101 | 101 | | artificial intelligence techniques, used to determine the order or |
---|
102 | 102 | | manner that a set of information is provided to a user on a covered |
---|
103 | 103 | | Internet platform, including the ranking of search results, the |
---|
104 | 104 | | provision of content recommendations, the display of social media |
---|
105 | 105 | | posts, or any other method of automated content selection ; |
---|
106 | 106 | | 2. "Commission" means the Federal Trade Commis sion; |
---|
107 | 107 | | 3. "Connected device" means a physical object that: |
---|
108 | 108 | | a. is capable of connecting to the Internet, either |
---|
109 | 109 | | directly or indirectly through a network, to |
---|
110 | 110 | | communicate information at the direction of an |
---|
111 | 111 | | individual, and |
---|
112 | 112 | | b. has computer processing capabilit ies for collecting, |
---|
113 | 113 | | sending, receiving, or analyzing data; |
---|
114 | 114 | | 4. "Covered Internet platform" means any public-facing website, |
---|
115 | 115 | | Internet application, or mobile app lication, including a social |
---|

151 | 151 | | in annual gross receipts, and |

152 | 152 | | (3) collects or processes on an annual basis the |

153 | 153 | | personal data of less than one million |
---|

155 | 155 | | b. is operated for the sole pu rpose of conducting |

156 | 156 | | research that is not made for profit either directly |
---|
157 | 157 | | or indirectly; |

158 | 158 | | 5. "Downstream provider" means, with respect to a search |
---|
159 | 159 | | syndication contract, the person that receives access to an index of |
---|
160 | 160 | | webpages on the Internet from an upstream provider under such |
---|
161 | 161 | | contract; |
---|
162 | 162 | | 6. a. "Input-transparent algorithm " means an algorithmic |
---|
163 | 163 | | ranking system that does not use the user-specific data of a user to |
---|
164 | 164 | | determine the order or manner that infor mation is furnished to such |

199 | 199 | | c. For purposes of subparagraph a of this paragraph, |

200 | 200 | | user-specific data that is provided by a user for the |
---|
201 | 201 | | express purpose of determining the order or manner |
---|
202 | 202 | | that information is furnished to a user on a covered |
---|
203 | 203 | | Internet platform, |
---|
204 | 204 | | (1) shall include user-supplied search terms, |
---|
205 | 205 | | filters, speech patterns (if provided for the |
---|
206 | 206 | | purpose of enabling the platform to a ccept spoken |
---|
207 | 207 | | input or selecting the language in which the user |
---|
208 | 208 | | interacts with the platform ), saved preferences, |
---|
209 | 209 | | and the user's current geographical location , |
---|
210 | 210 | | (2) shall include data supplied to the platform by |
---|
211 | 211 | | the user that expresses the user's desire that |
---|
212 | 212 | | information be furnished to them, s uch as the |
---|
213 | 213 | | social media profiles the user follows, the video |

249 | 249 | | whether such inferences are based on data |

250 | 250 | | described in division (1) of this subparagraph; |

251 | 251 | | 7. a. "Opaque algorithm" means an algorithmic ranking sy stem |
---|
252 | 252 | | that determines the order or manner that infor mation |
---|
253 | 253 | | is furnished to a user on a covered Internet platform |
---|
254 | 254 | | based, in whole or part, on user-specific data that |
---|
255 | 255 | | was not expressly provided by the user to the platform |
---|
256 | 256 | | for such purpose. |
---|
257 | 257 | | b. The term opaque algorithm shall not include an |
---|
258 | 258 | | algorithmic ranking s ystem used by a covered Internet |
---|
259 | 259 | | platform if: |
---|
260 | 260 | | (1) the only user-specific data, including inferences |
---|
261 | 261 | | about the user, that the system uses is |
---|
262 | 262 | | information relating to the age of t he user, and |
---|

297 | 297 | | 9. "Upstream provider" means, with respect to a search |

298 | 298 | | syndication contract, the person that grants access to an index of |
---|
299 | 299 | | webpages on the Internet to a downstream provider under the |
---|
300 | 300 | | contract; and |
---|
301 | 301 | | 10. "User-specific data" means information relating to an |
---|
302 | 302 | | individual or specific connected device that would not necessarily |
---|
303 | 303 | | be true of every individual or device. |
---|
304 | 304 | | SECTION 4. NEW LAW A new section of law to be codified |
---|

