4040 An Act relating to education; prohibiting the use of
4141 the 1619 Project in certain institutions; prohibiting
4242 teaching certain concepts pertaining to America and
4343 slavery; providing penalties for violation;
4444 preempting field of study; nullifying subsequent
4545 federal action; providing for codification; and
4646 providing an effective date .

5252 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5353 SECTION 1. NEW LAW A new section of law to be codified
5454 in the Oklahoma Statutes as Section 24-159 of Title 70, unless there
5555 is created a duplication in numbering, reads as follows:
5656 A. No state agency, school district, charter school, online
5757 instruction funded in any manner by the Oklahoma Legislature, or
5858 personnel or agent of such state agency, school district, charter
5959 school, or online instruction shall teach , use, or provide for use
6060 by any pupil any curric ula, instructional mater ials, or assignments
6161 designed to teach components of the 1619 Project as part of any
6262 curricula, course syllabi, or instruction in any course or program
6363 of study, including:

9090 1. Any teaching that America has more culpability, in gene ral,
9191 than other nations for the institution of slavery ;
9292 2. That one race is the unique oppr essor in the institution of
9393 slavery;
9494 3. That another race is the unique victim in the institution of
9595 slavery;
9696 4. That America, in gen eral, had slavery more extensive ly and
9797 for a later period of time than other nations ; or
9898 5. The primary and overarching pur pose for the founding of
9999 America was the initiation and perpetu ation of slavery.
100100 B. If the State Board of Education determines that a publicly
101101 funded local education agency or online program of instruction has
102102 violated this section, the Board shall notify the entity of its
103103 violation.
104104 C. If the entity fails to comply with this section within
105105 thirty (30) days of notification of its failure to comply under this
106106 section, the Board shall direct the State Department of Education to
107107 withhold a maximum of five percent (5%) of the monthly distribution
108108 of state formula funding to the education entity. Once the Board
109109 determines that the education entity has complied with this section,
110110 the Department shall restore the distribution of funding to its
111111 original amount.
112112 D. If the Attorney General determines that a sta te-supported
113113 two-year or four-year institution of higher education has violated

140140 this section, the Attorney General shall notify the institution of
141141 its violation.
142142 E. If a state-supported two-year or four-year institution of
143143 higher education fails to comply with this sec tion within thirty
144144 (30) days of notification of its failure to comply under this
145145 section, the Attorney General may direct the Oklahoma State Regents
146146 for Higher Education to withhold a maximum of ten percent (10%) of
147147 the distribution of state funding to the institution.
148148 F. Once the Attorney General determines that a state -supported
149149 two-year or four-year institution of higher education has complied
150150 with this section, the Attorney General shall restore the
151151 distribution of state funding for the institutio n to its original
152152 amount.
153153 G. This section shall not be construed to inhibit or violate
154154 the First Amendment rights of students or faculty, or undermine a
155155 public institution of higher ed ucation's duty to protect to the
156156 fullest degree intellectual freedom and free expression, and the
157157 intellectual vitality of students and faculty shall not be
158158 infringed.
159159 H. The State Legislature hereby occupies and preempts the
160160 entire field of legislation i n this state touching in any way the
161161 teaching of the 1619 Project or the concepts listed in subsection A
162162 of this section to the complete exclusion of any order, ordinance,

189189 or regulation by any municipality or other political subdivision of
190190 this state.
191191 I. Any federal statute, rule, or executive order, federal or
192192 state judicial order or judicial findings that would have the effect
193193 of forcing the teaching of the 1619 Project or the concepts listed
194194 in subsection A of this section shall be null, void, unenforce able
195195 and of no effect in the State of Oklahoma.
196196 SECTION 2. This act shall become effective November 1, 2022.
