4040 An Act relating to elections; amending 26 O.S. 2021,

5252 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5353 SECTION 1. AMENDATORY 26 O.S. 2021, Section 4 -101, is
5454 amended to read as follows:
5555 Section 4-101. A. Every person who is a qualified elector as
5656 defined by Section 1 of Article III of the Okla homa Constitution
5757 shall be entitled to become a registered voter in the precinct of
5858 his or her residence, with the following conditions:
5959 1. Persons convicted of a felony shall be eligible to register
6060 to vote when they have fully served their sentence of c ourt-mandated
6161 calendar days, including any term of incarceration, parole or
6262 supervision, or completed a period of probation ordered by any
6363 court; and

9090 2. Any person who has been adjudged to be an incapacitated
9191 person as such term is defined by Section 1 -111 of Title 30 of the
9292 Oklahoma Statutes shall be ineligible to register to vote. When
9393 such incapacitated person has been adjudged to be no longer
9494 incapacitated such person shall be eligible to become a registe red
9595 voter. The provisions of this paragraph sh all not prohibit any
9696 person adjudged to be a partially incapacitated person as such term
9797 is defined by Section 1-111 of Title 30 of the Oklahoma Statutes
9898 from being eligible to register to vote unless the orde r adjudging
9999 the person to be partially incapaci tated restricts such per son from
100100 being eligible to register to vote.
101101 B. The Secretary of State Election Board shall coordinate with
102102 the Oklahoma State Bureau of Investigation, the Department of Public
103103 Safety, the Administrative Office of t he Courts, and any other
104104 relevant agency to determine when a person described in paragraph 1
105105 of subsection A of this section has regained eligibility to vote .
106106 C. When the person described in paragraph 1 of subsection A of
107107 this section regains eligibility to vote, the Secretary shall use
108108 his or her best efforts to provide the person with:
109109 1. Notice informing the person in plain language that the
110110 person may be eligible to register to vote, including
111111 instructions for registration; and
112112 2. A voter registration app lication.
113113 D. The Secretary shall promulgate rules as necessary to
