24	55		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

26	56		SECTION 1. AMENDATORY Section 13, Chapter 366, O.S.L.
27	57		2016, as last amended by Section 9, Chapter 161, O.S.L. 2020 (37A
28	58		O.S. Supp. 2020, Section 2 -101), is amended to read as follows:

30	59		Section 2-101. A. Except as otherwise provided in this
31	60		section, the licenses issued by the ABLE Commission, and the annual
32	61		fees therefor, shall be as follows:

174	245		B. 1. There shall be added to the initial or renewal fees for
175	246		a Mixed Beverage License an administrative fee, which shall not be
176	247		deemed to be a license fee, in the amount of Five Hundred Dollars
177	248		($500.00), which shall be paid at the same time a nd in the same
178	249		manner as the license fees prescribed b y paragraph 12 of subsection
179	250		A of this section; provided, this fee shall not be assessed against

181	252		exempt under Section 501(c)(19), (8) o r (10) of the Internal Revenue

184	254		2. There shall be added to the fee for a Mixed Beverage/Caterer
185	255		Combination License an administrative fee, which shall not be deemed
186	256		to be a license fee, in the amount of Two Hundred Fifty Dollars
187	257		($250.00), which shal l be paid at the same time and in the same
188	258		manner as the license fee prescribed by paragraph 13 of subsection A
189	259		of this section.

191	260		C. Notwithstanding the provisions of subsection A of this
192	261		section:

194	262		1. The license fee for a mixed beverage or bottle club lic ense
195	263		for those service organizations or fraternal bene ficiary societies
196	264		which are exempt under Section 501(c)(19), (8) or (10) of the
197	265		Internal Revenue Code shall be Five Hundred Dollars ($500.00) per

200	294		2. The renewal fee for an airline/railroad/co mmercial passenger
201	295		vessel beverage license held by a r ailroad described in 49 U.S.C.,
202	296		Section 24301, shall be One Hundred Dollars ($100.00).

204	297		D. An applicant may apply for and receive both an on -premises
205	298		beer and wine license and a caterer license.

207	299		E. All licenses, except as otherwise provided, shall be vali d
208	300		for one (1) year from date of issuance unless revoked or
209	301		surrendered. Provided, all employee licenses shall be valid for two
210	302		(2) years.

212	303		F. The holder of a license, issued by the ABLE Commission, for
213	304		a bottle club located in a county of this state where the sale of
214	305		alcoholic beverages by the individual drink for on -premises
215	306		consumption has been authorized, may exchange the bottle club
216	307		license for a mixed beverage license or an on -premises beer and win e
217	308		license and operate the licensed premises as a mixed beverage
218	309		establishment or an on -premises beer and wine establishment subject
219	310		to the provisions of the Oklahoma Alcoholic Beverage Control Act.
220	311		There shall be no additional fee for such exchange and th e mixed
221	312		beverage license or on-premises beer and wine license issued shall
222	313		expire one (1) year from the date of issuance of the original bottle
223	314		club license.

225	315		G. In addition to the applicable licensing fee, the following
226	316		surcharge shall be assessed annuall y on the following licenses:

279	402		this title.

281	403		H. Any license issued by the ABLE Commission under this title
282	404		may be relied upon by other licensees as a valid license, and no
283	405		other licensee shall have any obligation to independently d etermine
284	406		the validity of such license or be held liabl e solely as a
285	407		consequence of another licensee's failure to maintain a valid
286	408		license.

288	409		SECTION 2. This act shall become effective July 1, 2021.

290	410		SECTION 3. It being immediately necessary for the preservation
291	411		of the public peace, health or safety, an emergency is hereby
292	412		declared to exist, by reason whereof this act shall take effect and
293	413		be in full force from and after its passage and approval.
