56	56	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOM A:
57	57	SECTION 1. AMENDATORY 70 O.S. 2021, Section 6 -204.2, is
58	58	amended to read as follows:
59	59	Section 6-204.2 A. The Oklahoma Commission for Teacher
60	60	Preparation Educational Quality and Accountability and the State
61	61	Board of Education ar e authorized to establish the E ducation
62	62	Leadership Oklahoma program.
63	63	B. The purposes of the Education Leadership O klahoma program
64	64	are to:

92	92	National Board certification and the Education Leadership Oklahoma
93	93	program services;
94	94	2. Provide technical assistance and National -Board-certified
95	95	mentors to all teachers s eeking National Board certification upon
96	96	request;
97	97	3. Reward teachers who are seeking National Board certification
98	98	by awarding them a portion of the application processing charge and
99	99	assessment fee and scholarship as provided in subsection D of this
100	100	section; and
101	101	4. Provide recognition to National -Board-certified teachers.
102	102	C. To fulfill the objectives of the Education Leadership
103	103	Oklahoma Act, the Oklahoma Commission for Teacher Preparation
104	104	Educational Quality and Accountability shall:
105	105	1. Inform teachers of the Education Leadership Oklahoma pro gram
106	106	and services it provides to teachers seeking National Board
107	107	certification, emphasizing recruiting efforts toward teachers at
108	108	high-poverty schools, schools identified as in need of improvement
109	109	and in counties with the lowest percentage of teachers who have
110	110	achieved National Board certification; and
111	111	2. Ensure that all teachers seeking National Board
112	112	certification receive adequate in formation regarding the level of
113	113	commitment required to acquire National Board certification.

140	140	D. The Commission shall sele ct not more than one hun dred
141	141	applicants to participate in the program each fiscal year for whom
142	142	the Commission shall pay one -half (1/2) of the application
143	143	processing charge and assessment fee for National Board
144	144	certification. The total amount paid by the Commission shall not
145	145	exceed One Thousand Three Hundred Dollars ($1,300.00). In addition
146	146	the Commission shall also provide to the sel ected applicants a
147	147	scholarship in the amount of Five Hundred Dollars ($500.00) to cover
148	148	other expenses associated with obta ining National Board
149	149	certification.
150	150	E. The Commission shall promulgate rules establishing a process
151	151	for accepting applications for t he Education Leadership Oklahoma
152	152	program and for providing to applicants selected for the program up -
153	153	front payment of the a pplication processing ch arge and assessment
154	154	fee and scholarship. If a selected applicant who receives the up-
155	155	front payment does not complete National Board certification within
156	156	three (3) years, the applicant shall repay the Commission the full
157	157	amount paid by the Commission pursu ant to subsection D of this
158	158	section. All selected applicants who do not recei ve an up-front
159	159	payment and successfully complete National Board certification shall
160	160	be reimbursed by the Commission for the application processing
161	161	charge and assessment fee. The total amount of reimbursement paid
162	162	by the Commission shall not exceed One Tho usand Three Hundred
163	163	Dollars ($1,300.00).

190	190	F. It is the intent of the Legislature that the Oklahoma
191	191	Commission for Teacher Preparation Educational Quality and
192	192	Accountability contract with Southeastern Oklahoma State University
193	193	to establish Education Leaders hip Oklahoma program training i n
194	194	higher education teacher preparation programs in the state to assist
195	195	teachers in meeting the requirements to obtain National Board
196	196	certification.
197	197	G. All teachers seeking National Board certification shall be
198	198	eligible to participate in Education Leadersh ip Oklahoma program
199	199	training to assist them in meeting the requirements of the National
200	200	Board certification process, free of charge.
201	201	H. Subject to district board of education policy or collective
202	202	bargaining agreement, additi onal professional leave days ma y be
203	203	granted to teachers seeking National Board certification for
204	204	National Board certification portfolio development. During the two
205	205	(2) days of the additional professional days granted to teachers for
206	206	National Board certifi cation portfolio development, a substitute
207	207	teacher shall be provided by the school district at no cost to the
208	208	teacher.
209	209	I. 1. The State Board of Education shall provide to teach ers
210	210	who attained National Board certification prior to June 30, 2013, a
211	211	bonus in the amount of Five Thousand Dollars ($5,000.00) annually
212	212	over a ten-year period, to be paid no later than January 31 each
213	213	year. The Beginning July 1, 2022, the Board shall provide a bonus

