5252 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5353 SECTION 1. AMENDATORY 36 O.S. 2011, Section 6802, is
5454 amended to read as follows:
5555 Section 6802. As used in this act, "telemedicine" means the
5656 practice of health care delivery, diagnosis, consultation,
5757 treatment, including but not limited to, the t reatment and
5858 prevention of strokes, transfer of medical data, or exchange of
5959 medical education information by means of audio, video, or data
6060 communications. Telemedicine is not may include a consultation
6161 provided by telephone or facsimile machine if a video-messaging
6262 application that provides for face -to-face visual communication is
6363 used.

9090 SECTION 2. AMENDATORY 36 O.S. 2011, Section 6803, is
9191 amended to read as follows:
9292 Section 6803. A. For services that a health care practitioner
9393 determines to be appropriately provided by means of telemedicine,
9494 health care service plans, disability insurer programs, workers '
9595 compensation programs, or state Medicaid managed care program
9696 contracts issued, amended, or renewed on or after January 1, 1 998,
9797 shall not require person -to-person contact between a health care
9898 practitioner and a patient.
9999 B. Subsection Any health benefit plan that is offered, issued
100100 or renewed on or after November 1, 2021 , shall reimburse health care
101101 practitioners for telemedi cine services at the same rate as in -
102102 person visits in accordance with the terms of the health benefit
103103 plan.
104104 C. Subsections A and B of this section shall apply to health
105105 care service plan contracts with the state Medicaid managed care
106106 program only to the e xtent that both of the following apply:
107107 1. Telemedicine services are covered by, and reimbursed under,
108108 the fee-for-service provisions of the state Medicaid managed care
109109 program; and
110110 2. State Medicaid managed care program contracts with health
111111 care service plans are amended to add coverage of telemedicine
112112 services and make any appropriate capitation rate adjustments.
