41	41	An Act relating to crimes and punishments; making
42	42	certain acts unlawful; providing penal ties; defining
43	43	terms; providing for codification; and providing an
44	44	effective date.

50	50	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
51	51	SECTION 1. NEW LAW A new section of law to be codified
52	52	in the Oklahoma Statutes as Section 117 6 of Title 21, unless there
53	53	is created a duplication in numbering, reads as follows:
54	54	A. Whoever, with the intent to threaten, intimidate or harass
55	55	or facilitate another to threaten, intimidate or harass, uses an
56	56	electronic communication device to knowingly publish, post or
57	57	otherwise make available personally identifiable information of a
58	58	first responder or elected official, and as a result places that
59	59	first responder or elected official in reasonable fear of death or
60	60	serious bodily injury shall, upon conviction, be guilty of a
61	61	misdemeanor punishable by imprisonment in the county jail for a term

88	88	not to exceed one (1 ) year, or by a fine of One Thousand Dollars
89	89	($1,000.00), or by both such fine and imprisonment.
90	90	B. As used in this section:
91	91	1. "Electronic communication " shall have the same meanin g as
92	92	that term is defined in Section 1172 of Ti tle 21 of the Oklahoma
93	93	Statutes. Electronic communication does not include broadcast
94	94	transmissions or similar communications that are not targeted at any
95	95	specific individual;
96	96	2. "Electronic communication dev ice" means any cellular
97	97	telephone, facsimile, pager, computer or any device capable of
98	98	electronic communication ;
99	99	3. "First responder" means state and local law enforcement
100	100	personnel, fire depar tment personnel and emergency medical
101	101	personnel;
102	102	4. "Personally identifiable information " means information
103	103	which can identify an individual including, but not limited to,
104	104	name, birth date, place of birth, mother 's maiden name, biometric
105	105	records, Social Security number, official state - or government-
106	106	issued driver license or identification number, government passport
107	107	number, employer or taxpayer identification number or any other
108	108	information that is linked or linkable to an individual, such as
109	109	medical, educational, financial or employment information ;

136	136	5. "Elected official" means any person elected to a state
137	137	office in the executive, legislative or judicial branch of state
138	138	government or other political subdivision of the state ; and
139	139	6. "Publish" means to circulate, deliver, distribute,
140	140	disseminate, transmit or otherwis e make available to another person .
141	141	SECTION 2. This act shall become effective November 1, 2021.
