44	44	waste of edible meat of wildlife; imposing fine for
45	45	violations; defining term; and providing an effective

54	54	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
55	55	SECTION 1. AMENDATORY 29 O.S. 2011, Section 7 -205, as
56	56	amended by Section 2, Chapter 286, O.S.L. 2013 (29 O.S. Supp. 2020,
57	57	Section 7-205), is amended to read as follows:
58	58	Section 7-205. A. Excluding furbearers and coyotes, no person
59	59	may capture, kill, mutilate or destroy any wildlife protected by law
60	60	this title or administrative rule of the Wildlife Conservation
61	61	Commission and remove the head, claws, teeth, hide, antlers, horns
62	62	or any or all of such parts from the body with the inten t to abandon
63	63	the body.

90	90	B. Excluding furbearers and coyotes, no person may capture or
91	91	mutilate any living wildlife protected by law this title or
92	92	administrative rule of the Wildlife Conservation Commission by
93	93	removing the claws, teeth, hide, antlers, horns or any or all of
94	94	such parts from the body.
95	95	C. No person may kill any wildlife protected by law this title
96	96	or administrative rule of the Wildlife Conservation Commission and
97	97	abandon the body without disposing of the body in the most
98	98	appropriate manner.
99	99	D. Any person convicted of violating the provisions of this
100	100	section shall be punished by a fine of not less than Five Hundred
101	101	Dollars ($500.00) nor more than One Thousand Dollars ($1,000.00), or
102	102	by imprisonment in the county jail for not more than one (1) y ear,
103	103	or by both fine and imprisonment.
104	104	E. Any hunting or fishing license issued to a person by the
105	105	Department of Wildlife Conservation shall be automatically revoked
106	106	upon conviction of the person of violating the provisions of this
107	107	section. The revocatio n shall be for a period set by the court of
108	108	not less than one (1) year nor more than ten (10) years. If the
109	109	court does not set a period, the revocation shall be for one (1)
110	110	year from the date of the conviction. During this period of
111	111	revocation, the Depar tment shall not issue the person a hunting or
112	112	fishing license. If the court does not set a revocation period, the
113	113	Department shall not issue that person a license within one (1) year

140	140	of the conviction of the person pursuant to this section. A person
141	141	who has a license or permit revoked pursuant to this section shall
142	142	surrender the revoked license or permit to the court. The court
143	143	shall send the Department of Wildlife Conservation the revoked
144	144	license and a copy of the judgment of conviction. For purposes o f
145	145	this section, "conviction" shall include a plea of guilty or nolo
146	146	contendere to an offense or the imposition of deferred adjudication
147	147	for an offense.
148	148	F. A person taking any wildlife protected by this title or
149	149	administrative rule of the Wildlife Conserva tion Commission shall
150	150	not purposely, knowingly, recklessly, or with gross negligence waste
151	151	or fail to use the edible meat of the wildlife. Any person
152	152	violating the provisions of this section shall be fined One Thousand
153	153	Dollars ($1,000.00). As used in this subsection, "edible meat"
154	154	shall mean the flesh of wildlife used as food .
155	155	SECTION 2. This act shall become effective November 1, 2021.
