47	47	being reported; making certain data ava ilable to the
48	48	public; directing the Bureau to maintain statewide
49	49	database; requiring publication of data on website of
50	50	the Bureau; providing for suspension of peace officer
51	51	certification for noncompliance; defining terms;
52	52	providing for codification; and pr oviding an

58	58	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
59	59	SECTION 1. NEW LAW A new section of law to be codified
60	60	in the Oklahoma Statutes as Section 150.21c of Title 74, unless
61	61	there is created a du plication in numbering, reads as follows:
62	62	A. Beginning July 1, 2023, the Oklahoma State Bureau of
63	63	Investigation shall create an annual report regarding use-of-force
64	64	incidents involving peace officers in Oklahoma. The report shall
65	65	include all of the information that is reported to the Bureau

92	92	pursuant to subsection B of this section by law enforcement agencies
93	93	that employ peace officers in this state.
94	94	B. Beginning January 1, 2023, the Oklahoma Highway Patrol
95	95	Division of the Department of Public Safety and each local law
96	96	enforcement agency that employs peace officers in this state shall
97	97	report to the Bureau:
98	98	1. All use of force by its peace officers that results in death
99	99	or bodily injury, including:
100	100	a. the date, time and location of the use of force,
101	101	b. the perceived demographic information of the person
102	102	contacted, provided that the identification of these
103	103	characteristics is based on the observation and
104	104	perception of the peace officer making the c ontact and
105	105	other available data,
106	106	c. the names of all peace off icers who were at the scene,
107	107	identified by whether the peace officer was involved
108	108	in the use of force or not , provided that the identity
109	109	of other peace officers at the scene not directly
110	110	involved in the use of force shall be identified by
111	111	the identification number of the officer unless the
112	112	peace officer is charged criminally or is a defendant
113	113	in a civil suit as a resul t arising from the use of
114	114	force,

142	142	injury, whether the peace officer suffered physica l
143	143	injury and the severity of the injury suffered by the
144	144	peace officer,
145	145	e. whether the peace officer was on duty at the time of
146	146	the use of force,
147	147	f. whether a peace officer unholstered a weapon during
148	148	the incident,
149	149	g. whether a peace officer discharged a fi rearm during
150	150	the incident,
151	151	h. whether the use of force resulted in a law enforcement
152	152	agency investigation and the result of the
153	153	investigation, and
154	154	i. whether the use of force resulted in a citizen
155	155	complaint and the resolution of that complaint;
156	156	2. All instances when a peace officer resigned while under
157	157	investigation or was terminated for violating department policy ;
158	158	3. All data relating to contacts conducted by its peace
159	159	officers, including:
160	160	a. the perceived demographic information of the person
161	161	contacted, provided that the identification of these
162	162	characteristics is based on the observation and
163	163	perception of the peace officer making the contact and
164	164	other available data ,

191	191	b. whether the contact was a traffic stop,
192	192	c. the time, date and location of the contac t,
193	193	d. the duration of the contact,
194	194	e. the reason for the contact,
195	195	f. the suspected crime,
196	196	g. the result of the contact, such as:
197	197	(1) no action, warning, citation, property seizure or
198	198	an arrest,
199	199	(2) if a warning or citation was issued, the warning
200	200	provided or violation cited,
201	201	(3) if an arrest was made, the offense charged , or
202	202	(4) if the contact was a traffic stop, the
203	203	information collected , which shall include the
204	204	driver and contact with any passengers in the
205	205	motor vehicle or pedestrians, and
206	206	h. the actions taken by the peace officer during the
207	207	contact including, but not limited to, whether:
208	208	(1) the peace officer asked for consent to search the
209	209	person, and, if so, whether consent was provided ,
210	210	(2) the peace officer searched the person or any
211	211	property, and, if so, the basis for the search
212	212	and the type of contraband or evidence
213	213	discovered, if any,

240	240	(3) the peace officer seized any property and, if so,
241	241	the type of property that was seized and the
242	242	basis for seizing the property,
243	243	(4) a peace officer unholste red a weapon during the
244	244	contact, and
245	245	(5) a peace officer discharged a firearm during the
246	246	contact; and
247	247	4. All instances of unannounced entry into a residence, with or
248	248	without a warrant, including:
249	249	a. the date, time and location of the use of unannounced
250	250	entry,
251	251	b. the perceived demographic information of the subject
252	252	of the unannounced entry, provided that the
253	253	identification of these characteristics is based on
254	254	the observation and perception of the peace officer
255	255	making the entry and other available data,
256	256	c. whether a peace officer unholstered a weap on during
257	257	the unannounced entry, and
258	258	d. whether a peace officer discharged a firearm during
259	259	the unannounced entry.
260	260	C. The Oklahoma Highway Patrol and local law enforcement
261	261	agencies shall not report the name , address, Social Security number
262	262	or other unique personal identifying information of the subject of
263	263	the use of force, victim of the official misconduct or persons

290	290	contacted, searched or subjected to a property seizure. The data
291	291	reported pursuant to this section shall be available to the public
292	292	pursuant to subsection D of this section.
293	293	D. The Oklahoma State Bureau of Investigation shall maintain a
294	294	statewide database with data collected pursuant to the provisions of
295	295	this section, in a searchable format, and publish the da tabase on
296	296	its website.
297	297	E. Any local law enforcement agency that fails to meet its
298	298	reporting obligations pursuant to the provisions of this section
299	299	shall have the certification of its peace officers suspended
300	300	indefinitely by the Council on Law Enforcement Education and
301	301	Training until compliance with the provisions of this section have
302	302	been met.
303	303	F. As used in this section:
304	304	1. "Law enforcement agency " means any department or agency of
305	305	the state, a county, a municipality, or political subdivision
306	306	thereof, with the duties to maintain pub lic order, make arrests and
307	307	enforce the criminal laws of this state or municipal ordinances,
308	308	which employs CLEET-certified personnel; and
309	309	2. "Peace officer" shall have the same meaning as that term is
310	310	defined in Section 99 of Title 21 of the Okla homa Statutes.
311	311	SECTION 2. This act shall become effective November 1, 2021.
