rules promulgated pursuant thereto and the rules promulgated by th e
333576 Oklahoma Used Motor Vehicle and Parts Commission pursuant to Se ction
334577 582 of this title. Manufactured home shall not mean a park model
335578 recreational vehicle as defined in this section;

337606 18. "Manufactured home dealer" means any person, firm or
338607 corporation engaged in the business of selling any new and unused,
339608 or used, or both new and used manufactured homes. Such information
340609 and a valid franchise letter as proof of authorization to sell any
341610 such new manufactured home product line or lines shall be attached
342611 to the application for a dealer license to sell manufactured hom es.
343612 "Manufactured home dealer" shall not include any person, firm or
344613 corporation who sells or contracts for the sale of the dealer's own
345614 personally titled manufactured home or homes. No per son, firm or
346615 corporation shall be considered a manufactured home dealer as to any
347616 manufactured home purchased or acquired by such person, firm or
348617 corporation for purposes other than resale; provided, that the
349618 restriction set forth in this sentence shall no t prevent an
350619 otherwise qualified person, firm or corporation from utilizing a
351620 single manufactured home as a sales office;

353621 19. "Medium-speed electrical vehicle" means any self -propelled,
354622 electrically powered four -wheeled motor vehicle, equipped with a
355623 roll cage or crush-proof body design, whose speed attainable in one
356624 (1) mile is more than thirty (30) miles per hour but not greater
357625 than thirty-five (35) miles per hour;

359626 20. "Motor license agent" means any person appointed,
360-designated or authorized by the Oklahoma Tax Commission to collect ENR. H. B. NO. 2382 Page 9
627+designated or authorized by the Ok lahoma Tax Commission to collect
361628 the fees and to enforce the prov isions provided for in the Oklahoma
362629 Vehicle License and Registration Act;

364657 21. "New vehicle" or "unused vehicle" means a vehicle which has
365658 been in the possession of the manufacturer, distribu tor or
366659 wholesaler or has been sold only by the manufacturer, dist ributor or
367660 wholesaler to a dealer;

369661 22. "Nonresident" means any person who is not a resident of
370662 this state;
371-
372663 23. "Off-road motorcycle" means any motorcycle, as defined in
373664 Section 1-135 of this title, when such motorcycle has been
374665 manufactured for and used exclusively off roads, highways and any
375666 other paved surfaces;
376-
377667 24. "Owner" means any person owning, operating or possessing
378668 any vehicle herein defined;
379-
380669 25. "Park model recreational vehicle" means a vehicle that is:
381-
382670 a. designed and marketed as temporary li ving quarters for
383671 camping, recreational, seasonal or travel use,
384-
385672 b. not permanently affixed to real property for use as a
386673 permanent dwelling,
387-
388674 c. built on a single chassis mounted on wheels wi th a
389675 gross trailer area not exceeding four hundred (400)
390676 square feet in the setup mode, and
391-
392677 d. certified by the manufacturer as complying with
393678 standard A119.5 of the American National Standards
394679 Institute, Inc.;

396707 26. "Person" means any individual, copartner , joint venture,
397708 association, corporation, limited liability comp any, estate, trust,
398709 business trust, syndicate, the State of Oklahoma, or any county,
399710 city, municipality, school district or other political subdivision
400711 thereof, or any group or combination ac ting as a unit, or any
401712 receiver appointed by the state or federal court;
402-
403713 27. "Rebodied vehicle" means a vehicle:

405714 a. which has been assembled using a new body or new major
406715 component which is of the identical type as the
407716 original vehicle and is licensed by the manufacturer
408717 of the original vehicle and other original, new or
409718 reconditioned parts. For purposes of this paragraph,
410719 "new body or new major component" means a new body,
411720 cab, frame, front end clip or rear end clip,
412-
413721 b. which is not a salvage, rebuilt, o r junked vehicle as
414722 defined by paragraph 1, 2, or 6 of subsection A of
415723 Section 1105 of this title, and
416-
417724 c. for which the Tax Commission has assigned or will
418725 assign a new identifying number;
419-
420726 28. "Recreational off -highway vehicle" means a vehicle
421727 manufactured and used exclusively for off-highway use, traveling on
422728 four or more non-highway tires, and being sixty -five (65) inches or
423729 less in width;

