4247 An Act relating to agriculture; enacting the Oklahoma
4348 Right to Garden Act of 2022 ; defining terms;
4449 providing that county, municipal and other political
4550 subdivisions of the state may not regulate vegetable

5661 BE IT ENACTED BY THE PEOPLE OF TH E STATE OF OKLAHOMA:
5762 SECTION 1. NEW LAW A new section of law to be codified
5863 in the Oklahoma Statutes as Section 3031 of Title 2, unless there is
5964 created a duplication in numbering, reads as follows:
6065 This act shall be known and may b e cited as the "Oklahoma Right
6166 to Garden Act of 2022 ".

94+SECTION 2. NEW LAW A new s ection of law to be codified
95+in the Oklahoma Statutes as Section 3032 of Title 2, unless there is

97+As used in this act:
9298 1. "Vegetable garden" means a piece of property wholly located
9399 within a person's residential property that is used to grow produce,
94100 flowers, herbs, fungi , or grains for one's own consumption and
95101 enjoyment and not for resale or distr ibution; and
96102 2. "Residential property " means real property on which there is
97103 a dwelling unit with accommo dations for four or fewer separate
98104 households and is further limited to the primary residence of a
99105 person.
100106 SECTION 3. NEW LAW A new section of law to be codified
101107 in the Oklahoma Statutes as Section 3033 of Title 2, unless there is
102108 created a duplication in numbering, reads as follows:
103109 Except as otherwise provided by law, a county, municipality, or
104110 other political subdivision of thi s state may not regulate vegetable
105111 gardens on residential properties. Any such local ordinance or
106112 regulation regulating vegetable gardens on residential properties is
107113 void and unenforceable.
108114 This section does not preclude the adoption of a local ordinance
109115 or regulation of a general nature that does not specifically
110116 regulate vegetable gardens, including, but not limited to,
111-regulations and ordinances relating to water use during drought
112-conditions, fertilizer use, or control of invasive species .
113-SECTION 4. This act shall become effective November 1, 2022.