241	241	annually over a ten-year period, to be paid not later than January
242	242	31 each year, to any teacher who:
243	243	a. attains National Board certification after June 30,
244	244	2013, if the teacher was s elected for the Education
245	245	Leadership Oklahoma program before June 30, 201 3, or
246	246	the teacher has submitted an application for National
247	247	Board certification to the National Board for
248	248	Professional Teaching Standards before June 30, 2013
249	249	after July 1, 2022,
250	250	b. attained National Board cert ification before July 1,
251	251	2022, and was receiving a bonus in the amount of Fiv e
252	252	Thousand Dollars ($5,000.00) annually, for the
253	253	remaining time of the ten-year period, or
254	254	c. attained National Board certification before July 1,
255	255	2022, and was receiving an additional salary increment
256	256	pursuant to the Minimum Salary Schedule in Section 18-
257	257	114.14 of this title, for the remaining time of the
258	258	ten-year period.
259	259	2. The teachers eligible to receive the annual bonus as
260	260	provided for in paragraph 1 of this subsection shall receive the
261	261	annual bonus for the ten -year duration of their National Board
262	262	certification or for the remaining duration of their National Boar d
263	263	certification if they have less than ten (10) years remaining in

290	290	their certification and so long as they are teaching in the
291	291	classroom full-time in an Oklahoma public school. No school or
292	292	school district shall be liable for payment of bonuses pursuant to
293	293	this section.
294	294	3. The bonus shall not be included in the calculation of the
295	295	teacher's salary for purposes of meeting the district or statutory
296	296	minimum salary schedule Minimum Salary Schedule or for purposes of
297	297	compensating Oklahoma Teachers ' Retirement System contributions or
298	298	benefits.
299	299	4. Teachers eligible to receive the annual bonus as provided
300	300	for in paragraph 1 of this s ubsection shall not be eligible to
301	301	receive the additional sala ry increment for National Board
302	302	certification as set forth in the minimum salary schedule in Section
303	303	3 of this act.
304	304	5. Teachers who attain National Board certification after June
305	305	30, 2013, shall be eligible to receive the additiona l salary
306	306	increments for National Board certification as set forth in the
307	307	minimum salary schedule in Section 3 of this act.
308	308	6. The State Board of Education shall promulgate rules for a
309	309	process by which a National -Board-certified teacher will verify
310	310	that:
311	311	a. the National Board cer tification has not lapsed,
312	312	b. the teacher is still a full -time teacher, and

340	340	not exceeded the limit of annual bonus payments as
341	341	provided for in paragraph 1 of this subsection.
342	342	J. It is the intent of t he Legislature that the Oklahoma State
343	343	Regents for Higher Educatio n incorporate the National Board
344	344	certification portfolio development into all programs in education
345	345	leading to a master's level degree.
346	346	SECTION 2. AMENDATORY 70 O.S . 2021, Section 18-114.14,
347	347	is amended to read as follows:
348	348	Section 18-114.14 A. Beginning with the 2018-2019 2022-2023
349	349	school year, certified personnel, as defined in Section 26 -103 of
350	350	this title, in the public schools of Oklahoma shall receive in
351	351	salary and/or fringe benefits not less than the amounts specified in
352	352	the following schedule:

490	490	B. 1. When determining the Minimum Salary Schedule, "fringe
491	491	benefits" shall mean all or part of retirement benefits, exc luding
492	492	the contributions made pursuant to subsection A of Section 17 -108.1
493	493	of this title and the flexible benefit allowance pursuant to Section
494	494	26-105 of this title from the flexible benefit allowance funds
495	495	disbursed by the State Board of Education and the State Board of
496	496	Career and Technology Education pursuant to Section 26 -104 of this
497	497	title.
498	498	2. If a school district intends to provide retirement benefits
499	499	to a teacher such that the teacher 's salary would be less tha n the
500	500	amounts set forth in the minimum salary schedule Minimum Salary
501	501	Schedule specified in subsection A of this section, the district
502	502	shall be required to provide written notification to the teacher
503	503	prior to his or her employment o r, if already employed by the
504	504	district, no later than thirty (30) days prior to the date the
505	505	district elects to pr ovide retirement benefits such that the
506	506	teacher's salary would be less than the minimum salary schedule
507	507	Minimum Salary Schedule .
508	508	C. Any of the degrees referred to in this s ection shall be from
509	509	a college recognized by the State Board of Education. The Bo ard
510	510	shall accept teaching experience from out-of-state school districts
511	511	that are accredited by the state board of education or appropriate
512	512	state accrediting agency for the di stricts. The Board shall accept

