41	41	requiring biological father to pay a percentage of
42	42	certain expenses; providing exception; providing for
43	43	reduction of percentage under certain circumstances;
44	44	providing for retroactive application ; directing
45	45	court to order payment under certain circumstances;
46	46	providing for codification; and providing an

54	54	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
55	55	SECTION 1. NEW LAW A new section of law to be codified
56	56	in the Oklahoma Statutes as Section 112.1B of Title 43, unless there
57	57	is created a duplication in numbering, reads as follows:
58	58	A. In this section, "pregnancy expenses" means an amount equal
59	59	to:
60	60	1. The sum of a pregnant mother 's:
61	61	a. health insurance pre miums while pregnant that are not
62	62	paid by an employer or government program , and

89	89	b. medical costs related to the pregnancy, incurr ed after
90	90	the date of conception and before the pre gnancy ends;
91	91	minus
92	92	2. Any portion of the amount de scribed in paragraph 1 of this
93	93	subsection that a court determin es is equitable based on the
94	94	totality of the circumstances , not including any amoun t paid by the
95	95	mother or biological father of the child.
96	96	B. 1. Except as otherwise provided in this section, the
97	97	biological father of a child has a duty to pay fifty percent (50%)
98	98	of the mother's pregnancy expenses.
99	99	2. If paternity is disputed, the biological father owe s no duty
100	100	under this section until the biological father's paternity is
101	101	established.
102	102	3. Any portion of a mother 's pregnancy expenses paid by the
103	103	mother or the biological father reduces that parent 's fifty-percent
104	104	share under subsection B of this section, not the total amount of
105	105	pregnancy expenses, and shall apply regardless of when the mother or
106	106	biological father pays the pregnancy expense s.
107	107	4. Pregnancy expenses may be retroactively collected and
108	108	awarded, including in the case where paternity is established
109	109	subsequent to the birth of the child.
110	110	C. If a person seeks pa yment under subsection B of this section
111	111	by providing documentation of payments, medical expenses, and
