2755 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

2956 SECTION 1. AMENDATORY Section 13, Chapter 187, O.S.L.
3057 2019 (59 O.S. Supp. 2020, Section 1389), is amended to read as

3359 Section 1389. A. Oversight.

3560 1. The executive, legislative and judicial branches of stat e
3661 government in each compact state shall enforce th is Compact and take
3762 all actions necessary and appropriate to effectuate the Compact's
3863 purposes and intent. The provisions of this Compact and the rules
3964 promulgated hereunder shall have standing as statuto ry law.

4192 2. All courts shall take judicial notice o f the Compact and the
4293 rules in any judicial or administrative proceeding in a compact
4394 state pertaining to the subject matter of this Compact which may
4495 affect the powers, responsibilities or actions of the Commission.

4696 3. The Commission shall be entitled to receive service of
4797 process in any such proceeding and shall have standing to intervene
4898 in such a proceeding for all purposes. Failure to provide service
4999 of process to the Commission shall render a judgme nt or order void
50100 as to the Commission, this Compact or promulgated rules.

52101 B. Default, Technical Assistance and Termination.

54102 1. If the Commission determines that a compact state has
55103 defaulted in the performance of its obligations or responsibilities
56104 under this Compact or the promulgated rules, the Commiss ion shall:

58105 a. provide written notice to the defaulting state and
59106 other compact states of the nature of the default, the
60107 proposed means of remedying the default and any other
61108 action to be taken by the Commi ssion, and
62-
63109 b. provide remedial training and specifi c technical
64110 assistance regarding the default.

66111 2. If a state in default fails to remedy the default, the
67112 defaulting state may be terminated from the Compact upon an
68113 affirmative vote of the majority of the compact states, and all
69114 rights, privileges and bene fits conferred by this Compact shall be
70115 terminated on the effective date of termination. A remedy of the

71143 default does not relieve the offending state of obligations or
72144 liabilities incurred during the peri od of default.

74145 3. Termination of membership in the Compact shall be imposed
75146 only after all other means of securing compliance have been
76147 exhausted. Notice of intent to suspend or terminate shall be
77148 submitted by the Commission to the Governor, the majority and
78149 minority leaders of the defaulting state's leg islature, and each of
79150 the compact states.

81151 4. A compact state which has been terminated is responsible for
82152 all assessments, obligations and liabilities incurred through the
83153 effective date of termination, i ncluding obligations which extend
84154 beyond the effective date of termination.

86155 5. The Commission shall not bear any costs incurred by the
87156 state which is found to be in default or which has been terminated
88157 from the Compact, unless agreed upon in writing betwe en the
89158 Commission and the defaulting state.

91159 6. The defaulting state may appeal the action of the Commission
92160 by petitioning the United States District Court for the State of
93161 Oklahoma Georgia or the federal district where the Compact has its
94162 principal offices. The prevailing member shall be awarded all cos ts
95163 of such litigation, including reasonable attorney fees.

99192 1. Upon request by a compact state, the Commission shall
100193 attempt to resolve disputes related to the Compact which arise a mong
101194 compact states and between compact and noncomp act states.

103195 2. The Commission shall promulgate a rule providing for both
104196 mediation and binding dispute resolution for disputes that arise
105197 before the Commission.

107198 D. Enforcement.

109199 1. The Commission, in the reasonable exercise of its
110200 discretion, shall enfor ce the provisions and rules of this Compact.

112201 2. By majority vote, the Commission may initiate legal action
113202 in the United States District Court for the State of Oklahoma
114203 Georgia or the federal district whe re the Compact has its principal
115204 offices against a compact state in default to enforce compliance
116205 with the provisions of the Compact and its promulgated rules and
117206 bylaws. The relief sought may include both injunctive relief and
118207 damages. In the event judi cial enforcement is necessary, the
119208 prevailing member shall be awarded all costs of such litigation,
120209 including reasonable attorney fees.

122210 3. The remedies herein shall not be the exclusive remedies of
123211 the Commission. The Commission may pursue any other reme dies
124212 available under federal or state law.

126213 SECTION 2. This act shall become effective November 1, 2021.
