5656 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOM A:
5757 SECTION 1. AMENDATORY 70 O.S. 2021, Section 6 -204.2, is
5858 amended to read as follows:
5959 Section 6-204.2 A. The Oklahoma Commission for Teacher
6060 Preparation Educational Quality and Accountability and the State
6161 Board of Education ar e authorized to establish the E ducation
6262 Leadership Oklahoma program.

9191 1. Provide teachers throughout the sta te information about
9292 National Board certification and the Education Leadership Oklahoma
9393 program services;
9494 2. Provide technical assistance and National -Board-certified
9595 mentors to all teachers s eeking National Board certification upon
9696 request;
9797 3. Reward teachers who are seeking National Board certification
9898 by awarding them a portion of the application processing charge and
9999 assessment fee and scholarship as provided in subsection D of this

101101 4. Provide recognition to National -Board-certified teachers.
102102 C. To fulfill the objectives of the Education Leadership
103103 Oklahoma Act, the Oklahoma Commission for Teacher Preparation
104104 Educational Quality and Accountability shall:
105105 1. Inform teachers of the Education Leadership Oklahoma pro gram
106106 and services it provides to teachers seeking National Board
107107 certification, emphasizing recruiting efforts toward teachers at
108108 high-poverty schools, schools identified as in need of improvement
109109 and in counties with the lowest percentage of teachers who have
110110 achieved National Board certification; and
111111 2. Ensure that all teachers seeking National Board
112112 certification receive adequate in formation regarding the level of
113113 commitment required to acquire National Board certification.

140140 D. The Commission shall sele ct not more than one hun dred
141141 applicants to participate in the program each fiscal year for whom
142142 the Commission shall pay one -half (1/2) of the application
143143 processing charge and assessment fee for National Board
144144 certification. The total amount paid by the Commission shall not
145145 exceed One Thousand Three Hundred Dollars ($1,300.00). In addition
146146 the Commission shall also provide to the sel ected applicants a
147147 scholarship in the amount of Five Hundred Dollars ($500.00) to cover
148148 other expenses associated with obta ining National Board
149149 certification.
150150 E. The Commission shall promulgate rules establishing a process
151151 for accepting applications for t he Education Leadership Oklahoma
152152 program and for providing to applicants selected for the program up -
153153 front payment of the a pplication processing ch arge and assessment
154154 fee and scholarship. If a selected applicant who receives the up-
155155 front payment does not complete National Board certification within
156156 three (3) years, the applicant shall repay the Commission the full
157157 amount paid by the Commission pursu ant to subsection D of this
158158 section. All selected applicants who do not recei ve an up-front
159159 payment and successfully complete National Board certification shall
160160 be reimbursed by the Commission for the application processing
161161 charge and assessment fee. The total amount of reimbursement paid
162162 by the Commission shall not exceed One Tho usand Three Hundred
163163 Dollars ($1,300.00).

190190 F. It is the intent of the Legislature that the Oklahoma
191191 Commission for Teacher Preparation Educational Quality and
192192 Accountability contract with Southeastern Oklahoma State University
193193 to establish Education Leaders hip Oklahoma program training i n
194194 higher education teacher preparation programs in the state to assist
195195 teachers in meeting the requirements to obtain National Board
196196 certification.
197197 G. All teachers seeking National Board certification shall be
198198 eligible to participate in Education Leadersh ip Oklahoma program
199199 training to assist them in meeting the requirements of the National
200200 Board certification process, free of charge.
201201 H. Subject to district board of education policy or collective
202202 bargaining agreement, additi onal professional leave days ma y be
203203 granted to teachers seeking National Board certification for
204204 National Board certification portfolio development. During the two
205205 (2) days of the additional professional days granted to teachers for
206206 National Board certifi cation portfolio development, a substitute
207207 teacher shall be provided by the school district at no cost to the
208208 teacher.
209209 I. 1. The State Board of Education shall provide to teach ers
210210 who attained National Board certification prior to June 30, 2013, a
211211 bonus in the amount of Five Thousand Dollars ($5,000.00) annually
212212 over a ten-year period, to be paid no later than January 31 each
213213 year. The Beginning July 1, 2022, the Board shall provide a bonus

