5656 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5757 SECTION 1. NEW LAW A new section of law not to be
5858 codified in the Oklahoma Statutes reads as follows:
5959 In publishing the decennial Oklahoma Statu tes, and the
6060 cumulative supplements after July 1, 2022, West Publishing Company
6161 shall include in such decennial statutes a nd supplements a new Title
6262 75A, to be designated "Technology".
6363 SECTION 2. NEW LAW A new section of law to be c odified

9292 This act may be known and cited as the "Filter Bubble
9393 Transparency Act of 2022 ".
9494 SECTION 3. NEW LAW A new section of law to be codified
9595 in the Oklahoma Statutes as Section 152 of Title 75A, unless there
9696 is created a duplication in numbering, reads as follows:
9797 As used in this act:
9898 1. "Algorithmic ranking system " means a computational process,
9999 including one derived from a lgorithmic decision-making, machine
100100 learning, statistical analysis, or other dat a processing or
101101 artificial intelligence techniques, used to determine the order or
102102 manner that a set of information is provided to a user on a covered
103103 Internet platform, including the ranking of search results, the
104104 provision of content recommendations, the display of social media
105105 posts, or any other method of automated content selection ;
106106 2. "Commission" means the Federal Trade Commis sion;
107107 3. "Connected device" means a physical object that:
108108 a. is capable of connecting to the Internet, either
109109 directly or indirectly through a network, to
110110 communicate information at the direction of an
111111 individual, and
112112 b. has computer processing capabilit ies for collecting,
113113 sending, receiving, or analyzing data;
114114 4. "Covered Internet platform" means any public-facing website,
115115 Internet application, or mobile app lication, including a social

143143 aggregation service. The term covered Internet platform shall not
144144 include a platform that:
145145 a. is wholly owned, controll ed, and operated by a person
146146 that:
147147 (1) for the most recent six-month period, did not
148148 employ more than five hundred (500) employees,
149149 (2) for the most recent three-year period, averaged
150150 less than Fifty Million Dollars ($50,000,000.00)
151151 in annual gross receipts, and
152152 (3) collects or processes on an annual basis the
153153 personal data of less than one million
154154 individuals, or
155155 b. is operated for the sole pu rpose of conducting
156156 research that is not made for profit either directly
157157 or indirectly;
158158 5. "Downstream provider" means, with respect to a search
159159 syndication contract, the person that receives access to an index of
160160 webpages on the Internet from an upstream provider under such
161161 contract;
162162 6. a. "Input-transparent algorithm " means an algorithmic
163163 ranking system that does not use the user-specific data of a user to
164164 determine the order or manner that infor mation is furnished to such

191191 user on a covered Internet platform, unless the user -specific data
192192 is expressly provided to the platform by the user for such purpose .
193193 b. The term input-transparent algorithm shall include an
194194 algorithmic ranking system that us es user-specific
195195 data to determine whether a user is old enough to
196196 access age-restricted content on a cove red Internet
197197 platform; provided that the system otherwise meets the
198198 requirements of subparagraph a of this paragraph,
199199 c. For purposes of subparagraph a of this paragraph,
200200 user-specific data that is provided by a user for the
201201 express purpose of determining the order or manner
202202 that information is furnished to a user on a covered
203203 Internet platform,
204204 (1) shall include user-supplied search terms,
205205 filters, speech patterns (if provided for the
206206 purpose of enabling the platform to a ccept spoken
207207 input or selecting the language in which the user
208208 interacts with the platform ), saved preferences,
209209 and the user's current geographical location ,
210210 (2) shall include data supplied to the platform by
211211 the user that expresses the user's desire that
212212 information be furnished to them, s uch as the
213213 social media profiles the user follows, the video

240240 channels the user subscribes to, or other sources
241241 of content on the platform the user fol lows,
242242 (3) shall not include the history of the user's
243243 connected device, including the user's history of
244244 web searches and browsing, geographical
245245 locations, physical activity, device interaction,
246246 and financial transactions , and
247247 (4) shall not include inferences about the user or
248248 the user's connected device, without regard to
249249 whether such inferences are based on data
250250 described in division (1) of this subparagraph;
251251 7. a. "Opaque algorithm" means an algorithmic ranking sy stem
252252 that determines the order or manner that infor mation
253253 is furnished to a user on a covered Internet platform
254254 based, in whole or part, on user-specific data that
255255 was not expressly provided by the user to the platform
256256 for such purpose.
257257 b. The term opaque algorithm shall not include an
258258 algorithmic ranking s ystem used by a covered Internet
259259 platform if:
260260 (1) the only user-specific data, including inferences
261261 about the user, that the system uses is
262262 information relating to the age of t he user, and

