42	47		An Act relating to agriculture; enacting the Oklahoma
43	48		Right to Garden Act of 2022 ; defining terms;
44	49		providing that county, municipal and other political
45	50		subdivisions of the state may not regulate vegetable
46	51		gardens on residential properties ; providing that
47	52		ordinance or regulation that regulates vegetable
48	53		gardens is void and unenforceable ; providing
49	54		exceptions; providing for codification ; and providing

56	61		BE IT ENACTED BY THE PEOPLE OF TH E STATE OF OKLAHOMA:
57	62		SECTION 1. NEW LAW A new section of law to be codified
58	63		in the Oklahoma Statutes as Section 3031 of Title 2, unless there is
59	64		created a duplication in numbering, reads as follows:
60	65		This act shall be known and may b e cited as the "Oklahoma Right
61	66		to Garden Act of 2022 ".

	94	+	SECTION 2. NEW LAW A new s ection of law to be codified

	97	+	As used in this act:
92	98		1. "Vegetable garden" means a piece of property wholly located
93	99		within a person's residential property that is used to grow produce,
94	100		flowers, herbs, fungi , or grains for one's own consumption and
95	101		enjoyment and not for resale or distr ibution; and
96	102		2. "Residential property " means real property on which there is
97	103		a dwelling unit with accommo dations for four or fewer separate
98	104		households and is further limited to the primary residence of a
99	105		person.
100	106		SECTION 3. NEW LAW A new section of law to be codified
101	107		in the Oklahoma Statutes as Section 3033 of Title 2, unless there is
102	108		created a duplication in numbering, reads as follows:
103	109		Except as otherwise provided by law, a county, municipality, or
104	110		other political subdivision of thi s state may not regulate vegetable
105	111		gardens on residential properties. Any such local ordinance or
106	112		regulation regulating vegetable gardens on residential properties is
107	113		void and unenforceable.
108	114		This section does not preclude the adoption of a local ordinance
109	115		or regulation of a general nature that does not specifically
110	116		regulate vegetable gardens, including, but not limited to,
111		-	regulations and ordinances relating to water use during drought
112		-	conditions, fertilizer use, or control of invasive species .
113		-	SECTION 4. This act shall become effective November 1, 2022.
