4267 SECTION 1. AMENDATORY 70 O.S. 2011, Section 1 8-200.1, as
4368 amended by Section 11 of Enrolled Senate Bill No. 1064 of the 1st
4469 Session of the 58th Oklahoma Legislature, is amended to read as

4797 Section 18-200.1 A. Beginning with the 2020 -21 school year,
4898 and each school year thereafter, each scho ol district shall have its
4999 initial allocation of State Aid calculated based on the state
50100 dedicated revenues actually collected during the preceding fiscal
51101 year, the adjusted assessed valuation of the preceding year and the
52102 highest weighted average daily me mbership for the school district of
53103 the two (2) preceding school years. Each school district shall
54104 submit the following data based on the first nine (9) weeks, to be
55105 used in the calculation of the average daily membership of the
56106 school district:

58107 1. Student enrollment by grade level;
59-
60108 2. Pupil category counts; and
61-
62109 3. Transportation supplement data.
63-
64110 On or before December 30, the State Department of Education
65111 shall determine each school district's current year allocation
66112 pursuant to subsection D of this sec tion. The State Department of
67113 Education shall complete an audit, using procedures established by
68114 the Department, of the student enrollment by grade level data, pupil
69115 category counts and transportation supplement data to be used in the
70116 State Aid Formula pu rsuant to subsection D of this section by
71117 December 1 and by January 15 shall notify each school district of
72118 the district's final State Aid allocation for the current school
73119 year. The January payment of State Aid and each subsequent payment
74120 for the remainder of the school year shall be based on the final

75147 State Aid allocation as calculated in subsection D of this section.
76148 Except for reductions made due to the assessment of penalties by the
77149 State Department of Education according to law, the January payment
78150 of State Aid and each subsequent payment for the remainder of the
79151 school year shall not decrease by an amount more than the amount
80152 that the current chargeable revenue increases for that district.

82153 B. The State Department of Education shall retain not less than
83154 one and one-half percent (1 1/2%) of the total funds appropriated
84155 for financial support of schools, to be used to make midyear
85156 adjustments in State Aid and which shall be reflected in the final
86157 allocations. If the amount of appropriated funds, includ ing the one
87158 and one-half percent (1 1/2%) retained, remaining after January 1 of
88159 each year is not sufficient to fully fund the final allocations, the
89160 Department shall recalculate each school district' s remaining
90161 allocation pursuant to subsection D of this section using the

93163 C. On and after July 1, 1997, the amount of State Aid each
94164 district shall receive shall be the sum of the Foundation Aid, the
95165 Salary Incentive Aid and the Transportation Supplement, as adjusted
96166 pursuant to the provisions of subsection G of this section and
97167 Section 18-112.2 of this title; provided, no district having per
98168 pupil revenue in excess of three hundred percent (300%) of the
99169 average per pupil revenue of all districts shall receive any State
100170 Aid or Supplement in State Aid.

102197 The July calculation of per pupil revenue shall be dete rmined by
103198 dividing the district's second preceding year' s total weighted
104199 average daily membership (ADM) into the district's second preceding
105200 year's total revenues excluding federal revenue, insurance loss
106201 payments, reimbursements, recovery of overpayments and refunds,
107202 unused reserves, prior expenditures recovered, prior year surpluses,
108203 and less the amount of any transfer fees paid in that year.

110204 The December calculation of pe r pupil revenue shall be
111205 determined by dividing the district's preceding year' s total
112206 weighted average daily mem bership (ADM) into the district's
113207 preceding year's total revenues excluding federal revenue, insurance
114208 loss payments, reimbursements, recovery o f overpayments and refunds,
115209 unused reserves, prior expenditures recovered, prior year surpluses,

118211 D. For the 1997-98 school year, and each school year
119212 thereafter, Foundation Aid, the Transportatio n Supplement and Salary

122214 1. Foundation Aid shall be determined by subtracting the amount
123215 of the Foundation Program Income from the cost of the Foundation
124216 Program and adding to this difference the Transportation Supplement.

136252 b. The Foundation Program Income shall be the sum of the

139254 (1) The adjusted assessed valuation of the current
140255 school year of the school district, minus the
141256 previous year protested ad valorem tax revenues
142257 held as prescribed in Section 2884 of Title 68 of
143258 the Oklahoma Statutes, multiplied by the mill s
144259 levied pursuant to subsection (c) of Section 9 of
145260 Article X of the Oklahoma Constitution, if
146261 applicable, as adjusted in subsection (c) of
147262 Section 8A of Article X of the Oklahoma
148263 Constitution. For purposes of this subsection,
149264 the "adjusted assessed valua tion of the current
150265 school year" shall be the adjusted assessed
151266 valuation on which tax revenues are collected
152267 during the current school year, and

154268 (2) Seventy-five percent (75%) of the amount received
155269 by the school district from the proceeds of the
156270 county levy during the preceding fiscal year, as

275448 subparagraph b of paragraph 1 of this subsection, not
276449 including the county four -mill levy, by the remainder
277450 of subparagraph b of this paragraph. The product
278451 shall be the Salary Incentive Aid of the district.