289289 (2) such information is onl y used to restrict a
290290 user's access to content on the basis that the
291291 individual is not old enough to access such
292292 content;
293293 8. "Search syndication contract" means a contract or
294294 subcontract for the sale, license, or other right to access an index
295295 of webpages on the Internet for the purpose of operating an Internet
296296 search engine;
297297 9. "Upstream provider" means, with respect to a search
298298 syndication contract, the person that grants access to an index of
299299 webpages on the Internet to a downstream provider under the
300300 contract; and
301301 10. "User-specific data" means information relating to an
302302 individual or specific connected device that would not necessarily
303303 be true of every individual or device.
304304 SECTION 4. NEW LAW A new section of law to be codified
305305 in the Oklahoma Statutes as Section 153 of Title 75A, unless there
306306 is created a duplication in num bering, reads as follows:
307307 A. Beginning one (1) year after the date o f enactment of this
308308 act, it shall be unlawful :
309309 1. For any person to operate a covered Internet platform that
310310 uses an opaque algorithm unless the person co mplies with the
311311 requirements of subsection B of this section; or

338338 2. For any upstream provider to grant access to an index of
339339 webpages on the Internet under a search syndication contract that
340340 does not comply with the requirements of subsection C of this
341341 section.
342342 B. 1. The requirements of this subsection with respect to a
343343 person that operates a covered Internet platform that uses an opaq ue
344344 algorithm are the following:
345345 a. the person provides notice to users of the platform
346346 that the platform uses an opaqu e algorithm that makes
347347 inferences based on user-specific data to select the
348348 content the user sees. Such notice shall be presented
349349 in a clear, conspicuous manner on the platform
350350 whenever the user interacts with an opaque algorithm
351351 for the first time, and may be a one-time notice that
352352 can be dismissed by the user, and
353353 (b) the person makes available a version of the platform
354354 that uses an input-transparent algorithm and enables
355355 users to easily switch be tween the version of the
356356 platform that uses an opaque algorithm and the version
357357 of the platform that uses the input-transparent
358358 algorithm by selecting a prominently placed icon,
359359 which shall be displayed wherever the user interacts
360360 with an opaque algorithm.

387387 2. Paragraph 1 of this subsection shall not apply with re spect
388388 to an Internet search engine if:
389389 a. the search engine is operated by a downstream provider
390390 with fewer than one thousand employees, and
391391 b. the search engine uses an index of webpages on the
392392 Internet to which such provider rec eived access under
393393 a search syndication contract.
394394 C. The requirements of this subsection w ith respect to a search
395395 syndication contract are that:
396396 1. As part of the contract, the upstream provider makes
397397 available to the downstream provider the same input-transparent
398398 algorithm used by the upstream provider for purposes of complying
399399 with subparagraph b of paragraph 1 of subsection B of this section;
400400 and
401401 2. The upstream provider does not impose any additional costs,
402402 degraded quality, reduced speed, or other constraint on the
403403 functioning of such algorithm when used by the downstream provider
404404 to operate an Internet search engine relative to the performance of
405405 such algorithm when used by the upstream provider to operate an
406406 Internet search engine.
407407 SECTION 5. NEW LAW A new sec tion of law to be codified
408408 in the Oklahoma Statutes as Section 154 of Title 75A, unless there
409409 is created a duplication in numbering, reads as follows:

436436 A. Actions for relief purs uant to this act may be prosecuted
437437 exclusively in a court of competent jurisdi ction in a civil action
438438 brought in the name of the people of the State of Oklahoma by the
439439 Attorney General or by any district attorney. This act shall not be
440440 deemed to create a p rivate right of action or limit any existing
441441 private right of actio n.
442442 B. A court may enjoin a person who knowingly engages, has
443443 engaged, or proposes to engage in a violation of this act. The
444444 court may make any orders or judgments as may be necessary to
445445 prevent a violation of this act.
446446 C. A person who knowingly engages, has engag ed, or proposes to
447447 engage in a violation of this act shall be liable for a civil
448448 penalty not to exceed Two Thousand Five Hundred Dollars ($2,500.00)
449449 for each profile on the platform in noncompliance with this act. If
450450 the action is brought by the Attorney General, the pe nalty shall be
451451 deposited into the Governmental Budget Account. If the action is
452452 brought by a district attorney, the penalty shall be paid to the
453453 treasurer of the county in which th e judgment was entered .
454454 SECTION 6. This act shall become e ffective November 1, 2022.