540	540	or otherwise endorsed by the appropriate national or regional
541	541	accrediting or endorsement authority. Out -of-country certification
542	542	documentation in a langua ge other than English shall be analyzed b y
543	543	an educational credential evaluation se rvice in accordance with
544	544	industry standards and guidelines and approved by the State
545	545	Department of Education. The person seeking to have credi t granted
546	546	for out-of-country teaching experience shall be responsible fo r all
547	547	costs of the analysis by a credenti al evaluation service. T he Board
548	548	shall accept teaching experience from primary and secondary schools
549	549	that are operated by the United States De partment of Defense or are
550	550	affiliated with the United States Department of State.
551	551	D. For the purpose of state sa lary increments and retir ement,
552	552	no teacher shall be granted credit for more than five (5) years of
553	553	active duty in the military service or out -of-state or out-of-
554	554	country teaching experience as a certified teacher or its
555	555	equivalent. Nothing in this section shall prohibit boards of
556	556	education from crediting more years of experience on district salary
557	557	schedules than those allowed for state purposes.
558	558	E. The State Board of Educatio n shall recognize, for purposes
559	559	of certification and salary increments, all the ye ars of experience
560	560	of a:
561	561	1. Certified teacher who teaches in the educational program of
562	562	the Department of Corrections, beginning with fiscal ye ar 1981;

590	590	Human Services if the counselor was empl oyed as a certified teach er
591	591	by the State Department of Education when the Division of Vocational
592	592	Rehabilitation was transferred from the State Board of Career and
593	593	Technology Education or the State Board of Education to the Oklahoma
594	594	Public Welfare Commissio n on July 1, 1968;
595	595	3. Vocational rehabilitation counselor which were completed
596	596	while employed by the Department of Human Services if such coun selor
597	597	was certified as a teache r or was eligible for certification as a
598	598	teacher in Oklahoma;
599	599	4. Certified teache r which were completed wh ile employed by the
600	600	Child Study Center located at University Hospital, if the teacher
601	601	was certified as a teacher in Ok lahoma; and
602	602	5. Certified school psychologist or psychometrist which wer e
603	603	completed while employed as a doctoral intern, psychological
604	604	assistant, or psychologist with any agency of the State of Oklahoma
605	605	if the experience primarily involved work with person s of school- or
606	606	preschool-age and if the person was, at the time the exp erience was
607	607	acquired, certified as, or el igible for certification as, a school
608	608	psychologist or psychometrist.
609	609	F. The provisions of this section shall not apply to teachers
610	610	who have entered into postretirement emplo yment with a public school
611	611	in Oklahoma and are still receiving a monthly retiremen t benefit.

638	638	G. If a person employed as certified personnel, as defined in
639	639	Section 26-103 of this title, by a school district during the 2017 -
640	640	2018 school year was receiving a salary above the step level
641	641	indicated by the State state Minimum Salary Schedule for the 2017-
642	642	2018 school year, the person shall receive a salary increase amount
643	643	equal to the amount indicated in subsection A for the step leve l
644	644	indicated for the person, pro vided they remain employed by the same
645	645	district, unless the hours or the duties of the c ertified personnel
646	646	are reduced proportionately.
647	647	SECTION 3. This act shall become effective July 1, 2022.
648	648	SECTION 4. It being immediate ly necessary for the preservation
649	649	of the public peace, health or safety, an emergency is hereby
650	650	declared to exist, by reason whereof thi s act shall take effect and
651	651	be in full force from and after its passage and approval.
