4141 An Act relating to crimes and punishments; making
4242 certain acts unlawful; providing penal ties; defining
4343 terms; providing for codification; and providing an

5050 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5151 SECTION 1. NEW LAW A new section of law to be codified
5252 in the Oklahoma Statutes as Section 117 6 of Title 21, unless there
5353 is created a duplication in numbering, reads as follows:
5454 A. Whoever, with the intent to threaten, intimidate or harass
5555 or facilitate another to threaten, intimidate or harass, uses an
5656 electronic communication device to knowingly publish, post or
5757 otherwise make available personally identifiable information of a
5858 first responder or elected official, and as a result places that
5959 first responder or elected official in reasonable fear of death or
6060 serious bodily injury shall, upon conviction, be guilty of a
6161 misdemeanor punishable by imprisonment in the county jail for a term

8888 not to exceed one (1 ) year, or by a fine of One Thousand Dollars
8989 ($1,000.00), or by both such fine and imprisonment.
9090 B. As used in this section:
9191 1. "Electronic communication " shall have the same meanin g as
9292 that term is defined in Section 1172 of Ti tle 21 of the Oklahoma
9393 Statutes. Electronic communication does not include broadcast
9494 transmissions or similar communications that are not targeted at any
9595 specific individual;
9696 2. "Electronic communication dev ice" means any cellular
9797 telephone, facsimile, pager, computer or any device capable of
9898 electronic communication ;
9999 3. "First responder" means state and local law enforcement
100100 personnel, fire depar tment personnel and emergency medical
101101 personnel;
102102 4. "Personally identifiable information " means information
103103 which can identify an individual including, but not limited to,
104104 name, birth date, place of birth, mother 's maiden name, biometric
105105 records, Social Security number, official state - or government-
106106 issued driver license or identification number, government passport
107107 number, employer or taxpayer identification number or any other
108108 information that is linked or linkable to an individual, such as
109109 medical, educational, financial or employment information ;

136136 5. "Elected official" means any person elected to a state
137137 office in the executive, legislative or judicial branch of state
138138 government or other political subdivision of the state ; and
139139 6. "Publish" means to circulate, deliver, distribute,
140140 disseminate, transmit or otherwis e make available to another person .
141141 SECTION 2. This act shall become effective November 1, 2021.