307 | 307 | | A. Beginning one (1) year after the date o f enactment of this |
---|
308 | 308 | | act, it shall be unlawful : |

309 | 309 | | 1. For any person to operate a covered Internet platform that |
---|
310 | 310 | | uses an opaque algorithm unless the person co mplies with the |
---|
311 | 311 | | requirements of subsection B of this section; or |

345 | 345 | | a. the person provides notice to users of the platform |
---|
346 | 346 | | that the platform uses an opaqu e algorithm that makes |
---|
347 | 347 | | inferences based on user-specific data to select the |
---|
348 | 348 | | content the user sees. Such notice shall be presented |
---|
349 | 349 | | in a clear, conspicuous manner on the platform |
---|
350 | 350 | | whenever the user interacts with an opaque algorithm |
---|
351 | 351 | | for the first time, and may be a one-time notice that |
---|
352 | 352 | | can be dismissed by the user, and |
---|
353 | 353 | | (b) the person makes available a version of the platform |
---|
354 | 354 | | that uses an input-transparent algorithm and enables |
---|
355 | 355 | | users to easily switch be tween the version of the |
---|
356 | 356 | | platform that uses an opaque algorithm and the version |
---|
357 | 357 | | of the platform that uses the input-transparent |
---|
358 | 358 | | algorithm by selecting a prominently placed icon, |
---|
359 | 359 | | which shall be displayed wherever the user interacts |
---|
360 | 360 | | with an opaque algorithm. |

394 | 394 | | C. The requirements of this subsection w ith respect to a search |
---|
395 | 395 | | syndication contract are that: |
---|
396 | 396 | | 1. As part of the contract, the upstream provider makes |
---|
397 | 397 | | available to the downstream provider the same input-transparent |
---|
398 | 398 | | algorithm used by the upstream provider for purposes of complying |
---|
399 | 399 | | with subparagraph b of paragraph 1 of subsection B of this section; |
---|
400 | 400 | | and |
---|
401 | 401 | | 2. The upstream provider does not impose any additional costs, |
---|
402 | 402 | | degraded quality, reduced speed, or other constraint on the |
---|
403 | 403 | | functioning of such algorithm when used by the downstream provider |
---|
404 | 404 | | to operate an Internet search engine relative to the performance of |
---|
405 | 405 | | such algorithm when used by the upstream provider to operate an |
---|
406 | 406 | | Internet search engine. |
---|
407 | 407 | | SECTION 5. NEW LAW A new sec tion of law to be codified |

---|
437 | 437 | | exclusively in a court of competent jurisdi ction in a civil action |

439 | 439 | | Attorney General or by any district attorney. This act shall not be |
---|
440 | 440 | | deemed to create a p rivate right of action or limit any existing |
---|
441 | 441 | | private right of actio n. |
---|
442 | 442 | | B. A court may enjoin a person who knowingly engages, has |
---|
443 | 443 | | engaged, or proposes to engage in a violation of this act. The |
---|
444 | 444 | | court may make any orders or judgments as may be necessary to |
---|
445 | 445 | | prevent a violation of this act. |
---|
446 | 446 | | C. A person who knowingly engages, has engag ed, or proposes to |
---|
447 | 447 | | engage in a violation of this act shall be liable for a civil |
---|
448 | 448 | | penalty not to exceed Two Thousand Five Hundred Dollars ($2,500.00) |
---|
449 | 449 | | for each profile on the platform in noncompliance with this act. If |
---|
450 | 450 | | the action is brought by the Attorney General, the pe nalty shall be |
---|
451 | 451 | | deposited into the Governmental Budget Account. If the action is |
---|
452 | 452 | | brought by a district attorney, the penalty shall be paid to the |
---|
453 | 453 | | treasurer of the county in which th e judgment was entered . |
---|
454 | 454 | | SECTION 6. This act shall become e ffective November 1, 2022. |
