4040 An Act relating to game and fish; amending 29 O.S.

4444 waste of edible meat of wildlife; imposing fine for
4545 violations; defining term; and providing an effective

5454 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5555 SECTION 1. AMENDATORY 29 O.S. 2011, Section 7 -205, as
5656 amended by Section 2, Chapter 286, O.S.L. 2013 (29 O.S. Supp. 2020,
5757 Section 7-205), is amended to read as follows:
5858 Section 7-205. A. Excluding furbearers and coyotes, no person
5959 may capture, kill, mutilate or destroy any wildlife protected by law
6060 this title or administrative rule of the Wildlife Conservation
6161 Commission and remove the head, claws, teeth, hide, antlers, horns
6262 or any or all of such parts from the body with the inten t to abandon
6363 the body.

9090 B. Excluding furbearers and coyotes, no person may capture or
9191 mutilate any living wildlife protected by law this title or
9292 administrative rule of the Wildlife Conservation Commission by
9393 removing the claws, teeth, hide, antlers, horns or any or all of
9494 such parts from the body.
9595 C. No person may kill any wildlife protected by law this title
9696 or administrative rule of the Wildlife Conservation Commission and
9797 abandon the body without disposing of the body in the most
9898 appropriate manner.
9999 D. Any person convicted of violating the provisions of this
100100 section shall be punished by a fine of not less than Five Hundred
101101 Dollars ($500.00) nor more than One Thousand Dollars ($1,000.00), or
102102 by imprisonment in the county jail for not more than one (1) y ear,
103103 or by both fine and imprisonment.
104104 E. Any hunting or fishing license issued to a person by the
105105 Department of Wildlife Conservation shall be automatically revoked
106106 upon conviction of the person of violating the provisions of this
107107 section. The revocatio n shall be for a period set by the court of
108108 not less than one (1) year nor more than ten (10) years. If the
109109 court does not set a period, the revocation shall be for one (1)
110110 year from the date of the conviction. During this period of
111111 revocation, the Depar tment shall not issue the person a hunting or
112112 fishing license. If the court does not set a revocation period, the
113113 Department shall not issue that person a license within one (1) year

140140 of the conviction of the person pursuant to this section. A person
141141 who has a license or permit revoked pursuant to this section shall
142142 surrender the revoked license or permit to the court. The court
143143 shall send the Department of Wildlife Conservation the revoked
144144 license and a copy of the judgment of conviction. For purposes o f
145145 this section, "conviction" shall include a plea of guilty or nolo
146146 contendere to an offense or the imposition of deferred adjudication
147147 for an offense.
148148 F. A person taking any wildlife protected by this title or
149149 administrative rule of the Wildlife Conserva tion Commission shall
150150 not purposely, knowingly, recklessly, or with gross negligence waste
151151 or fail to use the edible meat of the wildlife. Any person
152152 violating the provisions of this section shall be fined One Thousand
153153 Dollars ($1,000.00). As used in this subsection, "edible meat"
154154 shall mean the flesh of wildlife used as food .
155155 SECTION 2. This act shall become effective November 1, 2021.
