40	40	An Act relating to medical price transparency;
41	41	amending 63 O.S. 2021, Section 1-725.3, which relates
42	42	to health care provider price transparency; creating
43	43	penalties; providing for the allocation of penalties ;
44	44	amending 63 O.S. 2021, Section 1-725.4, which relates
45	45	to health care facility price transparency; creating
46	46	penalties; providing for the allocation of penalties;

54	54	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
55	55	SECTION 1. AMENDATORY 63 O.S. 2021, Section 1-725.3, is
56	56	amended to read as follows :
57	57	Section 1-725.3 A. A health care provider shall make available
58	58	to the public, in a single do cument, either electronically o r by
59	59	posting conspicuously on the provider 's website if one exists, the
60	60	health care prices for at least the twenty most commo n health care
61	61	services the health care prov ider provides. If the health care
62	62	provider, in the norma l course of his or her practice , regularly
63	63	provides fewer than twenty health care services, the health care

90	90	provider shall make available the health care pr ices for the health
91	91	care services the provi der most commonly provides.
92	92	B. The health care provider shall identify the services by:
93	93	1. A Current Procedural Terminology code or other coding system
94	94	commonly used by the health care provider and accepted as a national
95	95	standard for billing; and
96	96	2. A plain English description.
97	97	C. The health care provider shall update the document as
98	98	frequently as the health care provider deems appropriate, but at
99	99	least annually.
100	100	D. A health care provider not in complia nce with the
101	101	Transparency in Health Care Prices Ac t shall be assessed a penalty
102	102	in the following amounts:
103	103	1. One Thousand Dollars ($1,000.00) per month for health care
104	104	providers with ten or fewer licensed health care profession als; or
105	105	2. Ten Dollars ($10.00) for each licensed health care
106	106	professional per month for health care providers wit h more than ten
107	107	licensed health care professionals. This penalty shall not exceed
108	108	Ten Thousand Dollars ($10,000.00) per month.
109	109	E. Penalties shall be collected by the State Department of
110	110	Health and deposited into the Health Carrier Access Payment
111	111	Revolving Fund pursuant to Section 7202 of Title 36 of the Oklahoma
112	112	Statutes.

139	139	SECTION 2. AMENDATORY 63 O.S. 2021, Section 1-725.4, is
140	140	amended to read as foll ows:
141	141	Section 1-725.4 A. A health care facilit y shall make available
142	142	to the public, in a single document, either electronica lly or by
143	143	posting conspicuously on its website if one exists, the health care
144	144	prices for at least:
145	145	1. The twenty most used diagnosis -related group codes or other
146	146	codes for inpatient health care services per specia lty service line
147	147	used by the health care f acility for billing; and
148	148	2. The twenty most used outpatient CPT codes or health care
149	149	services procedure codes per specialty service line used for
150	150	billing.
151	151	B. A health care facility shall include with the health c are
152	152	prices provided pursuant to subsection A of this section a plain
153	153	English description of the services for which the health ca re prices
154	154	are provided.
155	155	C. The health care facility shall update the document as
156	156	frequently as it deems appropriate, but at lea st annually.
157	157	D. A health care facility not in compliance with the
158	158	Transparency in Health Care Prices Act shall be assessed a penalty
159	159	in the following amounts:
160	160	1. Three Hundred Dollars ($300.00) per day for a facility with
161	161	thirty or fewer beds; or

188	188	2. Ten Dollars ($10.00) for each bed per day for facilit ies
189	189	with more than thirty beds. This penalty shall not exceed Five
190	190	Thousand Five Hundred Dollars ($5,500.00) per day.
191	191	E. Penalties shall be collected by the State Department of
192	192	Health and deposited into the Health Carrier Access Payment
193	193	Revolving Fund pursuant to Section 7202 of Title 36 of the Oklahoma
194	194	Statutes.
195	195	SECTION 3. This act shall become effective November 1, 2022.
