42	42	term; amending 36 O.S. 2011, Sec tion 6803, which
43	43	relates to coverage of telemedicine services;

45	45	rate as in-person visits; and providing an effective

52	52	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
53	53	SECTION 1. AMENDATORY 36 O.S. 2011, Section 6802, is
54	54	amended to read as follows:
55	55	Section 6802. As used in this act, "telemedicine" means the
56	56	practice of health care delivery, diagnosis, consultation,
57	57	treatment, including but not limited to, the t reatment and
58	58	prevention of strokes, transfer of medical data, or exchange of
59	59	medical education information by means of audio, video, or data
60	60	communications. Telemedicine is not may include a consultation
61	61	provided by telephone or facsimile machine if a video-messaging
62	62	application that provides for face -to-face visual communication is
63	63	used.

90	90	SECTION 2. AMENDATORY 36 O.S. 2011, Section 6803, is
91	91	amended to read as follows:
92	92	Section 6803. A. For services that a health care practitioner
93	93	determines to be appropriately provided by means of telemedicine,
94	94	health care service plans, disability insurer programs, workers '
95	95	compensation programs, or state Medicaid managed care program
96	96	contracts issued, amended, or renewed on or after January 1, 1 998,
97	97	shall not require person -to-person contact between a health care
98	98	practitioner and a patient.
99	99	B. Subsection Any health benefit plan that is offered, issued
100	100	or renewed on or after November 1, 2021 , shall reimburse health care
101	101	practitioners for telemedi cine services at the same rate as in -
102	102	person visits in accordance with the terms of the health benefit
103	103	plan.
104	104	C. Subsections A and B of this section shall apply to health
105	105	care service plan contracts with the state Medicaid managed care
106	106	program only to the e xtent that both of the following apply:
107	107	1. Telemedicine services are covered by, and reimbursed under,
108	108	the fee-for-service provisions of the state Medicaid managed care
109	109	program; and
110	110	2. State Medicaid managed care program contracts with health
111	111	care service plans are amended to add coverage of telemedicine
112	112	services and make any appropriate capitation rate adjustments.
