4040 An Act relating to law enforcement; directing the
4141 Oklahoma State Bureau of Investigation to create
4242 certain annual report; directing the Oklahoma Highway
4343 Patrol Division and local law enforcement agencies to
4444 submit use-of-force incidents to the Bureau;
4545 specifying information to be submitted; prohibiting
4646 certain personal identification information from
4747 being reported; making certain data ava ilable to the
4848 public; directing the Bureau to maintain statewide
4949 database; requiring publication of data on website of
5050 the Bureau; providing for suspension of peace officer
5151 certification for noncompliance; defining terms;

5858 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5959 SECTION 1. NEW LAW A new section of law to be codified
6060 in the Oklahoma Statutes as Section 150.21c of Title 74, unless
6161 there is created a du plication in numbering, reads as follows:
6262 A. Beginning July 1, 2023, the Oklahoma State Bureau of
6363 Investigation shall create an annual report regarding use-of-force
6464 incidents involving peace officers in Oklahoma. The report shall
6565 include all of the information that is reported to the Bureau

9292 pursuant to subsection B of this section by law enforcement agencies
9393 that employ peace officers in this state.
9494 B. Beginning January 1, 2023, the Oklahoma Highway Patrol
9595 Division of the Department of Public Safety and each local law
9696 enforcement agency that employs peace officers in this state shall
9797 report to the Bureau:
9898 1. All use of force by its peace officers that results in death
9999 or bodily injury, including:
100100 a. the date, time and location of the use of force,
101101 b. the perceived demographic information of the person
102102 contacted, provided that the identification of these
103103 characteristics is based on the observation and
104104 perception of the peace officer making the c ontact and
105105 other available data,
106106 c. the names of all peace off icers who were at the scene,
107107 identified by whether the peace officer was involved
108108 in the use of force or not , provided that the identity
109109 of other peace officers at the scene not directly
110110 involved in the use of force shall be identified by
111111 the identification number of the officer unless the
112112 peace officer is charged criminally or is a defendant
113113 in a civil suit as a resul t arising from the use of
114114 force,

141141 d. the type of force used, the severity and nature of the
142142 injury, whether the peace officer suffered physica l
143143 injury and the severity of the injury suffered by the
144144 peace officer,
145145 e. whether the peace officer was on duty at the time of
146146 the use of force,
147147 f. whether a peace officer unholstered a weapon during
148148 the incident,
149149 g. whether a peace officer discharged a fi rearm during
150150 the incident,
151151 h. whether the use of force resulted in a law enforcement
152152 agency investigation and the result of the
153153 investigation, and
154154 i. whether the use of force resulted in a citizen
155155 complaint and the resolution of that complaint;
156156 2. All instances when a peace officer resigned while under
157157 investigation or was terminated for violating department policy ;
158158 3. All data relating to contacts conducted by its peace
159159 officers, including:
160160 a. the perceived demographic information of the person
161161 contacted, provided that the identification of these
162162 characteristics is based on the observation and
163163 perception of the peace officer making the contact and
164164 other available data ,

191191 b. whether the contact was a traffic stop,
192192 c. the time, date and location of the contac t,
193193 d. the duration of the contact,
194194 e. the reason for the contact,
195195 f. the suspected crime,
196196 g. the result of the contact, such as:
197197 (1) no action, warning, citation, property seizure or
198198 an arrest,
199199 (2) if a warning or citation was issued, the warning
200200 provided or violation cited,
201201 (3) if an arrest was made, the offense charged , or
202202 (4) if the contact was a traffic stop, the
203203 information collected , which shall include the
204204 driver and contact with any passengers in the
205205 motor vehicle or pedestrians, and
206206 h. the actions taken by the peace officer during the
207207 contact including, but not limited to, whether:
208208 (1) the peace officer asked for consent to search the
209209 person, and, if so, whether consent was provided ,
210210 (2) the peace officer searched the person or any
211211 property, and, if so, the basis for the search
212212 and the type of contraband or evidence
213213 discovered, if any,

240240 (3) the peace officer seized any property and, if so,
241241 the type of property that was seized and the
242242 basis for seizing the property,
243243 (4) a peace officer unholste red a weapon during the
244244 contact, and
245245 (5) a peace officer discharged a firearm during the
246246 contact; and
247247 4. All instances of unannounced entry into a residence, with or
248248 without a warrant, including:
249249 a. the date, time and location of the use of unannounced
250250 entry,
251251 b. the perceived demographic information of the subject
252252 of the unannounced entry, provided that the
253253 identification of these characteristics is based on
254254 the observation and perception of the peace officer
255255 making the entry and other available data,
256256 c. whether a peace officer unholstered a weap on during
257257 the unannounced entry, and
258258 d. whether a peace officer discharged a firearm during
259259 the unannounced entry.
260260 C. The Oklahoma Highway Patrol and local law enforcement
261261 agencies shall not report the name , address, Social Security number
262262 or other unique personal identifying information of the subject of
263263 the use of force, victim of the official misconduct or persons

290290 contacted, searched or subjected to a property seizure. The data
291291 reported pursuant to this section shall be available to the public
292292 pursuant to subsection D of this section.
293293 D. The Oklahoma State Bureau of Investigation shall maintain a
294294 statewide database with data collected pursuant to the provisions of
295295 this section, in a searchable format, and publish the da tabase on
296296 its website.
297297 E. Any local law enforcement agency that fails to meet its
298298 reporting obligations pursuant to the provisions of this section
299299 shall have the certification of its peace officers suspended
300300 indefinitely by the Council on Law Enforcement Education and
301301 Training until compliance with the provisions of this section have
302302 been met.
303303 F. As used in this section:
304304 1. "Law enforcement agency " means any department or agency of
305305 the state, a county, a municipality, or political subdivision
306306 thereof, with the duties to maintain pub lic order, make arrests and
307307 enforce the criminal laws of this state or municipal ordinances,
308308 which employs CLEET-certified personnel; and
309309 2. "Peace officer" shall have the same meaning as that term is
310310 defined in Section 99 of Title 21 of the Okla homa Statutes.
311311 SECTION 2. This act shall become effective November 1, 2021.
