40	40	An Act relating to elections; amending 26 O.S. 2021,
41	41	Section 4-101, which relates to persons entitled to
42	42	be registered voters; requiring certain agencies to
43	43	determine when persons conv icted of a felony have
44	44	regained eligibility to vote ; providing for notice
45	45	and registration application; authorizing Secretary
46	46	to promulgate rules; and providing an effective date .

52	52	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
53	53	SECTION 1. AMENDATORY 26 O.S. 2021, Section 4 -101, is
54	54	amended to read as follows:
55	55	Section 4-101. A. Every person who is a qualified elector as
56	56	defined by Section 1 of Article III of the Okla homa Constitution
57	57	shall be entitled to become a registered voter in the precinct of
58	58	his or her residence, with the following conditions:
59	59	1. Persons convicted of a felony shall be eligible to register
60	60	to vote when they have fully served their sentence of c ourt-mandated
61	61	calendar days, including any term of incarceration, parole or
62	62	supervision, or completed a period of probation ordered by any
63	63	court; and

90	90	2. Any person who has been adjudged to be an incapacitated
91	91	person as such term is defined by Section 1 -111 of Title 30 of the
92	92	Oklahoma Statutes shall be ineligible to register to vote. When
93	93	such incapacitated person has been adjudged to be no longer
94	94	incapacitated such person shall be eligible to become a registe red
95	95	voter. The provisions of this paragraph sh all not prohibit any
96	96	person adjudged to be a partially incapacitated person as such term
97	97	is defined by Section 1-111 of Title 30 of the Oklahoma Statutes
98	98	from being eligible to register to vote unless the orde r adjudging
99	99	the person to be partially incapaci tated restricts such per son from
100	100	being eligible to register to vote.
101	101	B. The Secretary of State Election Board shall coordinate with
102	102	the Oklahoma State Bureau of Investigation, the Department of Public
103	103	Safety, the Administrative Office of t he Courts, and any other
104	104	relevant agency to determine when a person described in paragraph 1
105	105	of subsection A of this section has regained eligibility to vote .
106	106	C. When the person described in paragraph 1 of subsection A of
107	107	this section regains eligibility to vote, the Secretary shall use
108	108	his or her best efforts to provide the person with:
109	109	1. Notice informing the person in plain language that the
110	110	person may be eligible to register to vote, including
111	111	instructions for registration; and
112	112	2. A voter registration app lication.
113	113	D. The Secretary shall promulgate rules as necessary to

141	141	SECTION 2. This act shall become effective November 1, 2022.
