52	52	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
53	53	SECTION 1. AMENDATORY 2 O.S. 2021, Section 11-92, is
54	54	amended to read as follows:
55	55	Section 11-92. A. Every scrap metal dealer shall keep a
56	56	separate book, record or other electronic recording system as
57	57	authorized by the Oklahoma Scrap Metal Dealers A ct, to record and
58	58	maintain the following data from any seller of any amount of scrap
59	59	metal as defined by the Oklahoma Scrap Metal Dealers Act:
60	60	1. A legible photocopy of the seller 's driver license or
61	61	government-provided photo identification, issued by the United
62	62	States government, State of Oklah oma, or any other state of the
63	63	United States, or any other federally recognized identification that

91	91	photo identification does not contain an address , an address shall
92	92	be provided;
93	93	2. Vehicle description and license tag number, or vehicle
94	94	identification number if no state license plate is affixed, if the
95	95	vehicle was used to transport the material being so ld;
96	96	3. Date and place of the transaction and the transaction number
97	97	as provided by the scrap metal dealer;
98	98	4. Description of the items sold and weight of the items as
99	99	required by the provisions of the Oklahoma Scrap Metal Dealers Act;
100	100	5. Whether the scrap metal is in wire, cable, bar, rod, sheet
101	101	or tube form; and
102	102	6. The digital image of t he items purchased and the digital
103	103	image of the seller. The digital image shall contain depictions
104	104	that clearly identify the items sold and are captured in the common
105	105	JPEG format. The digital image shall be retai ned by the purchaser
106	106	for a minimum of nine ty (90) days from the date of purchase.
107	107	B. Municipalities or other political subdivisions may designate
108	108	the reporting methods and the format of the information require d by
109	109	subsection A of this section, either writ ten, electronic or
110	110	Internet-based. The Oklahoma Department of Agriculture, Food, and
111	111	Forestry shall designate an Internet -based reporting method that
112	112	applies to all geographic areas of the state that are not s ubject to
113	113	a local designation for Internet rep orting.

140	140	C. Records required by this secti on shall be retained for no
141	141	less than two (2) years from the date of transaction and shall be
142	142	made available at any time to any person authorized by law for such
143	143	inspection.
144	144	D. It shall be unlawful for any scrap m etal dealer to purchase
145	145	any item from a minor under the age of sixteen (16) without having
146	146	first obtained the consent, in writing, of a parent or guardian of
147	147	such minor. Such written consent shall be kept with the book,
148	148	record or other electronic recordin g system required by subsection A
149	149	of this section and, if requested by a law enforcement agency where
150	150	the purchase was made, shall be transmitted to the law enforcement
151	151	agency and may be kept as a permanent rec ord and made available for
152	152	public inspection.
153	153	E. A scrap metal dealer shall obtain from each seller of a
154	154	scrap metal item regulated by the Oklahoma Scrap Metal Dealers Act,
155	155	or a parent or guardian on behalf of a minor, a written declaration
156	156	of ownership containing a legible signature of the seller. The
157	157	declaration of ownership shall be in t he following form and shall
158	158	appear on the bill of sale or transaction ticket to be completed by
159	159	the seller in the presence of the purchaser at the time of the
160	160	transaction:
161	161	"I hereby affirm that I am the rightful ow ner of the hereon
162	162	described merchandise; o r I am an authorized representative of the

191	191	I state under penalty of perjury under the laws of Oklahoma that

195	195	F. If requested by a law enforcement agency, a scrap metal
196	196	dealer shall report in writing all purchases of scrap metal as
197	197	defined by the Oklahoma Scrap Metal Dea lers Act within forty-eight
198	198	(48) hours following such purchase. The report shall contain all
199	199	the information required by this section.
200	200	G. 1. Prior to the purchase of a used motor vehicle, trailer
201	201	or nonmotorized recreational vehicle, the scrap metal dea ler shall
202	202	require one of the following forms of proof of ownership from the
203	203	person selling the used motor vehicle, trailer or nonmotorized
204	204	recreational vehicle:
205	205	1. A
206	206	a. a certificate of title that matches the vehicle
207	207	identification number of the vehicle b eing sold;,
208	208	2. A
209	209	b. a notarized power of attorney from the individual on
210	210	the certificate of title authorizing the seller to
211	211	dispose of the vehicle on behalf of the owner ;, or
212	212	3. A

239	239	c. a statement of ownership from the seller stating t hat
240	240	the vehicle was purchased from the lawful owner,
241	241	accompanied by a bill of sale from the lawful owner
242	242	including a statement that there are no outstanding
243	243	liens on the vehicle, and a statement that the vehicle
244	244	is inoperable or incapable of operation or u se on the
245	245	highway and has no resale value except as scrap.
246	246	2. A scrap metal dealer shall obtain the vehicle identification
247	247	number of the used motor vehicle and confirm with law enforce ment
248	248	that the vehicle is not stolen at least twenty-four (24) hours prior
249	249	to the destruction of the vehicle. No vehicle shall be destroyed
250	250	for at least seven ( 7) days after the date of purchase.
251	251	3. The provisions of this subsection shall not apply to sales,
252	252	purchases or other transfers of vehicles between scrap metal dealers
253	253	and licensed automotive dismantlers and parts recyclers, licensed
254	254	crushers, salvage dealers, used car dealers and licensed wreckers.
255	255	H. A scrap metal dealer shall not enter into any cash
256	256	transactions in excess of One Thousand Dollars ($1,000.00) in
257	257	payment for the purchase of scrap metal that is listed in subsection
258	258	C of Section 11-93 of this title unless the transaction is made with
259	259	an exempted seller. Payment by check shall be issued and made
260	260	payable only to the seller of the scrap metal whose identification
261	261	information has been obtained pursuant to the provisions of t his
262	262	section.

289	289	I. The following shall be exempt from this section:
290	290	1. Scrap metal hauled by a scrap metal dealer for an exempted
291	291	seller in a motor vehicle registered with the Oklahoma Department of
292	292	Transportation; and
293	293	2. Material delivered by an exempted seller with a check made
294	294	payable to the company of the exempted seller.
295	295	SECTION 2. This act shall become effectiv e November 1, 2022.
