4040 An Act relating to insurance; amending 36 O.S. 2011,
4141 Section 941, which relates to motor vehicle insurance
4242 policies; prohibiting cancella tion, refusal to renew
4343 or increase of premium rate for the reason of change
4444 in marital status; and providing an effective date.

5050 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5151 SECTION 1. AMENDATORY 36 O.S. 2011, Section 941, is
5252 amended to read as follows:
5353 Section 941. A. No insurance carrier who issues motor vehicle
5454 insurance policies in this state shall assign driving record points,
5555 cancel, refuse to issue or renew, or charge a higher premium rate
5656 for any motor vehicle liability or collision insurance policy for
5757 the reason that the insured has been involved in a motor vehicle
5858 collision and was not at fault.
5959 B. No insurance carrier who issues motor vehicle insurance
6060 policies in this state shall cancel, refuse to issue or renew, or
6161 charge a higher premium for any motor vehicle liability or collision
6262 insurance policy for the reason that the insured had lower liability

8989 limits with a previous insurer without actuarial justification.
9090 This prohibition includes using p rior limits for company or tier
9191 placement unless the insurer provides actuarial justification.
9292 C. No insurance carrier who issues motor vehicle insurance
9393 policies in this state shall cancel, refuse to issue or renew, or
9494 charge a higher premium for any mot or vehicle liability or collision
9595 insurance policy for the reason that the marital status of the
9696 insured has changed due to legal separation, divorce or death of a
9797 spouse.
9898 D. This section shall not apply to an insured who has been
9999 convicted of:
100100 1. Homicide or assault arising out of the operation of any
101101 motor vehicle; or
102102 2. A violation of Section 11 -902 or 761 of Title 47 of the
103103 Oklahoma Statutes as being impaired by or under the influence of
104104 alcohol or intoxicating liquor or who was under the influence o f any
105105 substance included in the Uniform Controlled Dangerous Substances
106106 Act.
107107 SECTION 2. This act shall become effective November 1, 20 21.