280452 E. By June 30, 1998, the State Department of Education shall
281453 develop and the Department and all school districts shall have
282454 implemented a student identification system which is consistent with
283455 the provisions of subsections C and D of Section 3111 of Title 74 of
284456 the Oklahoma Statutes. The student identification system shall be
285457 used specifically for the purpose of reporting enrollment data by
286458 school sites and by school districts, the administration of the
287459 Oklahoma School Testing Program Act, the collection of appropriate
288460 and necessary data pursuant to the Oklahoma Educational Indicators
289461 Program, determining student enrollment, establishing a student
290-mobility rate, allocation of the State Aid Formula and midyear
462+mobility rate, allocation of the State Aid Formula and mid -year
291463 adjustments in funding for student growth. This enrollment data
292464 shall be submitted to the State Department of Education in
293465 accordance with rules promulgated by the State Board of Education.
294466 Funding for the development, implementation, personnel training and
295467 maintenance of the student identification system shall be set out in
296468 a separate line item in the allocation section of the appropriation
297469 bill for the State Board of Education for each year.

299496 F. 1. In the event that ad valorem taxes of a school distri ct
300497 are determined to be uncollectible because of bankruptcy, clerical
301498 error, or a successful tax protest, and the amount of such taxes
302499 deemed uncollectible exceeds Fifty Thousand Dollars ($50,000.00) or
303500 an amount greater than twenty -five percent (25%) of a d valorem taxes
304501 per tax year, or the valuation of a district is lowered by order of
305502 the State Board of Eq ualization, the school district' s State Aid,
306503 for the school year that such ad valorem taxes are calculated in the
307504 State Aid Formula, shall be determine d by subtracting the net
308505 assessed valuation of the property upon which taxes were deemed
309506 uncollectible from the assessed valuation of the school district and
310507 the state. Upon request of the local board of education, it shall
311508 be the duty of the county asses sor to certify to the Director of

316512 2. In the event that the amount of funds a school district
317513 receives for reimbursement from the Ad Valorem Reimbursement Fund is
318514 less than the amount of funds claimed for reimbursement by the
319515 school district due to insufficiency of funds as provided in Section
320516 193 of Title 62 of the Oklahoma Sta tutes, then the school district' s
321517 assessed valuation for the school year that such ad valorem
322518 reimbursement is calculated in the State Aid Formula shall be

325546 G. 1. Notwithstanding the provisions of Section 18 -112.2 of
326547 this title, a school district shall have its State Aid reduced by an
327548 amount equal to the amount of carryover in the general fund of the
328549 district as of June 30 of the preceding fiscal year, that is in

359596 notice the school district shall submit to the Department a written
360597 reply either accepting or protesting the penalty to be assessed
361598 against the district. If protesting, the school district shall
362599 submit with its reply the reasons for rejecting the calculations a nd
363600 documentation supporting those reasons. The Department shall review
364601 all school district penalty protest documentation and notify each
365602 district by March 15 of its finding and the final penalty to be
366603 assessed to each district. General fund balance penal ties shall be
367604 assessed to all school districts by April 1.

369605 3. Any school district which receives proceeds from a tax
370606 settlement or a Federal Emergency Management Agency settlement
371607 during the last two (2) months of the preceding fiscal year shall be
372608 exempt from the penalties assessed in this subsection, if the
373609 penalty would occur solely as a result of receiving funds from the
374610 tax settlement.

376611 4. Any school district which receives an increase in State Aid
377612 because of a change in Foundation and/or Salary Incen tive Aid
378613 factors during the last two (2) months of the preceding fiscal year
379614 shall be exempt from the penalties assessed in this subsection, if
380615 the penalty would occur solely as a result of receiving funds from
381616 the increase in State Aid.

383617 5. If a school district does not receive Foundation and/or
384618 Salary Incentive Aid during the preceding fiscal year, the State
385619 Board of Education may waive the penalty assessed in this subsection

386646 if the penalty would result in a loss of more than forty percent
387647 (40%) of the remaining State Aid to be allocated to the school
388648 district between April 1 and the remainder of the school year and if
389649 the Board determines the penalty will cause the school district not
390650 to meet remaining financial obligations.

392651 6. Any school district which receives gross production revenue
393652 apportionment during the 2002 -2003 school year or in any subsequent
394653 school year that is greater than the gross production revenue
395654 apportionment of the preceding school year shall be exempt from the
396655 penalty assessed in this subsection, if the penalty would occur
397656 solely as a result of the gross production revenue apportionment, as
398657 determined by the State Board of Education.

