4040 An Act relating to professions and occupations;
4141 ensuring confidentiality of information relating to
4242 the alarm and locksmith industry ; requiring custodian
4343 to protect certain information; providing for notice
4444 if confidential information is compromised;
4545 prohibiting certain information from third parties;
4646 providing for disciplinary action and civil
4747 penalties; providing for codification; an d providing
4848 an effective date.

5454 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5555 SECTION 1. NEW LAW A new section of law to be codified
5656 in the Oklahoma Statutes as Section 1800.19 of Title 59, unless
5757 there is created a duplication in numbering, reads as follows:
5858 A. A licensee or public entity shall ensure the confidentiality
5959 of information obtained from a client and shall not disclose,
6060 release to any third-party entities, or distribute information
6161 relating to the alarm industry or locksmith industry ,
6262 notwithstanding emergency responders for dispatching purposes.
6363 Information shall not be shared with, stored , or distributed by any
6464 third party.

9191 B. Any person who is the custodian of confidential information
9292 shall exercise due diligence on an ongoing basis to protect the
9393 security of the confidential information including, but not limited
9494 to, maintaining current technology to prevent unauthorized access to
9595 computers, computer systems, software and computer networks;
9696 maintaining adequate safeguards to ensure that confidential
9797 information is only distributed to authorized individuals; and
9898 conducting employee training in information security measures.
9999 C. A person having custody of confidential information shall
100100 notify a person if the person's confidential information has been
101101 accessed by an unauthorized person or if there has been a breach of
102102 the custodian's security measures which may have compromised the
103103 security of the person 's confidential information.
104104 D. Personal or busin ess information shall not be accessed by,
105105 sold to or used by any third party without the written authorization
106106 that specifically calls out such conformation of understanding of
107107 that person or business.
108108 E. Any person, licensee, public entity or third party licensee
109109 that fails to comply with the requirements of this section shall be
110110 deemed to be engaged in professional misconduct and is subject to
111111 disciplinary action and civil penalties.
112112 SECTION 2. This act shall become effective November 1, 2021.