513914 conveyances shall be required to display the owner's driver license
514915 number or license plate number of any vehicle owne d by the owner of
515916 the implement of husbandry on the rear of the i mplement in numbers
516917 not less than two (2) inches in height. The use of the owner's
517918 Social Security number on the rear of the implement of husbandry
518919 shall not be required; and

6191122 3. The license plate shall be securely at tached to the rear of
6201123 the vehicle, except truck -tractor plates which shall be attached to
6211124 the front of the vehicle. The Tax Commission may, with the
6221125 concurrence of the Department of Public S afety, by Joint Rule,
6231126 change and direct the manner, place and loc ation of display of any
6241127 vehicle license plate when such action is deemed in the public
6251128 interest. The license plate, decal and all letters and numbers
6261129 shall be clearly visible at all times. The operation of a vehicle

7191318 produce documentary evidence of the ownership, a license plate may
7201319 be issued upon approval by the Tax Commission or Corporation

7221321 issuing a certificate of title shall be indicated on the receipt
7231322 given to the applicant. I t shall still be the duty of the applicant
7241323 to immediately take al l necessary steps to obtain the Oklahoma
7251324 certificate of title and it shall be unlawful for the applicant to
7261325 sell the vehicle until the certificate has been obtained in the

7291327 D. The certificate of registration provided for in this section
7301328 shall be in convenient form, and the certificate of registration, or
7311329 a certified copy or photostatic copy thereof, duly authenticated by
7321330 the Tax Commission or Corporation Commission, as applic able, shall
7331331 be carried at all times in or upon all vehicles so re gistered, in
7341332 such manner as to permit a ready examination thereof upon demand by
7351333 any peace officer of the state or duly authorized employee of the
7361334 Department of Public Safety. Any such offic er or agent may seize
7371335 and hold such vehicle when the operator of the same does not have
7381336 the registration certificate in the operator's possession or when
7391337 any such officer or agent determines that the registration

7471371 E. The purchaser of a new or used manufactured home shall,
7481372 within thirty (30) days of the date of purchase, register the home
7491373 with the Tax Commission or a motor license agent pursuant to the
7501374 provisions of Section 1117 of this title. For a new manufactured
7511375 home, it shall be the res ponsibility of the dealer selling the home
7521376 to place a temporary license plate on the home in the same manner as
7531377 provided in Section 1128 of this title for other new motor vehicles.
7541378 For the first year that any manufactured home is registered in this
7551379 state, the Tax Commission shall issue a metal license plate which
7561380 shall be affixed to the manufactured home. The temporary dealer
7571381 license plate or the metal license plate shall be displayed on the
7581382 manufactured home at all times when upon a public roadway; provi ded,
7591383 a repossession affidavit issued pursuant to Sections 1110 and 1126
7601384 of this title shall be permissible in lieu of a current license

7721423 shall be charged for issuance of any plate or decal. The fee shall
7731424 be apportioned each month to the General Revenue Fund of the State
7741425 Treasury.

7761426 F. The decal shall be easily visible for purposes of
7771427 verification by a county assessor that the manufactured home is
7781428 properly assessed for ad valorem taxation. In the first year of
7791429 registration, a decal sha ll be issued for placement on the license
7801430 plate indicating paymen t of applicable registration fees and excise
7811431 taxes. A duplicate manufactured home registration decal shall be
7821432 affixed inside the window nearest the front door of the manufactured
7831433 home. In the second and all subsequent years for which the
7841434 manufactured home is subject to ad valorem taxation, an annual decal