400658 7. Beginning July 1, 2003, school districts that participate in
401659 consolidation or annexation pursuant t o the provisions of the
402-Oklahoma School Voluntary Consolidation and Annexation Act shall be ENR. H. B. NO. 2890 Page 10
660+Oklahoma School Voluntary Consolidation and Annexation Act shall be
403661 exempt from the penalty assessed in this subsection for the school
404662 year in which the consolidation or annexation occurs and for the
405663 next three (3) fiscal years.

407664 8. Any school district which receives proceeds from a sales tax
408665 levied by a municipality pursuant to Section 22 -159 of Title 11 of
409666 the Oklahoma Statutes or proceeds from a sales tax levied by a
410667 county pursuant to Section 1370 of Title 68 of the Oklahoma Stat utes
411668 during the 2003-2004 school year or the 2004 -2005 school year shall
412669 be exempt from the penalties assessed in this subsection, if the

413696 penalty would occur solely as a result of receiving funds from the
414697 sales tax levy.

416698 9. Any school district which has a n amount of carryover in the
417699 general fund of the district in excess of the limits established in
418700 paragraph 1 of this subsection during the fiscal year years
419701 beginning July 1, 2019 2020, July 1, 2021, July 1, 2022, and July 1,
420702 2023, shall not be assessed a general fund balance penalty as
421703 provided for in this subsection.

423704 10. For purposes of calculating the general fund balance
424705 penalty, the terms "carryover" and "general fund balance" shall not
425706 include federal revenue.
426-
427707 H. In order to provide startup funds fo r the implementation of
428708 early childhood programs, State Aid may be advanced to school
429709 districts that initially start early childhood instruction at a
430710 school site. School districts that desire such advanced funding
431711 shall make application to the State Depar tment of Education no later
432712 than September 15 of each year and advanced funding shall be awarded
433713 to the approved districts no later than October 30. The advanced
434714 funding shall not exceed the per pupil amount of State Aid as
435715 calculated in subsection D of t his section per anticipated Head
436716 Start eligible student. The total amount of advanced funding shall
437717 be proportionately reduced from the m onthly payments of the
438718 district's State Aid payments during the last six (6) months of the

502845 State Aid Formula pursuant to subsection D of this section by
503846 December 1 and by January 15 shall notify each school district of
504847 the district's final State Aid alloca tion for the current school
505848 year. The January payment of State Aid and each subsequent payment
506849 for the remainder of the school year shall be based on the final
507850 State Aid allocation as calculated in subsection D of this section.
508851 Except for reductions made due to the assessment of penalties by the
509852 State Department of Education according to law, the January payment
510853 of State Aid and each subsequent payment for the remainder of the
511854 school year shall not decrease by an amount more than the amount
512855 that the current chargeable revenue increases for that district.

514856 B. The State Department of Education shall retain not less than
515857 one and one-half percent (1 1/2%) of the total funds appropriated
516858 for financial support of schools, to be used to make midyear
517859 adjustments in State Aid and which shall be reflected in the final
518860 allocations. If the amount of appropriated funds, including the one
519861 and one-half percent (1 1/2%) retained, remaining after January 1 of
520862 each year is not sufficient to fully fund the final allocations, the
521863 Department shall recalculate each school district's remaining
522864 allocation pursuant to subsection D of this section using the
523865 reduced amount of appropriated funds.

525866 C. On and after July 1, 1997, the amount of State Aid each
526867 district shall receive shall be the sum of the Foundation Aid, the

7391208 bill for the State Board of Education for each year.

7421210 are determined to be uncollectible because of bankruptcy, clerical
7431211 error, or a successful tax protest, and the amount of such taxes

8161349 tax settlement.

8181350 4. Any school district which receives an increase in State Aid
8191351 because of a change in Foundation and/or Salary Incentive Aid
8201352 factors during the last two (2) months of the preceding fiscal year
8211353 shall be exempt from the penalties assessed in this subsection, if
8221354 the penalty would occur solely as a result of receiving funds f rom
8231355 the increase in State Aid.

8251356 5. If a school district does not receive Foundation and/or
8261357 Salary Incentive Aid during the preceding fiscal year, the State
8271358 Board of Education may waive the penalty assessed in this subsection
8281359 if the penalty would result in a loss of more than forty percent
8291360 (40%) of the remaining State Aid to be allocated to the school
8301361 district between April 1 and the remainder of the school year and if
8311362 the Board determines the penalty will cause the school district not
8321363 to meet remaining fina ncial obligations.

8441399 Oklahoma School Voluntary Consolidation and Annexation Act shall be
8451400 exempt from the penalty assessed in this subsection for the school
8461401 year in which the consolidation or annexation oc curs and for the
8471402 next three (3) fiscal years.