240240 in the amount of Seven Thousand Five Hundred Dollars ($7,500.00)
241241 annually over a ten-year period, to be paid not later than January
242242 31 each year, to any teacher who:
243243 a. attains National Board certification after June 30,
244244 2013, if the teacher was s elected for the Education
245245 Leadership Oklahoma program before June 30, 201 3, or
246246 the teacher has submitted an application for National
247247 Board certification to the National Board for
248248 Professional Teaching Standards before June 30, 2013
249249 after July 1, 2022,
250250 b. attained National Board cert ification before July 1,
251251 2022, and was receiving a bonus in the amount of Fiv e
252252 Thousand Dollars ($5,000.00) annually, for the
253253 remaining time of the ten-year period, or
254254 c. attained National Board certification before July 1,
255255 2022, and was receiving an additional salary increment
256256 pursuant to the Minimum Salary Schedule in Section 18-
257257 114.14 of this title, for the remaining time of the
258258 ten-year period.
259259 2. The teachers eligible to receive the annual bonus as
260260 provided for in paragraph 1 of this subsection shall receive the
261261 annual bonus for the ten -year duration of their National Board
262262 certification or for the remaining duration of their National Boar d
263263 certification if they have less than ten (10) years remaining in

290290 their certification and so long as they are teaching in the
291291 classroom full-time in an Oklahoma public school. No school or
292292 school district shall be liable for payment of bonuses pursuant to
293293 this section.
294294 3. The bonus shall not be included in the calculation of the
295295 teacher's salary for purposes of meeting the district or statutory
296296 minimum salary schedule Minimum Salary Schedule or for purposes of
297297 compensating Oklahoma Teachers ' Retirement System contributions or
298298 benefits.
299299 4. Teachers eligible to receive the annual bonus as provided
300300 for in paragraph 1 of this s ubsection shall not be eligible to
301301 receive the additional sala ry increment for National Board
302302 certification as set forth in the minimum salary schedule in Section
303303 3 of this act.
304304 5. Teachers who attain National Board certification after June
305305 30, 2013, shall be eligible to receive the additiona l salary
306306 increments for National Board certification as set forth in the
307307 minimum salary schedule in Section 3 of this act.
308308 6. The State Board of Education shall promulgate rules for a
309309 process by which a National -Board-certified teacher will verify
310310 that:
311311 a. the National Board cer tification has not lapsed,
312312 b. the teacher is still a full -time teacher, and

339339 c. for teachers eligible for the bonus, the teacher has
340340 not exceeded the limit of annual bonus payments as
341341 provided for in paragraph 1 of this subsection.
342342 J. It is the intent of t he Legislature that the Oklahoma State
343343 Regents for Higher Educatio n incorporate the National Board
344344 certification portfolio development into all programs in education
345345 leading to a master's level degree.
346346 SECTION 2. AMENDATORY 70 O.S . 2021, Section 18-114.14,
347347 is amended to read as follows:
348348 Section 18-114.14 A. Beginning with the 2018-2019 2022-2023
349349 school year, certified personnel, as defined in Section 26 -103 of
350350 this title, in the public schools of Oklahoma shall receive in
351351 salary and/or fringe benefits not less than the amounts specified in
352352 the following schedule:

490490 B. 1. When determining the Minimum Salary Schedule, "fringe
491491 benefits" shall mean all or part of retirement benefits, exc luding
492492 the contributions made pursuant to subsection A of Section 17 -108.1
493493 of this title and the flexible benefit allowance pursuant to Section
494494 26-105 of this title from the flexible benefit allowance funds
495495 disbursed by the State Board of Education and the State Board of
496496 Career and Technology Education pursuant to Section 26 -104 of this
497497 title.
498498 2. If a school district intends to provide retirement benefits
499499 to a teacher such that the teacher 's salary would be less tha n the
500500 amounts set forth in the minimum salary schedule Minimum Salary
501501 Schedule specified in subsection A of this section, the district
502502 shall be required to provide written notification to the teacher
503503 prior to his or her employment o r, if already employed by the
504504 district, no later than thirty (30) days prior to the date the
505505 district elects to pr ovide retirement benefits such that the
506506 teacher's salary would be less than the minimum salary schedule
507507 Minimum Salary Schedule .
508508 C. Any of the degrees referred to in this s ection shall be from
509509 a college recognized by the State Board of Education. The Bo ard
510510 shall accept teaching experience from out-of-state school districts
511511 that are accredited by the state board of education or appropriate
512512 state accrediting agency for the di stricts. The Board shall accept

