AS INTRODUCED 
 
An Act relating to public health; creating the 
Maintaining the People 's Rights Act; preempting 
vaccine mandates by any authority other than the 
Legislature; prohibiting discrimination on the basis 
of vaccination or immunity status; defining term; 
providing for codification; and providing an 
effective date. 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Section 7311 of Title 63, unless there 
is created a duplication in numbering, reads as follows: 
This act shall be known and may be cited as the "Maintaining the 
People's Rights Act". 
SECTION 2.     NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Section 7312 of Title 63, unless there 
is created a duplication in numbering, reads as follows: 
Vaccine mandates may only be imposed by the Legislature, which 
hereby states its intent to preempt any vaccine -related ordinances, 
rules, and orders.  No elected or appointed official or any

political subdivision of the state, including, but not limited to , 
counties, cities, towns, school di stricts, agencies, boards, 
councils, and commissions, shall issue or enforce a vaccine mandate 
through any means, including, but not limited to, orders, 
ordinances, or rules. 
SECTION 3.     NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Section 7313 of Title 63, unless there 
is created a duplication in numbering, reads as follows: 
No person shall be discriminated against on the basis of his or 
her vaccination or immunity status by denial of any public 
accommodation.  For purposes of this section, "discrimination" shall 
include, but not be limited to, the following: 
1.  Providing any service, financial aid, or benefit to an 
individual that is different or is provided in a different manner 
from that provided to othe r similarly situated members of the 
general public; 
2. Subjecting any individual to segregation or separate 
treatment in any manner related to that individual 's receipt of any 
service, financial aid, or benefit provided to other similarly 
situated members of the general public; 
3. Restricting in any way the enjoyment of any advantage or 
privilege enjoyed by others receiving any service, financial aid, or 
benefit provided to other similarly situated members of the general 
public;

4. Treating an individual differently from others in 
determining whether that individual satisfies any admission, 
enrollment, quota, eligibility, membership, or other requirement or 
condition which individuals must meet in order to be provided any 
service, financial aid, function, or benefit available to other 
similarly situated members of the general public; and 
5. Denying an individual an opportunity to participate in a 
program through the provision of service or otherwise afford that 
individual an opportunity to do so that is different from that 
afforded to other similarly situated members of the general public. 
SECTION 4.  This act shall become effective November 1, 2021.
