40	40	An Act relating to professions and occupations;
41	41	ensuring confidentiality of information relating to
42	42	the alarm and locksmith industry ; requiring custodian
43	43	to protect certain information; providing for notice
44	44	if confidential information is compromised;
45	45	prohibiting certain information from third parties;
46	46	providing for disciplinary action and civil
47	47	penalties; providing for codification; an d providing

54	54	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
55	55	SECTION 1. NEW LAW A new section of law to be codified
56	56	in the Oklahoma Statutes as Section 1800.19 of Title 59, unless
57	57	there is created a duplication in numbering, reads as follows:
58	58	A. A licensee or public entity shall ensure the confidentiality
59	59	of information obtained from a client and shall not disclose,
60	60	release to any third-party entities, or distribute information
61	61	relating to the alarm industry or locksmith industry ,
62	62	notwithstanding emergency responders for dispatching purposes.
63	63	Information shall not be shared with, stored , or distributed by any
64	64	third party.

91	91	B. Any person who is the custodian of confidential information
92	92	shall exercise due diligence on an ongoing basis to protect the
93	93	security of the confidential information including, but not limited
94	94	to, maintaining current technology to prevent unauthorized access to
95	95	computers, computer systems, software and computer networks;
96	96	maintaining adequate safeguards to ensure that confidential
97	97	information is only distributed to authorized individuals; and
98	98	conducting employee training in information security measures.
99	99	C. A person having custody of confidential information shall
100	100	notify a person if the person's confidential information has been
101	101	accessed by an unauthorized person or if there has been a breach of
102	102	the custodian's security measures which may have compromised the
103	103	security of the person 's confidential information.
104	104	D. Personal or busin ess information shall not be accessed by,
105	105	sold to or used by any third party without the written authorization
106	106	that specifically calls out such conformation of understanding of
107	107	that person or business.
108	108	E. Any person, licensee, public entity or third party licensee
109	109	that fails to comply with the requirements of this section shall be
110	110	deemed to be engaged in professional misconduct and is subject to
111	111	disciplinary action and civil penalties.
112	112	SECTION 2. This act shall become effective November 1, 2021.
