40	40	An Act relating to higher education; prohibiting
41	41	state educational insti tutions from refusing to
42	42	provide certain student transcripts; banning
43	43	conditional release of transcripts; proscribing
44	44	higher fees or less favorable treatment for certain
45	45	requests; defining term; construing provision;
46	46	providing for codification ; and providing an
47	47	effective date.

54	54	BE IT ENACTED BY THE PEOP LE OF THE STATE OF OKLAHOMA:
55	55	SECTION 1. NEW LAW A new section of law to be codified
56	56	in the Oklahoma Statutes as Section 3218.16 of Title 70, unless
57	57	there is created a duplication in numbering, reads as follows:
58	58	A. A state educational institution within The Oklahoma State
59	59	System of Higher Education shall not:
60	60	1. Refuse to provide a transcript of a current or former
61	61	student on the grounds that the student owes a debt to the
62	62	institution;
63	63	2. Condition the provision of a transcript on the payment of a
64	64	debt, other than a fee charged to provide the transcript ; or

91	91	3. Charge a higher fee for obtain ing a transcript or provide
92	92	less favorable treatment of a transcript request because a current
93	93	or former student owes a debt to the institution.
94	94	B. As used in this section, "debt" means any money, obligation,
95	95	claim, or sum, due or owing, or alleged to be due or owing, from a
96	96	current or former student, but shall not include the fee, if any,
97	97	charged to all students for the actual costs of providin g
98	98	transcripts.
99	99	C. Nothing in this section shall be construed to require the
100	100	institution to forgive or cancel a debt owed by a current or former
101	101	student to the institution.
102	102	SECTION 2. This act shall become effective November 1, 2022.
