3838 An Act relating to schools; enacting the Empowering
3939 Parents Over Testing Act of 202 2; enabling parents to
4040 opt their children out of mandatory testing;
4141 prohibiting consequences for students, teachers, and
4242 parents for excusing children from testing;
4343 permitting collection of data by state e ntities;
4444 permitting state entities to encourage taking
4545 standardized tests; providing for codification; and
4646 providing an effective date .

5050 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5151 SECTION 1. NEW LAW A new section of law to be codified in
5252 the Oklahoma Statutes as Section 11-107.2 of Title 70, unless there
5353 is created a duplication in numbering, reads as follows:
5454 This act shall be known and may be cited as the "Empowering
5555 Parents Over Testing Act of 2022".
5656 SECTION 2. NEW LAW A new section of law to be codified in
5757 the Oklahoma Statutes as Section 11-107.3 of Title 70, unless there
5858 is created a duplication in numbering, r eads as follows:
5959 It shall be unlawful for the State Department of Education, any
6060 school district, or any officer or employee of the State Department
6161 of Education or of any school district to:

8888 1. Impose or cause to be imposed on a public school student any
8989 adverse consequences, including, but not limited to, consequences
9090 relating to course grades, grade promotion, graduation, placement in
9191 advanced academic programs, or participation in extracurricular
9292 activities by reason of the public school student having been
9393 excused by his or her parents or guardians from taking any
9494 assessment used to meet the requirements of the federal Elementary
9595 and Secondary Education Act, 20 U.S.C., Sections 6301 through 7981,
9696 as amended by the Every Student Succeeds Act of 2015;
9797 2. Impose or cause to be imposed on a public school teacher any
9898 adverse consequences, including, but not limited to, consequences
9999 relating to teacher evaluations or pay, by reason of one or more of
100100 the teacher's students having been excused by their parents or
101101 guardians from taking any assessment used to meet the requirements
102102 of the federal Elementary and Secondary Education Act, 20 U.S.C.,
103103 Sections 6301 through 7981, as amended by the Every Student Succeeds
104104 Act; or
105105 3. Impose or cause to be imposed on a public school any adverse
106106 consequences, including, but not limited to, consequences relating
107107 to school grades or school interventions, by reason of one or more
108108 of the school's students having been excused by their parents or
109109 guardians from taking any assessment used to meet the requirements
110110 of the federal Elementary and Secondary Education Act, 20 U.S.C.,

139139 SECTION 3. NEW LAW A new sectio n of law to be codified in
140140 the Oklahoma Statutes as Section 11-107.4 of Title 70, unless there

142142 It shall be unlawful for any school district, or any officer or
143143 employee of any school district, to discipline or discharge a
144144 teacher by reason of that teacher having counseled parents,
145145 guardians, and/or students regarding the exercise of any rights this
146146 state may grant parents and guardians to excuse their student from
147147 taking assessments used to meet the requirements of the federal
148148 Elementary and Secondary Education Ac t, 20 U.S.C., Sections 6301
149149 through 7981, as amended by the Every Student Succeeds Act.
150150 SECTION 4. NEW LAW A new section of la w to be codified in
151151 the Oklahoma Statutes as Section 11-107.5 of Title 70, unless there
152152 is created a duplicati on in numbering, reads as follows:
153153 Nothing in this act shall be construed as limiting the State
154154 Department of Education, any school district, or any officer or
155155 employee of the State Department of Education or of any school
156156 district from requiring transparency in school reporting about the
157157 number of students who do not take assessments used to meet the
158158 requirements of the federal Elementary and Secondary Education Act,
159159 20 U.S.C., Sections 6301 through 7981, as amended by the Every

187187 manner that respects student and educator privacy .
188188 SECTION 5. NEW LAW A new sectio n of law to be codified in
189189 the Oklahoma Statutes as S ection 11-107.6 of Title 70, unless there
190190 is created a duplication in numbering, reads as follows:
191191 Nothing in this act should be construed as limiting the State
192192 Department of Education, any school district, or any officer or
193193 employee of the State Department of Education or of any school
194194 district from encouraging test participation of all students and
195195 subgroups of students at a rate of ninety-five percent (95%) or more
196196 on federally required tests by providing to parents and guardians
197197 evidence of educational benefits of test participation.
198198 SECTION 6. This act shall become effective November 1, 2022.
