52	52	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
53	53	SECTION 1. NEW LAW A new section of law not to be
54	54	codified in the Oklahoma Statutes reads as follows:
55	55	This act shall be known and may be ci ted as the "Proof of
56	56	Citizenship Act of 2021 ".
57	57	SECTION 2. AMENDATORY 26 O.S. 2011, Section 7 -114, as
58	58	last amended by Section 5, Chapter 4, O.S.L. 2014 (26 O.S. Supp.
59	59	2020, Section 7-114), is amended to read as follows:
60	60	Section 7-114. A. Each person appearing to vote shall announce
61	61	that person's name to the judge of the precinct and shall provide
62	62	proof of identity and proof of United States citizenship , whereupon

89	89	the judge shall determine whether the person 's name is in the
90	90	precinct registry.
91	91	B. As used in this section, "proof of identity" shall mean a
92	92	document that satisfies all of the following:
93	93	1. The document shows the name of the person to whom the
94	94	document was issued, and the name substantially conforms to the name
95	95	in the precinct registry;
96	96	2. The document shows a photograph of the person to whom the
97	97	document was issued;
98	98	3. The document includes an expiration date, which is after the
99	99	date of the election in which the person is appearing to vote. The
100	100	provisions of this par agraph shall not apply to:
101	101	a. an identification card that is valid indefinitely, or
102	102	b. an identification card issued by a branch of the armed
103	103	services of the United States to a person who is a
104	104	member of such branch or is retired therefrom; and
105	105	4. The document was issued by the United States, the State of
106	106	Oklahoma or the government of a federally recognized Indian tribe or
107	107	nation.
108	108	Provided, if the person presents a voter identification card
109	109	issued by the appropriate county election board, such card may serv e
110	110	as proof of identity without meeting the requirements of paragraphs
111	111	2 and 3 of this subsection.

138	138	C. As used in this section "proof of United States citizenship "
139	139	shall mean one of the following documents:
140	140	1. An original birth document issued by a state, the
141	141	Commonwealth of Puerto Rico or the District of Columbia, or a
142	142	certified copy thereof;
143	143	2. An original birth certificate issued by the federal
144	144	government, or a certified copy thereof;
145	145	3. An original United States Certificate of Birth Abroad;
146	146	4. An original Report of Birth Abroad of a Citizen of the
147	147	United States;
148	148	5. An original Certificate of Citizenship (Form N -560 or N-
149	149	561); or
150	150	6. An original Certificate of Na turalization (Form N -550, N-570
151	151	or N-578) or a valid United States passport.
152	152	Copies of these documents shall be made by the appropriate county
153	153	election board and kept available for public inspection pursuant to
154	154	the Oklahoma Open Records Act.
155	155	B. D. 1. If a person declines to or is unable to produce proof
156	156	of identity and proof of United States citizenship, the person may
157	157	sign a statement under oath, in a form approved by the Secretary of
158	158	the State Election Board, swearing or affirming that the person is
159	159	the person identified on the precinct registry, and shall be allowed
160	160	to cast a provisional ba llot in a manner consistent with the
161	161	provisions of Section 7 -116.1 of this title.

188	188	2. A provisional ballot cast by a voter who declines or is
189	189	unable to produce proof of identity shall only be considered
190	190	verified and approved for counting if:
191	191	a. the voter's name on the affidavit substantially
192	192	conforms to the voter 's name in the voter registration
193	193	database, except as provided in paragraph 3 of this
194	194	subsection,
195	195	b. the voter's residence address on the affidavit
196	196	substantially conforms to the voter 's residence
197	197	address in the voter registration database, except as
198	198	provided in paragraph 4 of this subsection,
199	199	c. the voter's date of birth matches the information in
200	200	the voter registration database,
201	201	d. the voter's Oklahoma driver license number or the last
202	202	four digits of the voter's Social Security number on
203	203	the affidavit matches the information in the voter
204	204	registration database. The provisions of this
205	205	subparagraph shall not apply if the voter was not
206	206	required to provide a driver license number or the
207	207	last four digits of the voter's Social Security number
208	208	at the time of registration, and
209	209	e. the provisional ballot meets the eligibility
210	210	requirements set forth in Section 7 -116.1 of this
211	211	title.

238	238	3. A voter casting a provisional ballot as provided in this
239	239	section who has legally changed his or her name, but has not updated
240	240	the name on the voter registry, may note this fact on the affidavit
241	241	and submit a form prescribed by the Secretary of the State Election
242	242	Board to update his or her name. In such a case, and where the
243	243	requirements of Section 4-117 of this title are satisfied, the
244	244	provisional ballot shall be deemed to meet the requirements of
245	245	subparagraph a of paragraph 2 of this subsection.
246	246	4. A voter casting a provisional ballot as provided in this
247	247	section who has changed h is or her address of residence, but has not
248	248	updated the address on the voter registry, may note this fact on the
249	249	affidavit and submit a form to update the address prescribed by the
250	250	Secretary of the State Election Board. In such a case, and where
251	251	the requirements of Section 4 -117 of this title are satisfied, the
252	252	provisional ballot shall be deemed to meet the requirements of
253	253	subparagraph a of paragraph 2 of this subsection.
254	254	5. False swearing or affirming under oath shall be punishable
255	255	as a felony as provide d in Section 16-103 of this title, and the
256	256	penalty shall be distinctly set forth on the face of the statement.
257	257	E. An individual may provide proof of United States citizenship
258	258	prior to any election when registering to vote or in person at the
259	259	State Election Board or appropriate county election board.