539539 teaching experience from out-of-country schools that are accredited
540540 or otherwise endorsed by the appropriate national or regional
541541 accrediting or endorsement authority. Out -of-country certification
542542 documentation in a langua ge other than English shall be analyzed b y
543543 an educational credential evaluation se rvice in accordance with
544544 industry standards and guidelines and approved by the State
545545 Department of Education. The person seeking to have credi t granted
546546 for out-of-country teaching experience shall be responsible fo r all
547547 costs of the analysis by a credenti al evaluation service. T he Board
548548 shall accept teaching experience from primary and secondary schools
549549 that are operated by the United States De partment of Defense or are
550550 affiliated with the United States Department of State.
551551 D. For the purpose of state sa lary increments and retir ement,
552552 no teacher shall be granted credit for more than five (5) years of
553553 active duty in the military service or out -of-state or out-of-
554554 country teaching experience as a certified teacher or its
555555 equivalent. Nothing in this section shall prohibit boards of
556556 education from crediting more years of experience on district salary
557557 schedules than those allowed for state purposes.
558558 E. The State Board of Educatio n shall recognize, for purposes
559559 of certification and salary increments, all the ye ars of experience
560560 of a:
561561 1. Certified teacher who teaches in the educational program of
562562 the Department of Corrections, beginning with fiscal ye ar 1981;

589589 2. Vocational rehabil itation counselor under the Department of
590590 Human Services if the counselor was empl oyed as a certified teach er
591591 by the State Department of Education when the Division of Vocational
592592 Rehabilitation was transferred from the State Board of Career and
593593 Technology Education or the State Board of Education to the Oklahoma
594594 Public Welfare Commissio n on July 1, 1968;
595595 3. Vocational rehabilitation counselor which were completed
596596 while employed by the Department of Human Services if such coun selor
597597 was certified as a teache r or was eligible for certification as a
598598 teacher in Oklahoma;
599599 4. Certified teache r which were completed wh ile employed by the
600600 Child Study Center located at University Hospital, if the teacher
601601 was certified as a teacher in Ok lahoma; and
602602 5. Certified school psychologist or psychometrist which wer e
603603 completed while employed as a doctoral intern, psychological
604604 assistant, or psychologist with any agency of the State of Oklahoma
605605 if the experience primarily involved work with person s of school- or
606606 preschool-age and if the person was, at the time the exp erience was
607607 acquired, certified as, or el igible for certification as, a school
608608 psychologist or psychometrist.
609609 F. The provisions of this section shall not apply to teachers
610610 who have entered into postretirement emplo yment with a public school
611611 in Oklahoma and are still receiving a monthly retiremen t benefit.

638638 G. If a person employed as certified personnel, as defined in
639639 Section 26-103 of this title, by a school district during the 2017 -
640640 2018 school year was receiving a salary above the step level
641641 indicated by the State state Minimum Salary Schedule for the 2017-
642642 2018 school year, the person shall receive a salary increase amount
643643 equal to the amount indicated in subsection A for the step leve l
644644 indicated for the person, pro vided they remain employed by the same
645645 district, unless the hours or the duties of the c ertified personnel
646646 are reduced proportionately.
647647 SECTION 3. This act shall become effective July 1, 2022.
648648 SECTION 4. It being immediate ly necessary for the preservation
649649 of the public peace, health or safety, an emergency is hereby
650650 declared to exist, by reason whereof thi s act shall take effect and
651651 be in full force from and after its passage and approval.
