18	44		community-based services; requiring the promulgation
19	45		of rules; providing for codification; providing an

29	52		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

31	53		SECTION 1. NEW LAW A new section of law to be codifi ed
32	54		in the Oklahoma Statutes as Section 2005 of Title 56, unless there
33	55		is created a duplication in numbering, reads as follows:

35	56		Applications for Home and Community Based Medicaid Waiver
36	57		Services for the Community Waiver, In -Home Supports Waiver for
37	58		Adults, and In-Home Supports Waiver for Children operated by the
38	59		Department of Human Services shall not be made until an applicant
39	60		has been a resident of Oklahoma for five (5) years prior to the date
40	61		of application. The Department of Human Services shall promulga te
41	62		rules as necessary for the implementation and administration of the
42	63		provisions of this section.

44	90		SECTION 2. This act shall become effective July 1, 2021.

46	91		SECTION 3. It being immediately necessary for the preservation
47	92		of the public peace, health or safety, an emergency is hereby
48	93		declared to exist, by reason whereof this act shall take effect and
49	94		be in full force from and after its passage and approval.
